Had the exact issue with my FOO passenger door handle & that was the final straw for my family & I. As previously stated on your channel. After 4 months of owning a FOO here in the UK, in January we returned for a full refund. Thank goodness we did, but 1000's have lost & Henry Fisker should be ashamed of his attempt to run a automobile car company!
It was a very fast decline

@@ryanboyd6192 I can guess - in the UK if you have financing on a car, the bank becomes jointly liable for your purchase. Essentially, you tell the bank you're dissatistified with the quality but can't resolve it with the seller (Fisker) and they have to, by law, take the car back from you and return your funds, minus a discount for fair wear and tear (so they can take a little bit off for mileage and damage.)
@tomsixsix in the UK we have a consumer code that states "not fit for purpose". This allows people to claim full refunds. If the goods don't match the seller's descriptions or don't function in the correct way the goods should do. It's a very powerful consumer law and right. 😊
@@ryanboyd6192 Our FOO was financed. I reported to the finance Company that the vehicle was not safe to drive due to issues with the regen braking & endles other faults as reported on this channel. The finance Company contacted Fisker UK & enforced our right to return the vehicle for a full refund. Fisker accepted. Collected the FOO from my home & refunded my deposit vack to me & refunded the Finance Company with 10 working days.
Fleet sale was apparently submitted. $46M for 3300 vehicles so roughly $14k per unit.

Spoke with a consumer protection lawyer about this. Being on the creditor matrix alone apparently doesn't mean much. Anyone on that list or not who has a claim will still have to file a Proof of Claim Form 410 within the deadline set by the court (Not sure if one has been determined yet!?) This lawyer suggested to put the full purchase price, since there is essentially no residual value left. Little to no expectations to get anything out of it for any individual though due to a lack of assets to be divvied up. The second thing I am looking into is if Fisker Finance / Chase can be held accountable for fraud, since the company was already in financial trouble and pretty much used this scheme of a partnership with Chase to collect some cash and push 100% of the liability to the buyers. Chase willingly participated for profit, knowing that their Branded Fisker Finance partnership was already doomed to fail... Wonder how many FOO owners financed through them?

I don’t know why I’m still watching any videos about Fisker as, as they say, “there by the grace of god go I “ as I nearly purchased one earlier this year but didn’t go ahead. Adam It’s fascinating seeing how in depth you are able to go with research into the downfall of the company so I’ll keep watching for that info. Maybe you should publish a book about the demise of the company once things are settled down. Keep up the good work - it’s way more interesting than non-stop Euro Soccer matches and, god save us , this week for 2 weeks we start Wimbledon and non stop tennis on the main UK TV channels.

Similar to one of your other viewer, LA City Cars got the headlights I needed but couldn't service me because I hadn't bought the car there... fortunately, Henry the tech stationed there diligently contacted the techs and scheduled me a house visit for today. I can't stress enough how capable and willing these techs are to help the owners unlike the management...

@@Aslash304 found out that the reason for these "glitches" is more like Fisker won't pay the dealers for Warranty work so they will not do them for free, which makes sense from the POV of the dealers.

You got the translation a bit wrong, the liabilities the court accepted are only 10.92 million of the 1.15 billion the creditors claimed, the assests (of the austrian branch) are supposedly valued between 40 and 60 million € (they claimed 959 million) according to industry magazine (the source you quoted)

Question about the Owners association. Is membership still permitted if: I had to get rid of my FOO because a cracked windshield wasn’t able to be repaired, and out of fear of my insurance totaling it and being stuffed with a $45k-50k negative equity from an unsecured loan to be paid instantly, struck me as too stressful to possibly depression? Also an accessory receiver (hitch) that is as charged $800 for was never installed and was supposed to get a refund but never did and I don’t think I’ll ever get it. As well as the main screen blacking out and rendering the UI and safety settings useless making the vehicle unsafe to drive? (Long question but these were my issues that were not getting repairs for a month). I took the loss and got out and to my surprise Mach E GT with my company’s purchase program got me a steal of a deal and took my Ocean as is for full Auction price.
I’ve come to terms with it happy to be out of a deadweight, but whatever representation or ramifications that may come, I would like to be included and I fear the FOA is only meant for current owners and not past owners who had to do what I did.

Thank you Adam for all the information you’ve posted. Sometimes hard to stomach but all true unfortunately. If we are listed on the creditor matrix, is this a good thing? And if there’s any repayment to creditors (even a minuscule one), do we need to take any steps to ensure we are included in that? This whole experience has been very stressful. Was planning on keeping my FOO for a few years but decided to trade it in before it’s too late. Thanks again for all your work and investigation. Invaluable for me.

When a UK field enginner visited my home in an attempt to fix the door handle, he blamed Magna stating; 'The door handles & mechanism is/was from the Landrover Jaguar I-Pace', which Magna were using with Fisker full approval.

But, the I-Pace has been in production for five years and has not had a door handle recall, so something is different about it.
Henrik Fisker needs to go to Jail… He intentionally misled investors and we the buyers by selling a car that was unsafe. I hope the DOT, SEC and the IRS file criminal charges.

🤔 I think a company in chap 11 can’t emerge with a two-tier share structure. You’re not going to find the assets if part of the corporation is a private entity. Has there been malfeasance? Unethical business practise? No, what happened is there was no market for problematic EVs from a company that had filed for bankruptcy once before.
Adam, you do know that a chap 11 filing goes through an orderly court process, right?

@@tribalypredisposed You don’t seem to remember that a class action lawsuit was actually filed, but was subsequently superseded by the shorting operation. Shareholders overwhelmingly sold making the whole legal procedure out of the question. Now it’s in bankruptcy court in administration the finger of blame falls squarely on the lack of sales, rather than some sort of scheme in the brain of some sort of criminal intent. 🤷♀️

@@effingsix3825 Specifically, how did Fisker lack sales when Henrik told us end of February 2023 that they had 63,000 reservations? How do they end up selling less than 6,000 cars? How did Fisker “estimate “ production and sales of 42,000 when they only had the capital to make 10,000 and nowhere close to the staff to deliver 42,000? Because it was all lies, and when the company is listed on the stock exchange, huge material lies are criminal.
Every "brand ambassador" who knowingly hyped Fisker while they were in their death spiral should be outed and held responsible. They bashed MKBHD for his honest review(s) while continuing to push the Ocean as something decent.
