  • The plaintiff purchased a car from the defendant that turn turned out to be a piece of junk that leaked oil. The plaintiff believes the defendant knew about the damages and is suing for a refund. The defendant says the plaintiff ran over a large screw, and she fixed it for free. Then the plaintiff came back and demanded her money back for no reason, so the defendant denies owing.

Why do people come on the People's Court complaining about USED cars? Even if you buy a car from a dealership, a used car should be checked out by an independent mechanic.

    • @themalissa

Exactly. It’s like people forget they’re allowed to have a car inspection done prior to making a down payment. Then why wait so long?!

@williamhudson2815 Great point!! It also makes sense from an insurance standpoint as well. I have only bought used cars from private individuals with no problems.
However, with new cars that I bought, I had a 2 - or 3-day time consideration when I could bring back the car for a full refund. Do you think a person could negotiate such a term with a used car?

They sold her a used car, she did not do her due diligence before purchasing it. They provided a warranty, which is absolutely not a requirement and very much outside of the norm for used car sales. The plaintiff failed to do her due diligence before purchasing the car and continue to make detrimental choices with how she handled the warranty.
She then proceeded to blame literally everybody else and took zero accountability. This is on her, completely.

So hard to believe there are so many people out there that are this dense when it comes to car purchases, warranties, etc.-if she didn’t understand all her paperwork, why didn’t she take someone with her, but instead she decides she’s just gonna give it back (which sounds like “buyers remorse” to me?!) Edit to add: The woman that busted in on the end of case interview has no idea what she's talking about. Even the Plaintiff agreed, she DID buy the Warranty. She opted not to use it. The unsigned paperwork that was an issue was the one that was supposed to be submitted for the deffered payment. How is Plaintiff's witness so mad when it was 100% the Plaintiff's fault she has no car?!?
Original: She didn't make payments and it was repossessed. She opted not to use the warranty she paid for. How is that the dealerships issue? Plus, she didn't even submit the deferred payment paperwork😂. I'm shocked she made it to court without getting lost.

I don't think dealers should fix anything for free or if they do make it clear they don't have to but they will to be nice. Doing it I think gives these buyers some false idea the dealer is responsible. But the dealer, in this case, is totally in the right.
