  • There are some misconceptions and misunderstandings around the NICS system. The purpose of this video is to educated the viewer on the NICS background check system and process. There are certain rules that govern the NICS system, which keeps them from holding your status indefinitely. I will discuss the process and the outcomes and why you may be delayed from receiving your purchase. Thanks for watching!

    In my state, I fill out the form, show my Carry Permit and I’m free to leave with my new firearm. Just added a new one to the family last week 👍🏼

      Yes, and most states are like that.... Until the Fed steps in and says your state's CCW is no longer as good as a background check. Then, you're just any other peon waiting, and waiting, and waiting.

      Must be nice. I have my CCW here in California and I still have to wait 10 days each time I buy a gun. My most recent purchase a Marlin 1894 Cowboy took 16 days for the background to go through due to DOJ being so backed up. Im not panic buying like the rest of the country. I have plenty guns and ammo to deal with what ever threat might present itself. I just wanted a Marlin 1984 with the octagon barrel. Me and lever action rifles have a love affair.

      Washington state got rid of being able to do that a few years ago. Now everyone has to wait for the background check. I waited 47 days to get a firearm and just received it last month.

      That’s one thing that sucks in New Hampshire. We’re a very gun friendly, constitutional carry state, BUT there is absolutely no way to get around having to take a background check for each and every purchase

    Good Video!!!! I ordered a Pistol,a month ago,during the down side of the panic buying,from a Large On-Line Retailer.It was shipped to my FFL and I had it in 8 Business Days. It took longer to fill out the 4473 than to get approved!!!!! I walk'd out of the Gun Shop in less than 20 minutes,WITH MY NEW PISTOL!!!!! He did say that most people are hung up for some reason and that they really must like me.I'll say,It felt really good walking out with my new toy.I actually thought that I might have to wait for It,after hearing about all of the HOOPLA.OF COURSE I'M NOT A FIRST TIME GUN BUYER EITHER!!!!!

    Thank you for this info. Im in that limbo state now in ny and could not understand why. After watching this i will not pester my ffl anymore and just let the system work. I was able to purchase a rifle and the nics did take a few days but now with my ccw im guessing its a more time consuming process. Either way i feel more educated on how the system works thank you.

    Been delayed 3 times this year. Never had this happen. I'm 36,been buying guns since I was 18....but 2020 has been the 1st year I've been delayed(3 times)

    I work for an ffl in Nevada. Here, we go through state to clear nics. Process used to be about a 5 minute hold on the phone and you'd get your response. This year it's been a challenge just to get on the phone with them. In March April 2 weeks of constant attempts without getting through. Or you would get through and on hold for 7 hours only to be disconnected. I have found out there are only 3 employees on duty at a given time, hence the delays. Initially we tried faxing but 60 apps were lost.
    Even now the average to get on the phone if you can is a 4 hour hold. It has calmed enough where we can fax again and they respond within 2 to 3 business days.

    In Florida, you still have to wait until your NICS goes through and then you can walk out with it. No CCW permit and you have to wait the required days. I have found that, the earlier in the day you buy, the less the wait time is. By about mid-morning or just after noon, the wait time will go from, roughly 30 minutes, to up near 3-6 hours.

      I'm in Florida and I have been wanting for a month in pending status. I spoke to the dealer and he told me he had a person who had to wait three months before the FDLE gave the approval. Does this sound right? Thanks

      @@mikescherrer4923 I’m in Florida from Florida and currently going through pending decision it’s been 2 days and mike scherrer Florida pass a law back in 2018 stating that Florida can put your transaction into decision pending after 3 days due to the shooting at the school parkland shooting . Moral of the story Florida made it to where 3 days doesn’t matter anymore it’s up to them now and it’s sucks because I just got conceal just went in to buy ar-15 now this waiting bs mind you not I already waited 5 months to get my conceals due to basically decision pending they had to further investigate

    What are the two rifles behind you? Is either one a 8mm Mauser perhaps? I've always gotten an immediate proceed for as long as they have been doing it. I bought 3 guns last week and still got immediate proceeds on them.

    I bought a gun about 2 weeks ago. Background check took 15 minutes or so. Will be picking up another firearm next week. Hopefully it’s about the same. Fingers crossed.
    In Florida even though I have a carry permit they still do NCIS check every time. Only benefit when purchasing is there is no waiting period for a hand gun if you have a carry permit. I have been delayed as long as 24 hours before. Pain in the butt.

    A friend of mine was denied and it was a mistake. He is a law-abiding citizen with a clean record and owns many firearms. It was a nightmare for him and had to sue the FBI to clear his name. Thanks for a very informative video. Cheers!

    I’ve never been denied but I’ve been delayed. I bought a Mosin over a decade ago and as I drove home I thought about the buy I got it was under $100; once I got home I threw the gun in the safe and went back. I bought another from the same store and was delayed; it blew the mind of both me and the associate as he was the one that called me in maybe 20 minutes before, when I passed. I said not a big deal and drove home; when I walked in I gad a message on the machine that it went through and I was good to go. I went back and picked it up and was glad the store was only maybe 6 miles away as if it was much further I would have been more annoyed. I’m a LEO that’s been printed and investigated a few time for different agencies and licenses and have only had thus one issue in quite a few purchases. The easiest time though I’ve ever had was having a Glock shipped to my agency; I called the county clerk and had the gun added to my pistol permit and they mailed me the updated permit. This was a few years back, NY has gotten tougher in the last few years; not that NY was ever 2A friendly.

    Took me 20 months in NY to get first hand gun. CCW. When I went to get permit, county clerk asked how long it took bc judges to them not to have anyone call with “how much longer until 18 months!”

    I live in New Jersey. I am currently in the process of purchasing my hand gun. I am now in week three. I purchased online and my local FFL just received the weapon yesterday. I had to pass two previous background checks just to get to the pint where my local FFL has to submit ANOTHER check. Yup, that's three background checks for NJ.

    So Cabela’s actually lied to me. They told me NICS held up the transfer for 12 days. First time I have ever been delayed in “many” purchases

      You should see what it’s like trying to buy a firearm in California... it’s horrible

      Or more likely it's just that stores policy to not transfer until they a definitive answer. Find that hard to be with Cabelas but no idea what state your in. Also really trash because they have no 9mm? A whole shit load of places don't have 9mm or .223 or 5.56 right now and those that do are setting limits on it. I.E local shop has a 80 rounds of 5.56 a day limit per person. 9mm is a big nope unless your buying some for the indoor range. Though the way our state is going that will probably be closed down now due to mandates.

    I was told by 2 seperate FFLs in Texas that during the pandemic buying frenzy NICS had actually extended the 5 day period for a couple of weeks. I was not delayed it was just in conversation. I wonder if perhaps NICS was just intimidating the dealers into thinking they could hold it up and the FFLs wanting not to be accused of breaking a rule and losing their income didn't question it.

    Thank goodness I have my concealed carry license. I fill out the 4473, hand the dealer my drivers license, concealed carry license, pay, and walk out with my firearm.

      That is how it is here in Iowa. If you buy a gun at a big box store, their store policy may require a NICS check. But it isn't required. My local gunshop checks the County website to see if my permit is valid...if so..👍good to go

      Curious if your state has legalized recreational or medical marijuana use. I’m in Michigan. Have had my CPL for 15 years. That’s counted as a background check until this past year. Feds found marijuana users with CPL’s slipping through the cracks. They reached out to the state with a list of illegal purchases and the state was directed to no longer accept CPL as an adequate background check.
      Since then all 3 of purchases this year have been delayed. Never once used marijuana.

      @@wrxified I'm in Arkansas. We are just now getting "medical" pot. Which I think is for the most part a farce. Just like in the prohibition there was medical alcohol available with a prescription. Just stepping stones to becoming a recreational drug. But for the moment, at least here, if you have a pot prescription, you lose your concealed carry license. Any time Uncle Sam says "we're going to give you something" there's always a hook in it somewhere.

    Florida is a point-of-contact state so we can't use NICS directly. The Florida Department of Law Enforcement runs our checks. Problem is that they *do* hold up some records checks. I have several that have been on hold since March. Longest one I have seen is 7-months. Florida eliminated the 3-day release in 2018. So we can't release a firearm until FDLE completes and approves the background check (aka "green lighting"). ATF says the 30-day expiration of the 4473 starts when FDLE renders an approval decision, not the day the person signed the 4473.

    Bought 2 pistols, 1 rifle in the last months, online gun stores charged my credit card without shipping them until 4 weeks later and with 2 follow up calls, all 3 were with cut off capacities to not over 10 bullets for my pistols and an ar 15 in New Jersey, no suppressors, no bayonet lugs allowed, bought 2 more, one revolver, 1 shotgun in the last weeks, still awaits for them to ship, no bullup shotguns are complaints in NJ if they are semi with mags, all 3 bought took 3 days to clear Nicks, 2 trips to the same store for each gun, these experiences are among the worst purchasing experiences, waited longer than buying a house!

      My record in WI is 4:44 for a stripped AR lower. I start the timer when I walk in the door and stop it when I walk out. Of course, I knew exactly what I went in there for. I filled out the paper work, paid, and walked out. Clean living pays off.

    Last two guns I purchased (in April this year), the background checks took less than a minute.
    I purchased one on Friday, and the second on the next day (Saturday).

      No NICS required here in Kansas if you have a CCP. Still have to fill out the 4473, but no NICS.

      @David Kuykendall Kansas also has Constitutional Carry, but I still got my CCP because 1) it's good in 39 states, and 2) no NICS, which can sometimes take 15 to 20 minutes. Another advantage here in Kansas is that your CCP is your driver's license number and if you're stopped they know you're probably carrying and they also know you're a law abiding citizen. The LEO's I've talked to like people who have their CCP because they feel they can trust them. I was stopped once and I had 4 pistols and 2 long guns in my pickup. I was never asked about firearms and was told to have a good day.

    My "gun guy" explained to me that the more common name you have, the greater chance you have of being denied or held up. Being my name is so very rare and my name is already in the fed's data base, I never have an issue.. Just something to think about.. Keep the good vids coming. Look forward to them.

      My name is very, very common..My name is Juan Gonzalez..and it is crazy how much that name comes up just here in Ohio let alone the whole country. I just tried to buy a 45 pistol..paid for it..waited like an hr. Got denied!
      I don't have domestic violence on my record, nor any felonies..just some weed and bowl charges but that has been over 5 yrs ago, really about 6-7 yrs ago.
      I went to get my prints done at BCIS...then went court house to get a back ground check from sheriff or whatever. I still got denied!! I don't understand. The mother of my children died about 7 yrs ago and I went to court for my kids who ended up going with their grandmother because I didn't have the means and resorces to take them even though I didn't want it that way. I remember the judge wanted me to get a drug screening and mental health evauation if I wanted my kids, but It was a moot point as I wasn't in a position to take them. Did that mess me up???
      I got the paper from the sheriff says something on my record..but didn't tell me....I just don't know what the heck I'm held up for. I'm 42 and this was my very first attempt to buy a gun. What the heck is going on. The gun dealer gave me the stuff/papers to appeal. But I just don't know why it got denied?? Can anyone out here in comments figure what it could be??..or is it just a defunct system and I'm just being jammed up like some of the comments I'm reading here?

    In Georgia where I live, if you go through the process of getting a concealed carry permit...during which you get a pretty extensive background check...then you don't have to undergo a NICS check at point of purchase. You just select a firearm, fill out your portion of the 4473, pay, and leave with your purchase. If you don't have a carry permit, you undergo the NICS background check...which usually just takes a matter of minutes. Now here in Georgia the carry permit procedure's price varies some around the State, but my cost is around 85 bucks. Around twelve years ago prior to me getting a permit, dealers charged 5 bucks for the instant check......don't know what it is now. It does upset me to have to pay for a permit to exercise my Constitutional right. I haven't heard people getting charged to exercise their freedom of speech, religion etc.

    I have my permit in ny and sometimes I'm in and out and other times I get delayed. Either way when buying a pistol once you pass your NICS, you have to take your receipt down to the county pistol permit office and add the gun to your license, once you do that you have to go back to the store and pick up the firearm. Its a ridiculous process

    I'm in Oregon, have a CCL, bought a couple guns at 2 different times, cleared in minutes. Next gun I bought went to delay for 2 weeks, then clear. Next 2 guns I bought the background check cleared in minutes. Next purchase went to delay for 30 days, then cleared. Bought another gun no problem, 30 days later bought another and am now intto week 2 of delay.

    Interesting you mentioned dealers calling customers to whome they did a transfer for which were later denied by NICS. It is my understanding the ATF sends agents physically to the denied person's residence to retrieve the firearm.

    You need to talk about permanent residence. We are automatically put on hold or delay. I have lived in the US for 25 years as a permanent resident from Canada. Every time I go to buy a gun I'm on delay. I've checked the forms and read up and it's because I'm a permanent resident. I don't have a problem with that but you need to make a video about it.

    A friend of mine was a gunsmith so he had an FFL. ATF told him he could deny the sale of any firearm for any reason OR no reason. If he "Felt funny" about someone that was cause enough not to proceed with the sale.

    if u are delayed alot or denied and dont know why you can file an appeal with the atf and they will give u a form that u take with u to your next purchase where the dealer can submit it with ur background check that will clarify your info. sometimes its because you have misdemeanor arrests or your info is close to a person who is prohibited that form is supposed to help with that. either way you have an opportunity to appeal it if they deny or delay you to much. just some stuff he didnt touch on.

    I live in Washington and every time I have bought a gun after some bullshit law passed, I have to wait for my local PD to approve the purchase. It is like having to get a concealed permit every time. NICS is done on a computer at my gun dealer and it is fast! 15-20 minutes max. The other part of the deal takes a good week or so.

    In Indiana it takes 15-45 mins on average. Plan for it. The only one that took an hour was the Hatsan for some reason.

    He is correct. Most of the Fed databases look at name and DOB first. If nothing pops up then you are good to go.

    It's funny for me to be delayed. I did the online application in my county for ccw. Did it on Saturday (memorial day weekend) was approved for ccw the following Tuesday when they opened back up from holiday. The ccw was in my mailbox that Thursday. Got the ccw faster than the gun because of the delay lol

    The Franklin gun shop in Franklin, TN. has over 6000 guns right now lol. A little pricey, but they have just about anything you'd want. A friend of mine paid $1700 after tax for a Volquartsen black mamba. He said that was actually the cheapest he found it.

    Good video. I always get delayed. Four times this year I have been delayed. It's always the next morning and I can go pick up my gun. It's happened at Academy, a pawn shop and twice at a local gun store. Academy was done on a tablet and the others were filled out by hand forms. I don't have any tickets ever and my only criminal record is negotiating a Worthlessness Check in 1998. I don't have a very common name and last name combo. I think it could possibly be that my brother is a felon x2. One of his felonies was actually manslaughter. It was a stabbing and not firearm related. He is just a year and a half older than me and we look decently similar to each other. There are people all in my family that have various felonies also. Nothing firearm related again but I have always thought maybe that's why I'm delayed 24 hours every time. Maybe they are just taking a better look at information

    In Delaware there isn't a mandatory wait, but they allow NICS 25 days of research. The FFL cannot transfer until after 25 days .

    So, what does a person do, if the initial decision is to deny, due to incorrect information on file within the NICS system, but are able to successfully dispute the information, but the FFL sold the firearm while you are disputing the information on file? Specifically, the store I attempted to purchase a firearm at, was in a metropolis suburb. Because of the scarcity of firearms, it’s hard for them to get the make/model I want. Can I take the paperwork from the FBI, that documents my ability to purchase a gun, to another location of that store chain within that metropolis, and complete the transaction there?     Delayed 30 days and I was told I have to go through the entire process again. I do live in Indiana. A bad system and one that is against my right to own a gun. I have a clean record!

    I am a CPL holder, and I was just delayed for a shotgun...dealer gave me a 10 day period to get it if I don’t get a answer, but I’m in Michigan and it’s still a 3 business day waiting period. Why would he say 10 days? Makes me think it’s some sort of discrimination

    here in pennsylvania it took an hour for my check to go through. due to many people using the system so it was bogged down.

    Have purchased many guns, never a delay or problem....until the last one...found a Marlin 60 .22lr in a pawn shop...filled out the paperwork...since the SS# is optional, I decided I would leave it off...called in...put on delayed status and was told by the pawn shop employee I would need to come back in 3 days. Then the next morning, pawn shop called and said come in and pick up your rifle, you are cleared! I fully believe if I had filled in my SS#, I would have been immediately approved. So don't believe that crap about SS# being optional! If you want the gun that day, fill it out!

    I was arrested for a misdemeanor possession charge of weed, “ possession less than a ounce “ , this is the only thing I’ve ever been in trouble for and after I got my ICHR I notice the charge was changed to “ purchase, possession, or intent to distribution of weed less than a ounce ( even tho it wasn’t in a bag n no scale in the car ), do I stand any chance at filing a appeal ? I spent less than a day behind bars and it was written off as a “ disorderly conduct “ ticket and weed is also decriminalized in the county
