      The ICJ has found a "prima facea" case, which puts the signatories of the Genocide Convention under the law.
      If Israel had succeeded in removing the case, the court would say so. It didn't.
      Now this ties the UK, USA, European countries and Canada into stopping any acts of genocide of the Palestinian people.
      Sanctions CAN be applied to all of these countries if they DON'T do something immediately.
      South Africa DID make it's case, and the incitement of ANYONE is directly ordered to stop immediately.

      Just to be clear, the ICJ needs more time to prove Genocide. So for now, there is no Genocide from a Legal point of view, innocent until proven guilty. But on a positive note, the ICJ did order Isreal to prevent Genocide. All in all, you should not look at the ICJ as a classical court but rather as a political tool to try prevent or stop war.....that is how international law works.

    • @kathleencove
      @kathleencove Před 3 měsíci +7

      Technically it’s an order to stop killing civilians. So not a complete ceasefire, a partial ceasefire. The court did not order them to stop killing Hamas combatants, so it’s not a complete ceasefire of all arms, but, if Israel follows the orders to prevent genocide, it should stop the airstrikes, land mines. and leveling of buildings. It should also provoke an investigation into genocidal rhetoric by politicians within Israel and IDF generals and soldiers. Israel is to report back how they’ve changed their warfare tactics to prevent civilian casualties, and investigations of IDF members and politicians within a month from now. In all likelihood this probably means that targeted campaigns of gun and non-WMD weapons against Hamas will still be allowed. Hamas has also been warned to not use WMDs, and to release hostages. The ICJ did not require Israel to release Palestinian political prisoners and hostages from before October 7th that they have in their secretive prison camp 1391 near Tel Aviv, in exchange for the hostages Hamas has, just unconditional release of hostages by Hamas. Hopefully, the ICJ’s ruling will at least prevent further air strikes and mines and attacks on civilians in Gaza.

    The recent ICJ ruling deals a significant blow to Arab states like UAE, Bahrain, and Saudi Arabia, which consistently sought to defend Israel in forums such as OIC and the Arab League throughout the conflict. While some may argue this is disinformation, the fact remains. Arab states were expected to pursue this case, but unexpectedly, South Africa took charge. It appears that major Arab states, under pressure or seeking face-saving measures, supported this case to demonstrate concern for Palestinians. In reality, Saudi Arabia and the UAE were evidently embarrassed by South Africa's action. Nonetheless, kudos to South Africa for persisting with this case even in the face of substantial pressure from the US, EU, and the UAE. "Not all battles are fought for victory; some are fought to tell the world that someone was there who stood against tyranny".

      SA did emerge victorious, although genocide supporters deny it and pretend to celebrate. The ICJ orders Israel to stop killing Palestinians and not do anything (for example, starving Palestinians) that would amount to genocide. This is as good as can be.
      One great value of this ruling is that it gives a big justification for people, especially Americans, to pressure their government to stop the genocide.

YES they don't say ceasefire in layman terms, but they still confirm South Africa;s war crime concerns and have set judgments on Israel to cease its assault and bombardment in Gaza. This sets a precedent for MORE charges on the apartheid state. I expect next others will file in the international criminal court. Although it didn't result in ceasefire mandate(YET) I am pleased that they cited key points in South Africa's favor especially saying that they found "some" examples to be valid in the charge of genocide. Third provision measures 15/2 majority to do measures to prevent and punish those to uphold Genocide act 2a) to d)

      You are absolutely right, the judge was super professional and fulfilled her obligations with exceptional precision. The court refused to israel to dismiss the claim, agreed that it was appropriate, and proceeded to the hearing, finding that South Africa had every reasonable fear of committing genocide. Moreover, the court saw possible violations of the convention in Israel’s actions, asked to stop these actions and provide a report on the termination of actions.

    It's a shame that the court failed to order an immediate ceasefire. And I would like to ask these judges as to how do they expect the people of Gaza to survive for one month without food, water, clothes, medicine, etc by which time they will learn that Isreal has done no or wholly halfhearted efforts to comply to the courts order while this genocide continues. I wish some of the judges and their relatives were subjected to these same conditions as being experienced by the Gazan population then we would see how quickly they would order not just a ceasefire but also the lifting of the siege and occupation of Palestine. What a shameful judgement.
