I didn’t do the fingerprint part as it seemed to be optional but my expedite the process. Just did this minutes ago and I got an email with a case number.. I hope this get resolved soon. Just annoyed!!
I was denied.. because I wanted to buy a new gun...I'm have nothing on my record that would stop me but I still was denied. Luckily I live in Alaska so I will just buy used guns from private sales. Never going to try to buy a gun from a store again. Waste of time and just a Hassel. Need to appeal for my rights. I'm good.
I, too have to use other means to obtain a firearm. It's becoming painfully clear that criminals are in power. Just think: A thug on the streets can get a weapon in seconds illegally. Meanwhile, a law abiding citizen has to pay nearly a hundred dollars just in taxes and fees, and then may still be denied. So we're left unarmed, while the maniacs have assault riffles.
I’m in Alaska also and on delay for two weeks now. Which is not feds it’s state that’s doing that. Funny part is I just did background check for work and literally says no criminal record. So they just make shit up to delay or deny? They don’t like my face? Lol

I have been buying WWII rifles for my collection. I bought one rifle about 6 weeks ago and was delayed fro about 2 days. Than I bought one 6 weeks ago with no delay. Third buy - no delay. Forth one got delayed for a week and a fifth one got delayed as well. Today I found out that I actually got denied! I filled out an appeal online and will go do my fingerprints next week which will be electronically submitted. FBI website claims it will take 48 hours to process. My guess why it happened - my passport lists a middle name, but my driver's license does not. I made a mistake of not listing middle name. This is a federal data base and I should have used my passport data. I do not understand why they allowed me to purchase 5 rifles with no issue. I believe Federal government is deliberately trying to slow down firearm purchases across USA these days.

this just happened to me, and has happened to my aunt, when I asked why they said it was because of like named people, I think it is just a way for them to keep updating your info and prints, I have a CPL, and was still denied all the information should be on a file somewhere, I got my first handgun was purchased with out me having a CPL, and when I got it there was no wait, paid for and walked out. I am in the middle of the process now, just sent out my prints. but I think that the FBI customer service should be a lot better than what it is. when I tried to get information on what all I needed to send in I was talked to very rudely and was hung up on. they will be getting no stars from me and a bad yelp review.
It's sooooooooooo embarrassing. My first and last name are super common and probably 1 out of 10 background checks have been rejected. I live in a state that has universal background checks so every time I buy a gun even off armslist I have to go to an FFL and file a 4473. I haven even have NICS checks come back as inconclusive. sometimes if I find a great deal on armslist I will drive for an hour or 2 and the anxiety is REAL when your out of town buying a gun from a stranger and your background check might not come back right, especially when its a trade and their background check has already come back and is paid for! What does the state expect me to tell that guy that just paid 25 bucks and now can't go through with our trade because the government fucked up? Of course I look like a jerk who is trying to buy a gun with a violent record and wasting everyones time. Then 2 weeks later I'm buying a gun at sportsmans warehouse and it comes back clean as a whistle.

Get a CCW. No NICS check. CCW is a deep background check. I used to get delayed all the time, I tried to get that special pin number on the 4473, I was denied the pin because FBI said "I was never delayed or denied". Still have the letter. This was while I was delayed.
I feel your pain. I was in the same shoes except, I didn't order my firearm online. But, I am trying to get license to carry and all I have to do is get my fingerprints on Wednesday.
Thanks for the video bro,I haven't been denied technically but apparently in MS the FFL can decide to go hold your firearm and if no "proceed" status comes back in 29 days then I have been told I need to go thorough the entire process again and wait 29 more days and is a never ending loop of being required to reapply and wait 29 days unless the "proceed" status comes back one day. I did the same only I went to the Sportsmans Warehouse here in Southaven MS and order a Ruger precision in 338 lapua. So they have my 2 grand and I have to sit on my hands and wait. NICS website says after 3 business days the FFL can legally release the firearm to you if the FFL has not gotten a "proceed" status on your application. Today is the 27th day for me. Very frustrating.

I've had my UPIN for months already also 👀👍My resident MD HGP, HQL, & collector status paperwork, ALSO my non resident FL, UT ( just received my RENEWED permit LAST WEEK 9/13/2023 ) AND my non-res PA permit !!!!! Bought 6 handguns and my 1 AR within the last 2 years !!!! just bought a new 12g Shotty 3 months ago @Bass Pro 5 months USING my UPIN 🤣 Just got done filling out the WHY was I denied APPEAL website were filled out with the NTN #..... I had to call 4 different agencies ranging from district courts to federal CJIS. It also was apparent that the state does not follow through on their word. Had to call multiple times to ensure they had corrected their mistakes. Simple enough process but the government employees make it difficult to navigate. All in all, it was easy but you have to be persistent and ask the right questions because they definitely don’t volunteer any helpful information.

Me too. Then found undetermined but the shop owner decided to give it to me, but I declined to take it. I went the same day to do 2 livescans. 1 for firearms DOJ and FBI, and one for me to see what is going to come up. Now I wait and dont know what to do.

I agree that we should remain calm and professional when trying to resolve these denials. However, it's starting to seem like a backdoor way to limit gun sales. Also, a lot of folks in government do want to take our right. Shrieking about it online isnt going to help anyone but they are most certainly trying to trim our rights down to where we can only own single shot options.
We need a government agency that fights for us and not against us .And they shouldn't have the authority to take my rights away without representation to restore those rights , or redress of grievances.
Just happened to me. They cleared me on a .22 and put me on a hold for a .40. This is only a 7 day window between the two purchases. I haven't even gotten a parking ticket in that time.
Just happened to me today. I have an nfa item and paperwork in on another but was denied a firearm purchase today. They have all my info but all of a sudden I'm a bad guy. I'm 64 years old and never got as much as a parking ticket so you can emagine how surprised I was when I got denied. I even have a carry permit but haven't changed my address since I moved so the store called it in. Hang on guys, we are in for a long hard ride I'm afraid.

I get DELAYED 100% of the time, EVERY time that I purchase a firearm. I have a squeaky clean record, I have even undergone a Federal Aviation background check - and was cleared, I have been a concealed carry licensee for probably 11+ years, and I am even licensed to sell ammunition! Yet literally every single time I purchase a firearm, I get delayed for "further research"... What more could I possibly give them beyond what I have already given them??? I honestly feel as though they intentionally target some people for investigation. Perhaps they monitor our social media accounts? Internet records? Perhaps they use social markers to monitor who we associate with? There has to be something more to this, which is obviously illegal for them to be doing, but of which they are not disclosing to us.
I was just denied my atf form 1 for a suppresor. I have no felonies, was never dishonorably discharged from military ( never served ), and have no domestic abuse charges, and i am a US citizen that has a concealed firearms permit. So I am legaly allowed to conceal a firearm. I just can't make it quieter... guess I am contacting lawyers.
I got denied today at my local firearms shop. What I don't understand is that I have a concealed pistol license (CPL) and they still denied me??? Yes, I am upset that it costing me more money. I ran 2 background checks today and paid over $30.00 to do so and also lost $260.00 for 20% restocking fee on the firearm I purchased. My background is SUPER clean. What a bad day for me.... Mondo 357 there are two processes that you can do. You can file an appeal or apply for a upin/appeal. Do the appeal first. Getting a upin takes much longer than a straight up appeal. Go to the fbi NICS website and there are instructions there. Just be patient, mine took a month and a half, while some took longer.

Destroyer of Agendas i just had to do a nics appeal and on there website it says there doing appeals from January 2017. Wonder how long it will take to get voluntary appeal file. @@HondaMastr Are you sure you have no issues? The thing is, a clear record should never get any delays. If you never had any run-ins with the law, then you should have no problem. Sure, maybe mistaken identity but that should clear fast. I thought I was clear and I don't factor in a dismissed battery charge from 28-years ago. I went through the FBI data base myself first and it came back with a hit for a domestic that occurred almost 30 years ago. It was somethings I did not do because sometimes women abuse the system and make accusations that never happened. The case was so bad that they tossed it. It was whittled down to a dismissal but after speaking with an attorney, he told me that even if it was dismissed, the incident can't be sealed, so there will always be access to that info unless you can get it pardoned from the state governor where the incident occurred. So, I am now asking the state of California for a pardon on something I did not do, so I can get my rights back. This is something that didn't show up before but I believe that it's being used more aggressively now in order to weigh decisions. I also have to accept the fact that I might not get a pardon or it could take 2 or 3 attempts. I just don't understand that if a person was never convicted, how could they be treated as if they were convicted? This has been hard for me because this is effecting my job opportunities. I have had to place several things on hold. I had a job offer I just turned down and I was getting g my certification to teach gun safety and I can't get that either because I can't buy equipment. I am so down that I won't even go to the range. I have just fallen into a disassociation until this is resolved. Apart from that, I can't have anything associated with guns in my home even though I have a carry permit. The ATF can show up anytime after a denial to ensure that one doesn't have guns in their home. The inability to purchase is just one tier. Once denied, the person who attempted to purchase cannot posses a weapon. So, it's possible that the ATF will make a spot check to ensure that you are free of guns in your home, which of course, I am. I will not have gun in my house until I am allowed to buy one. I just don't know when that will be, if it I am ever allowed. This has been a nightmare. This entire thing has changed my way of thinking politically. I now have to consider who is fighting for me and who is looking out for my rights. I wish you luck, my friend.
I’m on delay in la Cali, I purchased an Baer custom ii and I’m on a 30 day wait. I received a letter from doj saying someone with my name and last name stole a gun and they want me to do a live scan so they can see if it matches my prints and I did that today, it’s been almost 20 days of waiting for my gun :( sucks but I’ll just keep that head up and wish everything is good to go
I had the same experience with the other gun that I tried to purchase 1.5 months ago. It was delayed for 30 days and came up undetermined. The gun shop did not give me the gun and instead told me and gave me a form to apply for an appeal. I read the form it says it will take a month to 4 months before I could get an answer. I did not pursue the appeal and instead bought another firearm from another dealer about 6 days ago. Today I got a call from the dealer telling me that the DOJ is delaying my purchase once again. They told me they have 30 days to see what will happen. I mentioned to them what happen last time and told them that I got the 'UNDETERMINED " answer from the DOJ and they told me that if that is the case again they can give the gun to me. I'm trying to get a CCW here in Kern County and I'm worried if these delays will be a problem applying for CCW. This is the very first time I'm buying a gun, to be honest, and my experience never been that pleasant. I have a clean record and never been arrested or committed anything unlawful to get this kind of treatment.
BTW I also did the live scan the day I received a letter from the DOJ telling me someone with my background involved in a stolen gun. It's pure BS in my opinion.
Feels awful for sure. It is a simple easy process but there is no clear direction from any of the agencies who have a hand in it. To simplify. Request the reason through NICS website. Get your IDHS from fbi using fingerprints. File appeal to figure out which record is causing the denial and what agency “owns” that record. Call that agency and request the docket/disposition. Make sure the disposition from the case matches the record in your IDHS. If not, have the record corrected by the state first. Next have the states CJIS firearms division verify the change is made and update the fed record. If the disposition is correct, look at expungement in that particular state. This can all be done without a lawyer and cost is only fingerprints and potentially the record request fee from whatever court(most don’t charge).
I’m going through this now! Did the challenged and received an email stating that i am prohibited from owning firearms because I have a warrant in another city/county and if it’s not me than I can dispute that with the PD over there. Talked to a detective over there and he said I am more than welcome to go in to get verified but if I’m not the wanted person than they’ll just let me go. Detective said there’s nothing they can do for me, not even an email to the FBI to clear my name cuz my problem is with the FBI and not them. This country ain’t so free anymore! Since when do we or I in this case is guilty before!!innocence.

This just happened to me and it pisses me off. I have a CC and a few firearms but they denied me recently and I have no fucking clue as to why. What changed between now and when I purchased my last firearm... absolutely nothing.
I got denied on 3 NFA items. One in March, one in April, and one in early May. Then got approved on a different NFA item in late May. What a pain in the ass. I tried to do a challenge. Got a quick email back saying they don’t do challenges to NFA denials. So here I am with 15 approved tax stamps, three denials, then approval of stamp 16. No rhyme or reason. So I bought a background check from FBI NICS, and the gathered all applicable paperwork. On the NICS background check, I had an arrest 19 years ago for an unpaid speeding ticket. Suddenly now it’s popping up and causing my background check to be ruled as “inconclusive”. So I sent off a VAF request for each denial. Hoping my other four pending form 4’s don’t get denied. This whole process has me furious.....

I got denied and immediately the ATF called me and told me that if I owned other guns that I needed to transfer them to a relative and I told him I have the right to defend myself before being accused, anyway he got a hold of my records then called me later on the same day and said that there's any reason why I can't own or purchase firearms and said he was going to send his report to fbi nics, but advised me to do a volunteer appeal, and I also did a challenge, and I also requested a summary background from the FBI, got background within a week and there's nothing in my record from me not owning a firearm, I was good enough to serve my country for 20 years in military, fired M16, M60, 50 cal, m203 grenade launchers, at4, but yet I can't own a simple glock9, this pisses me off, nowadays you need a gun for your protection and family's safety, to many crazy people out their, nothing is safe any more

Nevada is even worse. Discount Firearms has my money and my gun right now because of a hold. Why is it worse? In this state after 3 days it's up to the seller to give you the gun or keep it until the background check is resolved. They keep the gun to collect interest on the sale. So in this state, find a gun store you love and trust and stick with them. If it's that big of need to shop around, don't sign any form that states they won't refund your money during a hold. And please don't think this could never happen to you. I was cleared on a pistol last week, and put hold for another the very next week. You've been warned.
I filed a appeal with my fingerprints. CCW and etc.. tried and tried and tried to call them numbers with no success. Has been 3 months now still nothing from them I wonder how long it's going to take?
@@jasoncentore1830 Some states allow the FFL to decide rather they want to release the gun or not if there is an unresolved check over 90 days. This is why many shops make you sign a waver saying no refunds due to NICS holds. That's how they got me...

I purchased a pistol online had it shipped to a home based ffl cleared my criminal check it got delayed the dealer told me to come back in 7days, then they tell me they are out of town for a whole week so 7 days later I call they tell me they are waiting for a call form the ATF. can someone shed some light on my situation. I'm from Texas feel like the dealer is giving me the runaround for some reason.

Same here...denied last week for "Dishonorable Discharge". I'm a Submarine Vet from the 70's with a General Under Honorable Discharge. My DD-214 lists General Under Honerable which I uploaded to them figuring a slam dunk...NOPE! Now the want fingerprints in order to continue. I've been buying guns for over 50 years...passing NICS for over 25 years at least 20 times with a carry permit for the last ten years which is rechecked at least every year. Their number no longer works and the only communication is by e-mail with canned responses. They won't tell you anything and answers to questions are basic and simple...often the same as their websight general information. I'm having my prints taken by local PD on Monday and will overnight them to the FBI/CJIS along with another copy of my DD-214..it's the only proof Vets have. This was out of the blue and I'm totally freaked out...Orwellian/1984 stuff. Now I wait...I'm a poor retired guy with no monetary ability to legally challenge this error/mistake.
I was denied, after appealing, and also running a background check I found out a former friend/roommate had been using my name and social when dealing with the police. This dates back about 15 years on the other side of the country, it flagged his warrants, my name, and social as a known alias of his. I've appealed multiple times, they keep telling me I need the sheriffs department to correct some issue. Police department tells me its an FBI/ATF clerical error, and they need to solve it. I'm 32, I've had two traffic tickets and never had any interactions with law enforcement yet I'm simply screw playing the back and forth game. I've gotten absolutely no where in 2 weeks, and I'm personal furious how pathetic this system can be when I can't even contact a person at the FBI to explain this situation.
I have a non violent juvenile record and can’t even get a LTC in my home state. Everything is over 11 years old and I have a clean adult record. My hopes of ever buying more guns is slim. (I’ve bought 2 when I lived in Ca somehow). Hopefully Texas will treat me right.
Hey how did that end up working for you?? I recently got denied for a hunting rifle because of a felony i had when i was 13, like 30 years ago. Ive been able to buy firearms and get my ccl, then out of no where bam! Im denied. They used my sealed juvenile record as an excuse.
My first 3 firearms I got proceed within minutes. Then got delays for the next 2 I bought. After that got proceeds within minutes again. Now I just purchased a new pistol in WA with their new universal background checks, and there is a 10 day waiting period. I’m a veteran with PTSD and I’m hoping that doesn’t affect the decision since I have to give up my 4th amendment rights to purchase a pistol.

They shouldn’t be but, the records can be screwed up when entered by the state. I got a denial when a charge was entered as a guilty conviction. It was dismissed and converted to civil but under a state law. This is something fed nics doesn’t compute. I had to have a note added by the district court showing that it was in fact dismissed. Then the state firearms division of CJIS had to verify that record before updating the federal record. Took about a month of calling around.
Denied yesterday. Same as you I have no criminal record and have purchased guns before. For sure a case of mistaken identity from the reason they provided. I did the online appeal but just uploaded county record stating I have no felonies, my birth certificate and drivers license and my DD214 honorable discharge.I didn’t do fingerprints because I’m waiting to get my VAP packet with the card for fingerprints. Hopefully with what I provided they can sort it out. How did you do your fingerprints? Upload or mail in the standard card?
peedonkel get your fingerprints taken ASAP. You need to mail them, I paid for priority shipping with a signature confirmation so I know they got it. They seem to rely heavily on fingerprints. Don’t do the fingerprints yourself, have your local police department or court house do it because any mistakes can cause longer delays.
I already submitted the online appeal. I guess I can email them letting them know I will be sending rolled prints to go with my appeal. Thanks a bunch for making this video and helping myself and others out.
Funny thing is I used to work for the Sheriff’s department here and you would think they can access those prints. I will definitely take your advice and get rolled and mail them in. I’ll email them and find a way to make sure when they get my prints that they are tied with my appeal and not some random prints just sitting around.

My background check is being delayed in California. I have no criminal record after becoming an adult 18+,... but as a minor I think I have 2 felonies. Non violent that were expunged... should I expect being denied? 🤔.
@@roadwavetrucker326 no I was not approved or denied. It eventually was labeled undetermined and the store wouldn’t release the firearm to me. They said I should try again and do the whole process over. I plan on retrying again soon.
Got denied yesterday, funny how it feels like the whole world around you is crushing down. Worst is the uncertainty of why it happened when i know i have a clean record, not even a traffic fine.

I got delayed when i went to puck up my g19 and after 14 days the ffl told me to file a challenge as if i were denied . i mailed it to the PA State police and i should be hetting a letter back sometime this week
@@Miguelz-hk7od I wish I got delayed. I've been told that if you get delayed, after 3 days of no response, you can pick up your gun. They legally can't delay any longer without responding. I challenged my denial and had to send in fingerprints but they get 90 days to respond on denials.
They ask the question if you were convicted of a felony and a misdemeanor charges domestic abuse. What they use and don't tell you about is a misdemeanor felony equivalent. If you were convicted of littering and the fine exceeded $1,000⁰⁰ like $1,200.⁰⁰ or $1,500.⁰⁰ then you are a prohibited person from owning a firearm.
This is what happened to me except, I wasn’t convicted. They used the charged alone even though it was converted to civil and dismissed. I was able to appeal and have their records corrected after about a month of investigation.
Just saw the video. Congrats on getting a response from NICS in only two months. I just received my UPIN number and I filed a VAF in September of 2016. I got a letter from NICS in 2017 stating that they received the application and that they were currently working on 2015 applications. I'll find out if it was worth it soon.
@@diamondcuttermedia No.I didn't know that they had a customer service email that you would actually respond to you. When I filed they had a number that you could call and someone would answer the phone. A few months later they changed the format.
identity@fbi.gov. That is the email I used to contact them. I do know that it will take a long time when you go through the VAF route to get a upin versus an appeal which was what I did. For whatever reason they process appeals quicker than the VAF.
People are being delayed left and right. Do yourself a favor and don't buy from Cabela's or Bass Pro Shop or any place that doesn't release it to you after 3 days with no answer from the FBI.

Sorry that happened to you man. But if you were ever arrested, and was acquitted you still have to fill out paperwork to expunge that. I'm not saying that's your problem I'm just saying a lot of guys don't know about that.
So an update 6 weeks and got challenge back and I am able to own firearms. I took the paper down to FFL to pick up the gun. The FFL called them and past 30 days so had to fill out new form and give them the approved AMD ID #..(which is basically a UPIN for this transaction) FFL said they told him ok that is everything. He is DELAYED!!! WHAT?? I am sitting here with the paper from you that says he can get this gun. LOL it is comical at this point.
I was denied today. I've never had an issue before. Really makes you feel terrible and like you're a lesser man.

I, too have to use other means to obtain a firearm. It's becoming painfully clear that criminals are in power. Just think: A thug on the streets can get a weapon in seconds illegally. I have been buying WWII rifles for my collection. I bought one rifle about 6 weeks ago and was delayed fro about 2 days. Than I bought one 6 weeks ago with no delay. Third buy - no delay. Forth one got delayed for a week and a fifth one got delayed as well. Today I found out that I actually got denied! I filled out an appeal online and will go do my fingerprints next week which will be electronically submitted. FBI website claims it will take 48 hours to process. My guess why it happened - my passport lists a middle name, but my driver's license does not. I made a mistake of not listing middle name. This is a federal data base and I should have used my passport data. I do not understand why they allowed me to purchase 5 rifles with no issue. I believe Federal government is deliberately trying to slow down firearm purchases across USA these days.

this just happened to me, and has happened to my aunt, when I asked why they said it was because of like named people, I think it is just a way for them to keep updating your info and prints, I have a CPL, and was still denied all the information should be on a file somewhere, I got my first handgun was purchased with out me having a CPL, and when I got it there was no wait, paid for and walked out. I am in the middle of the process now, just sent out my prints. but I think that the FBI customer service should be a lot better than what it is. when I tried to get information on what all I needed to send in I was talked to very rudely and was hung up on. they will be getting no stars from me and a bad yelp review.

It's sooooooooooo embarrassing. My first and last name are super common and probably 1 out of 10 background checks have been rejected. I live in a state that has universal background checks so every time I buy a gun even off armslist I have to go to an FFL and file a 4473. I haven even have NICS checks come back as inconclusive. sometimes if I find a great deal on armslist I will drive for an hour or 2 and the anxiety is REAL when your out of town buying a gun from a stranger and your background check might not come back right, especially when its a trade and their background check has already come back and is paid for! What does the state expect me to tell that guy that just paid 25 bucks and now can't go through with our trade because the government fucked up? Of course I look like a jerk who is trying to buy a gun with a violent record and wasting everyones time. Then 2 weeks later I'm buying a gun at sportsmans warehouse and it comes back clean as a whistle.

Get a CCW. No NICS check. CCW is a deep background check. I used to get delayed all the time, I tried to get that special pin number on the 4473, I was denied the pin because FBI said "I was never delayed or denied". Still have the letter. This was while I was delayed.

Thanks for the video bro,I haven't been denied technically but apparently in MS the FFL can decide to go hold your firearm and if no "proceed" status comes back in 29 days then I have been told I need to go thorough the entire process again and wait 29 more days and is a never ending loop of being required to reapply and wait 29 days unless the "proceed" status comes back one day. I did the same only I went to the Sportsmans Warehouse here in Southaven MS and order a Ruger precision in 338 lapua. So they have my 2 grand and I have to sit on my hands and wait. NICS website says after 3 business days the FFL can legally release the firearm to you if the FFL has not gotten a "proceed" status on your application. Today is the 27th day for me. Very frustrating.

I had to call 4 different agencies ranging from district courts to federal CJIS. It also was apparent that the state does not follow through on their word. Had to call multiple times to ensure they had corrected their mistakes. Simple enough process but the government employees make it difficult to navigate. All in all, it was easy but you have to be persistent and ask the right questions because they definitely don’t volunteer any helpful information.
Tried to get upin with my Certificate of good Conduct. The VAF WAS CLOSED 3 TIMES. I am hiring an attorney. They are violating my rights.

I agree that we should remain calm and professional when trying to resolve these denials. However, it's starting to seem like a backdoor way to limit gun sales. Also, a lot of folks in government do want to take our right. Shrieking about it online isnt going to help anyone but they are most certainly trying to trim our rights down to where we can only own single shot options.
We need a government agency that fights for us and not against us .And they shouldn't have the authority to take my rights away without representation to restore those rights , or redress of grievances.

Just happened to me. They cleared me on a .22 and put me on a hold for a .40. This is only a 7 day window between the two purchases. I haven't even gotten a parking ticket in that time.
Just happened to me today. I have an nfa item and paperwork in on another but was denied a firearm purchase today. They have all my info but all of a sudden I'm a bad guy. I'm 64 years old and never got as much as a parking ticket so you can emagine how surprised I was when I got denied. I even have a carry permit but haven't changed my address since I moved so the store called it in. Hang on guys, we are in for a long hard ride I'm afraid.

I get DELAYED 100% of the time, EVERY time that I purchase a firearm.
I have a squeaky clean record, I have even undergone a Federal Aviation background check - and was cleared, I have been a concealed carry licensee for probably 11+ years, and I am even licensed to sell ammunition! Yet literally every single time I purchase a firearm, I get delayed for "further research"...
What more could I possibly give them beyond what I have already given them??? I honestly feel as though they intentionally target some people for investigation. Perhaps they monitor our social media accounts? Internet records? Perhaps they use social markers to monitor who we associate with?
There has to be something more to this, which is obviously illegal for them to be doing, but of which they are not disclosing to us.

I was just denied my atf form 1 for a suppresor. I have no felonies, was never dishonorably discharged from military ( never served ), and have no domestic abuse charges, and i am a US citizen that has a concealed firearms permit. Yes, I am upset that it costing me more money. I ran 2 background checks today and paid over $30.00 to do so and also lost $260.00 for 20% restocking fee on the firearm I purchased. Mondo 357 there are two processes that you can do. You can file an appeal or apply for a upin/appeal. Do the appeal first. Getting a upin takes much longer than a straight up appeal. Go to the fbi NICS website and there are instructions there. Just be patient, mine took a month and a half, while some took longer.

Destroyer of Agendas i just had to do a nics appeal and on there website it says there doing appeals from January 2017. Wonder how long it will take to get voluntary appeal file. @@HondaMastr Are you sure you have no issues? The thing is, a clear record should never get any delays. If you never had any run-ins with the law, then you should have no problem. Sure, maybe mistaken identity but that should clear fast. I thought I was clear and I don't factor in a dismissed battery charge from 28-years ago. I went through the FBI data base myself first and it came back with a hit for a domestic that occurred almost 30 years ago. It was somethings I did not do because sometimes women abuse the system and make accusations that never happened. The case was so bad that they tossed it. It was whittled down to a dismissal but after speaking with an attorney, he told me that even if it was dismissed, the incident can't be sealed, so there will always be access to that info unless you can get it pardoned from the state governor where the incident occurred. So, I am now asking the state of California for a pardon on something I did not do, so I can get my rights back. This is something that didn't show up before but I believe that it's being used more aggressively now in order to weigh decisions. I also have to accept the fact that I might not get a pardon or it could take 2 or 3 attempts. I just don't understand that if a person was never convicted, how could they be treated as if they were convicted? This has been hard for me because this is effecting my job opportunities. I have had to place several things on hold. I had a job offer I just turned down and I was getting g my certification to teach gun safety and I can't get that either because I can't buy equipment. I am so down that I won't even go to the range. I have just fallen into a disassociation until this is resolved. Apart from that, I can't have anything associated with guns in my home even though I have a carry permit. The ATF can show up anytime after a denial to ensure that one doesn't have guns in their home. The inability to purchase is just one tier. Once denied, the person who attempted to purchase cannot posses a weapon. So, it's possible that the ATF will make a spot check to ensure that you are free of guns in your home, which of course, I am. I will not have gun in my house until I am allowed to buy one. I just don't know when that will be, if it I am ever allowed. This has been a nightmare. This entire thing has changed my way of thinking politically. I now have to consider who is fighting for me and who is looking out for my rights. I wish you luck, my friend.

I’m on delay in la Cali, I purchased an Baer custom ii and I’m on a 30 day wait. I received a letter from doj saying someone with my name and last name stole a gun and they want me to do a live scan so they can see if it matches my prints and I did that today, it’s been almost 20 days of waiting for my gun :( sucks but I’ll just keep that head up and wish everything is good to go
I had the same experience with the other gun that I tried to purchase 1.5 months ago. It was delayed for 30 days and came up undetermined. The gun shop did not give me the gun and instead told me and gave me a form to apply for an appeal. I read the form it says it will take a month to 4 months before I could get an answer. I did not pursue the appeal and instead bought another firearm from another dealer about 6 days ago. Today I got a call from the dealer telling me that the DOJ is delaying my purchase once again. They told me they have 30 days to see what will happen. I mentioned to them what happen last time and told them that I got the 'UNDETERMINED " answer from the DOJ and they told me that if that is the case again they can give the gun to me. I'm trying to get a CCW here in Kern County and I'm worried if these delays will be a problem applying for CCW. This is the very first time I'm buying a gun, to be honest, and my experience never been that pleasant. I have a clean record and never been arrested or committed anything unlawful to get this kind of treatment.
BTW I also did the live scan the day I received a letter from the DOJ telling me someone with my background involved in a stolen gun. It's pure BS in my opinion.
Feels awful for sure. It is a simple easy process but there is no clear direction from any of the agencies who have a hand in it. To simplify.
Request the reason through NICS website.
Get your IDHS from fbi using fingerprints.
File appeal to figure out which record is causing the denial and what agency “owns” that record.
Call that agency and request the docket/disposition.
Make sure the disposition from the case matches the record in your IDHS. If not, have the record corrected by the state first. Next have the states CJIS firearms division verify the change is made and update the fed record.
If the disposition is correct, look at expungement in that particular state.
This can all be done without a lawyer and cost is only fingerprints and potentially the record request fee from whatever court(most don’t charge).

I’m going through this now! Did the challenged and received an email stating that i am prohibited from owning firearms because I have a warrant in another city/county and if it’s not me than I can dispute that with the PD over there. Talked to a detective over there and he said I am more than welcome to go in to get verified but if I’m not the wanted person than they’ll just let me go. Detective said there’s nothing they can do for me, not even an email to the FBI to clear my name cuz my problem is with the FBI and not them. This country ain’t so free anymore! Since when do we or I in this case is guilty before!!innocence.

I got denied on 3 NFA items. One in March, one in April, and one in early May. Then got approved on a different NFA item in late May. What a pain in the ass. I tried to do a challenge. Got a quick email back saying they don’t do challenges to NFA denials. So here I am with 15 approved tax stamps, three denials, then approval of stamp 16. No rhyme or reason. So I bought a background check from FBI NICS, and the gathered all applicable paperwork. On the NICS background check, I had an arrest 19 years ago for an unpaid speeding ticket. Suddenly now it’s popping up and causing my background check to be ruled as “inconclusive”. So I sent off a VAF request for each denial. Hoping my other four pending form 4’s don’t get denied. This whole process has me furious.....

I got denied and immediately the ATF called me and told me that if I owned other guns that I needed to transfer them to a relative and I told him I have the right to defend myself before being accused, anyway he got a hold of my records then called me later on the same day and said that there's any reason why I can't own or purchase firearms and said he was going to send his report to fbi nics, but advised me to do a volunteer appeal, and I also did a challenge, and I also requested a summary background from the FBI, got background within a week and there's nothing in my record from me not owning a firearm, I was good enough to serve my country for 20 years in military, fired M16, M60, 50 cal, m203 grenade launchers, at4, but yet I can't own a simple glock9, this pisses me off, nowadays you need a gun for your protection and family's safety, to many crazy people out their, nothing is safe any more

I just f****** moved out California when I found out that you were going to have to go through a background check before giving ammunition now proudly live in Nevada pass the background check for a suppressor and will have it in about 8 months

Nevada is even worse. Discount Firearms has my money and my gun right now because of a hold. Why is it worse? In this state after 3 days it's up to the seller to give you the gun or keep it until the background check is resolved. They keep the gun to collect interest on the sale. So in this state, find a gun store you love and trust and stick with them. If it's that big of need to shop around, don't sign any form that states they won't refund your money during a hold. And please don't think this could never happen to you. I was cleared on a pistol last week, and put hold for another the very next week. You've been warned.
I filed a appeal with my fingerprints. CCW and etc.. tried and tried and tried to call them numbers with no success.
Has been 3 months now still nothing from them I wonder how long it's going to take?
It can take up to a year. Be happy you have your money. The gun store won't even give me mine back until my background check is resolved.
I heard in some forum comments were someone was waiting since 2018 and still is waiting today
@@jasoncentore1830 Some states allow the FFL to decide rather they want to release the gun or not if there is an unresolved check over 90 days. This is why many shops make you sign a waver saying no refunds due to NICS holds. That's how they got me...

Hello friends, i got a denial in my first purchase and i appeal with fbi and they overturned, i go to the gun shop they told me all its fine and they call me when i can pick up the gun, they never call me i went to the gun shop and they told me i go denied again with the fbi original letter says i can receive a posses firearm from xxx. What should i do

Just HAPPENED to me today 9/24/2023 !!!! Went to a gun show here in MD, saw a folding 9mm Kel-Tec that took Glock mags brand new for a decent price WITH a $100 factory rebate, decided hmmm... OKAY !!!!!! 4473.... BOOM.....delayed, then denied !!!!!!! I've had my UPIN for months already also 👀👍My resident MD HGP, HQL, & collector status paperwork, ALSO my non resident FL, UT ( just received my RENEWED permit LAST WEEK 9/13/2023 ) AND my non-res PA permit !!!!! Bought 6 handguns and my 1 AR within the last 2 years !!!! Just bought a new 12g Shotty @Bass Pro 5 months ago USING my UPIN 🤣 Just got done filling out the WHY was I denied APPEAL website page where I filled out with the NTN #..... I purchased a pistol online had it shipped to a home based ffl cleared my criminal check it got delayed the dealer told me to come back in 7days, then they tell me they are out of town for a whole week so 7 days later I call they tell me they are waiting for a call form the ATF. can someone shed some light on my situation. I'm from Texas feel like the dealer is giving me the runaround for some reason.

I don't know what state you're in, but this will really piss you off: In Nevada if your background check is delayed for more than 3 days, it's up to the seller to decide rather or not they want to release the firearm to the buyer...Do you guys smell a rat yet?
@@pappagetti I actually got my pistol after I fused a few times he said it was a hold up with the NICS system but I got my license to carry so no more back ground checks.

Same here...denied last week for "Dishonorable Discharge". I'm a Submarine Vet from the 70's with a General Under Honorable Discharge. My DD-214 lists General Under Honerable which I uploaded to them figuring a slam dunk...NOPE! Now the want fingerprints in order to continue. I've been buying guns for over 50 years...passing NICS for over 25 years at least 20 times with a carry permit for the last ten years which is rechecked at least every year. Their number no longer works and the only communication is by e-mail with canned responses. They won't tell you anything and answers to questions are basic and simple...often the same as their websight general information. I'm having my prints taken by local PD on Monday and will overnight them to the FBI/CJIS along with another copy of my DD-214..it's the only proof Vets have. This was out of the blue and I'm totally freaked out...Orwellian/1984 stuff. Now I wait...I'm a poor retired guy with no monetary ability to legally challenge this error/mistake.
I was denied, after appealing, and also running a background check I found out a former friend/roommate had been using my name and social when dealing with the police.
This dates back about 15 years on the other side of the country, it flagged his warrants, my name, and social as a known alias of his. I've appealed multiple times, they keep telling me I need the sheriffs department to correct some issue.
Police department tells me its an FBI/ATF clerical error, and they need to solve it. I'm 32, I've had two traffic tickets and never had any interactions with law enforcement yet I'm simply screw playing the back and forth game.
I've gotten absolutely no where in 2 weeks, and I'm personal furious how pathetic this system can be when I can't even contact a person at the FBI to explain this situation.
I have a non violent juvenile record and can’t even get a LTC in my home state. Everything is over 11 years old and I have a clean adult record. My hopes of ever buying more guns is slim. (I’ve bought 2 when I lived in Ca somehow). Hopefully Texas will treat me right.
Hey how did that end up working for you?? I recently got denied for a hunting rifle because of a felony i had when i was 13, like 30 years ago. Ive been able to buy firearms and get my ccl, then out of no where bam! Im denied. They used my sealed juvenile record as an excuse.
My first 3 firearms I got proceed within minutes. Then got delays for the next 2 I bought. After that got proceeds within minutes again. Now I just purchased a new pistol in WA with their new universal background checks, and there is a 10 day waiting period. I’m a veteran with PTSD and I’m hoping that doesn’t affect the decision since I have to give up my 4th amendment rights to purchase a pistol.
@What's Up? And why is that? Does it make me more dangerous than someone without PTSD? Anyone can be dangerous at any time for any reason. And I have my PTSD under control.
Are dismissed cases a factor to deny?
They shouldn’t be but, the records can be screwed up when entered by the state. I got a denial when a charge was entered as a guilty conviction. It was dismissed and converted to civil but under a state law. This is something fed nics doesn’t compute. I had to have a note added by the district court showing that it was in fact dismissed. Then the state firearms division of CJIS had to verify that record before updating the federal record. Took about a month of calling around.

Denied yesterday. Same as you I have no criminal record and have purchased guns before. For sure a case of mistaken identity from the reason they provided. I did the online appeal but just uploaded county record stating I have no felonies, my birth certificate and drivers license and my DD214 honorable discharge.I didn’t do fingerprints because I’m waiting to get my VAP packet with the card for fingerprints. Hopefully with what I provided they can sort it out. How did you do your fingerprints? Upload or mail in the standard card?
peedonkel get your fingerprints taken ASAP. You need to mail them, I paid for priority shipping with a signature confirmation so I know they got it. They seem to rely heavily on fingerprints. Don’t do the fingerprints yourself, have your local police department or court house do it because any mistakes can cause longer delays.
I already submitted the online appeal. I guess I can email them letting them know I will be sending rolled prints to go with my appeal. Thanks a bunch for making this video and helping myself and others out.
Funny thing is I used to work for the Sheriff’s department here and you would think they can access those prints. I will definitely take your advice and get rolled and mail them in. I’ll email them and find a way to make sure when they get my prints that they are tied with my appeal and not some random prints just sitting around.
And..... is the government going to refund you for your right delayed? NO. This shit is how people people die. The average age of a illegal gun taken off the street is 13 years old. Good thing for all this red tape.

I actually said in the store today “I cant imagine any reason I would be denied”…cut to me not being a first time gun owner, and my mom being strangely happy that this happened…Wtf? good to hear a positive outcome on this…but you should be able to get this check before you walk into the damn store, or buy the gun online and have it shipped
My background check is being delayed in California. I have no criminal record after becoming an adult 18+,... but as a minor I think I have 2 felonies. Non violent that were expunged... should I expect being denied? 🤔.

@@roadwavetrucker326 no I was not approved or denied. It eventually was labeled undetermined and the store wouldn’t release the firearm to me. They said I should try again and do the whole process over. I plan on retrying again soon.
Seen it happen more than once when they get a hit with others with similar names, usually it's a delay and not a denial.

I got delayed when i went to puck up my g19 and after 14 days the ffl told me to file a challenge as if i were denied . i mailed it to the PA State police and i should be hetting a letter back sometime this week
@@Miguelz-hk7od I wish I got delayed. I've been told that if you get delayed, after 3 days of no response, you can pick up your gun. They legally can't delay any longer without responding.
I challenged my denial and had to send in fingerprints but they get 90 days to respond on denials.
They ask the question if you were convicted of a felony and a misdemeanor charges domestic abuse. What they use and don't tell you about is a misdemeanor felony equivalent. If you were convicted of littering and the fine exceeded $1,000⁰⁰ like $1,200.⁰⁰ or $1,500.⁰⁰ then you are a prohibited person from owning a firearm.
This is what happened to me except, I wasn’t convicted. They used the charged alone even though it was converted to civil and dismissed.
I was able to appeal and have their records corrected after about a month of investigation.
Just saw the video. Congrats on getting a response from NICS in only two months. I just received my UPIN number and I filed a VAF in September of 2016. I got a letter from NICS in 2017 stating that they received the application and that they were currently working on 2015 applications. I'll find out if it was worth it soon.

@@diamondcuttermedia No.I didn't know that they had a customer service email that you would actually respond to you. When I filed they had a number that you could call and someone would answer the phone. A few months later they changed the format.
identity@fbi.gov. That is the email I used to contact them. I do know that it will take a long time when you go through the VAF route to get a upin versus an appeal which was what I did. For whatever reason they process appeals quicker than the VAF.

People are being delayed left and right. Do yourself a favor and don't buy from Cabela's or Bass Pro Shop or any place that doesn't release it to you after 3 days with no answer from the FBI.

Sorry that happened to you man. But if you were ever arrested, and was acquitted you still have to fill out paperwork to expunge that. I'm not saying that's your problem I'm just saying a lot of guys don't know about that.

So an update 6 weeks and got challenge back and I am able to own firearms. I took the paper down to FFL to pick up the gun. The FFL called them and past 30 days so had to fill out new form and give them the approved AMD ID #..(which is basically a UPIN for this transaction) FFL said they told him ok that is everything. He is DELAYED!!! WHAT?? I am sitting here with the paper from you that says he can get this gun. LOL it is comical at this point.

What I do when I buy a gun is put my SSN on the 4473 form.
