State Police Officer PIT’s Wrong Way Driver After Nearly Being Hit By Him

On the morning of March 31st, 2022, at approximately 1:34 am, I, Patrolman R. Lujan III was on patrol in the City of Albuquerque, County of Bernalillo, and State of New Mexico.
While on duty, I was traveling eastbound on Interstate 40 near milepost 165 when I came into visual contact with a pair of headlights traveling westbound within the eastbound lanes of Interstate 40. As the vehicle's headlights began closing distance to the front of my patrol unit, I observed the vehicle that was traveling within the number 2 lane apply their brakes and move to their left as the vehicle traveled the wrong way past their location. I engaged my emergency equipment in an attempt to warn other motorists. The vehicle was observed to be a lifted pickup and due to the vehicle not slowing down I moved my patrol unit to the number 4 lane from center and the vehicle traveled past my location. As the vehicle traveled past my patrol unit, I observed in my rear-view mirror a line of vehicles approaching the vehicle traveling the wrong way. Due to the vehicle not stopping for my emergency equipment and it was posing an immediate threat to the motorist on the roadway, I immediately made a U-turn and proceeded to travel westbound in eastbound lanes. The vehicle continued traveling westbound in the eastbound lanes at approximately fifty (50) miles per hour. I positioned my patrol unit alongside the passenger side of the vehicle. The vehicle continued to display no indication of yielding/stopping for my full emergency equipment (Lights and Sirens). While traveling at approximately forty-seven (47) miles per hour, I positioned the front driver side bumper and fender area and a pursuit intervention technique (PIT) maneuver was performed. Due to the vehicle being larger than my patrol unit, the maneuver was not successful in the manner it was designed to do so. As both the vehicle and my patrol unit veered to the right, both of our vehicles began slowing and came to a complete stop on the inside shoulder of eastbound Interstate 40 near milepost 165. As the vehicle came to a complete stop, I exited my patrol unit and conducted a high-risk traffic stop on the driver of the vehicle. After several commands were provided, the driver exited his vehicle. As the driver of the vehicle walked to the rear of his vehicle, his balance appeared to be unsteady, and he was observed taking short choppy steps. As I had the driver turn the front of his body away from mine, he was observed having to take a step to his left, which appeared to be in order to maintain his balance. The driver was instructed to get on the ground in the prone position and I then placed him in handcuffs behind his back without incident. The male driver and sole occupant of the vehicle was later identified as being Mr. Josh Greenling, (defendant) by his New Mexico driver's license. The Defendant was then assisted to his feet, and during the escort to my patrol unit, I observed him to have bloodshot watery eyes, a slurred speech, and I was able to detect an overwhelming odor of an alcoholic beverage emitting from his breath/person. The Defendant was then sat inside of my patrol unit. While sitting within my patrol unit handcuffed, I read the Defendant his Miranda Rights, which he verbally consented to speak with me. During the interview with the Defendant, I informed him the reason for the traffic stop and advised him of my observations. Due to my observations, I asked the Defendant about the consumption of alcoholic beverages prior to driving. The Defendant initially advised that he has not consumed anything to drink but advised that he has consumed his prescribed medication. The Defendant advised that he consumed four (4) pills approximately two (2) hours prior to the traffic stop. The Defendant was then asked a second time about the consumption of alcoholic beverages. The Defendant at that time admitted to consuming four (4) ninety-nine (99) apples approximately six (6) hours prior to the traffic stop. At this time, this concluded my interview with the Defendant. Due to the Defendant being in handcuffs and the events that lead up to this incident, no Standardized Field Sobriety Tests (SFST's) were administered. Upon the completion of my interview with the Defendant, based on my training and experience and my observations of the Defendant's driving, I observed the Defendant to display signs of impairment and determined the Defendant was unable to continue to operate a motor vehicle safely.
Additional important notes:
The Defendant’s first breath sample was a .23 and the second sample as being Insufficient. The Defendant was released to the Bernalillo Metropolitan Detention Facility staff upon the completion of the paperwork where he was booked and incarcerated without incident.

While the PIT didn't spin him out, I wouldn't say it was entirely a fail. The truck did stop 🤷♀️ that's a win in my book. Great job officer. Pitting a larger truck is difficult (even for ASP)
Who pays for the (rightfully) sacrificed police cruiser??
@@jimc6687 their pushbumpers are pretty robust, most of the time there isn't any damage from the "light tap" to the suspects vehicle. However, any of the vehicles losing control or bad techinque can of course cause damage to the cruiser. So in normal circumstances there is no "sacrifice" at all. However, if the police cruiser happened to be damaged the responsible party would be the suspect (or their insurance, if they have one). If the responsible party can't pay for it it's usually the departments responsibility to fix their cars (so basically city money). Some departments do have insurances that cover the costs in that case.
Thanks for that excellent response, Lydia......and all this makes sense (have you checked out that 'Grappler' product?? This should almost be standard equipment for highway patrol and well worth their $5K price in my opinion) but the problem arises with most insurance companies. They have amendment language in their policies that basically proclaim all bets are off if the vehicle is used in illegal activity such as DWI running from the police. Also, who pays for all the automatic EMS and often fire truck services called on virtually every crash scene? @@jimc6687 you're welcome. I've heard of the grappler, but I have never seen it used outside of their advertisement videos. No clue if it's effective or not, but I kinda think if it was the solution to all chase problems they seem to advertise, we would've seen more wiedespread adoption.
EMS usually bills the person receiving their services (or again, thir healthcare insurance, if applicable). If they can't pay it will go to collections and end up on their credit.
Ofc, there may be different laws in different states. If I remember correctly, NY passed a DWI law that required the EMS payment to get the license back for example.

I'd like to know why I was pulled over-----😱 OMG --- this was terrifying to watch. Can't imagine seeing a huge f-g truck barreling down a super hi way at 85 miles per hour,headed straight for me. Horror. ---- this officer is beyond brave---this human should never be permitted to OWN a vehicle again. He got off easy.
I have had surgeries numerous times and each time they prescribed medication they specifically state, “do not operate any vehicle or equipment, do not drink any alcohol” right on the label.

They always do. And you get paperwork with your prescription that states it as well. And if this guy is telling the truth, and I don’t believe he is, but if he’s telling the truth that he took the pills four hours earlier, and drank the alcohol six hours earlier that would mean he got behind the wheel of his truck knowing he was in this condition. Also, if he only had four drinks, six hours earlier, the effects of the alcohol would’ve worn off by then. This guy is so clearly lying.

He drank a hell of a lot more than four drinks, six hours ago, or he’s lying about when he drank and about how much he drank.
My aunt killed someone (and herself) bc she drove the wrong way down the highway. They don't know if she was confused, if she may have took to many pills or has an adverse reaction, or if she was trying to commit self asleep... We will never know though, they never did a report on if she was intoxicated or not

As a high school student, I aspired to be a police officer but today, I’m glad that I am not. Aspire to become anything you like but understand precisely what that entails. I respect law enforcement for their diligence and bravery…..

This guy is hammered! And he’s so drunk that he doesn’t even realize that he just ruined any defence he might’ve had. First off, if he’s on a drug that can alter his state of mind they always say right on the bottle and on the paperwork that you’re not to drive or operate heavy machinery. Secondly, he’s admitted to taking the pills two hours before, and drinking the alcohol six hours before. Well, it doesn’t take 2 to 6 hours for either of those to kick in. So he would have know what condition he was in long before he ever got behind the wheel of his truck. Yet did so anyway. And I think he’s lying about everything. I think he drank a lot more than four drinks, and I think he drank more recently than six hours before. And if he only had four drinks six hours earlier the effects of those drinks would’ve worn off by then. This guy should be profusely thanking this officer for literally saving his own life and the life of whomever he would’ve hit. And even if he would’ve survived a head-on collision this officer still saved him from spending years behind bars, and living a life of guilt for killing someone.
dang! wrong way drivers usually drives in the 'fast lane' or lane 1. he was in the middle of the flippin' highway. I'm glad I'm a home body nowadays and home and in my pj's by 9 or 10

It was not successful in the way it was designed. In this case it case both vehicles to be pushed to one side while the PIT maneuver is designed to immediately bring the pursuit to an end by causing the fleeing vehicle to spin out of control before coming to a stop. So while it did eventually bring both vehicles to a stop it didn’t work in the manner the officer was going for.

Guiding the vehicle to the side of the road, as this officer did, is much better than performing a PIT maneuver. Which would have sent the truck spinning sideways into the oncoming traffic.

Mixing drugs and alcohol is dangerous, especially with painkillers. And if he drank six hours earlier and upon being released from the hospital where is it he was drinking? And where is he going to and from now in his pyjamas? If he got released from the hospital six hours earlier and immediately went to the liquor store (which is what he’s saying) where has he been for the last six hours? And where’s he off to drunk in his pj’s at 1:30 in the morning?

The Trooper needs proper PIT training, and when to use, and when not to use. It was not a wise choice, considering the truck vs a low profile Charger. He should have to pay for damages to his car, not taxpayers. Poor decision making.
