      The police do make a good point.
      It is a very busy road with people going 100km/h up the hill. If they slid out and went onto the other side of the road they would be scrapping them off the road with shovels. They managed to get one good run in and it looked like they were going to send them off with a warning.
      At the end of the day the police officer has probably had to go to many parents and has had to tell them there child had died in a road accident and if he had not have told them to stop then the media would have said why did they let them continue. His hands were tied.
      Many people have had accidents on this hill, its not the safest and it looked like it was a busy time of day.

      GracefulWalrusPK On several occasions, the riders were in violation of Section 11.1, subsection (3) of the Land Transport (Road User) Rule 2004.
      The cops weren't making up their own rules.

    • @RichardVowles
      @RichardVowles Před 9 lety +7

      Matt D that is open to interpretation, the document you refer to is here: www.nzta.govt.nz/resources/rules/docs/road-user-consolidation.pdf and it simply states they must stay left on a roadway. The police were stating they were not allowed on the road at all, which is simply a lie.

    • @mattd6931
      @mattd6931 Před 9 lety +1

      Richard Vowles There's no interpretation to it. The law states states "A pedestrian or driver of a mobility device or a wheeled recreational device using the roadway must remain as near as practicable to the edge of the roadway."
      At times in this video they are almost crossing the double yellow lines in the middle of the road (and riding two abreast). At others, they are riding down the middle of the lane. That is not keeping as near as practicable to the edge.
      Also, if that road is classified as a motorway or expressway, then what the officer said was correct, as all pedestrian, animal and cycle traffic is prohibited on them anyway.

  • @hamishdow2188
    @hamishdow2188 Před 10 lety +31

    The cops can't stop you riding on the road because under the NZ transportation act skateboards and that includes longboards are classed as wheeled recreational vehicles which means they can be used on the roads just like a bicycle which is also classed as a wheeled recreational vehicle

    • @cswvna
      @cswvna Před 10 lety +14

      Motor vehicles and bicycles have braking systems, actual braking systems as required by law for all road vehicles. I don't believe 'sliding' qualifies as a braking system, which means skateboarding and longboarding on the road are probably illegal on that point alone no matter how fast they can stop, nor how the boarder argues.

    • @bocskaicsaba4925
      @bocskaicsaba4925 Před 10 lety +10

      cswvna This is an interesting approach. I mean if you can stop faster than a car you should be legal. Problem is that it's not the board that mainly defines braking distance but the owner... Maybe a sort of certification could solve the legal part: you can stop fast and safe = you have a permit to use the road. You can't? Stay on the sidewalk. But this leads to another problem: sidewalk size and quality.

    • @cswvna
      @cswvna Před 10 lety +8

      ***** I think you miss the point of a fully controllable braking system. Motor vehicles and bicycles can apply, release, and feather their brakes to control their speed, and unless the driver or rider messes up they do not compromise their line to do it.
      When a longboarder goes into a braking slide they must first swing to one side or the other, commit themselves to the slide, and once they do they have NO CHOICE but to ride it to a standstill. They have no control over the rate of braking, and little control over their line while doing so. And every time they do they need to keep their bodies low to the ground which compromises their visual presence, making it much harder for motorists to see and avoid them.
      Also, in the moments after a longboarder stops they are a sitting duck for the traffic around them, forcing others to evade, which invalidates the 'safe' part of your 'stop fast and safe' argument. These reasons are why no-one in charge of making or enforcing the road laws will ever make longboarding legal on the roads, no matter what arguments and self-justification longboarders give.

      It depends on the State. _Federal_ law does not apply in such cases. In most European cases, you _DO NOT_ have to identify yourself specifically when making an arrest. The generic term "Police" is sufficient. In the rest of the world, they can do what they fucking like; so watch out.

  • @MrManlyBeardyMan

    • @Goabnb94
      @Goabnb94 Před 8 lety +2

      And I think the job of police is not to be lawyers who get into the legislation, but use their power to keep the roads safe and the users of it safe, by enforcing the powers given to them by legislation, even if its a murky grey area. Don't argue with the police, argue it with a judge and lawyer.

    That officer was just being discriminatory towards these boarders. It is just as legal to skate as it is to cycle on the street as long as you aren't causing problems for others using the roads as well, and yielding the right of way. From the video, there were no cars behind you waiting on you, nor were you taking up both lanes making it dangerous for cars on the other side...Legally, you guys were all good to ride.

I live in a town that is filled with drugs, vandalism, peoples houses occasionally getting burnt down, brake in's, and yet i get yelled at for holding a longboard. And yes i have been yelled at for literally only holding a longboard. And for sliding my fingers across a fence at the baseball field in the park near my house. Police could be putting their efforts towards much more serious causes yet still waste time to yell at innocent people...

  • @fishingsouthernontario6384

    Legally you are allowed to record police when they confront you, so I love it when he tried to grab your camera and I also liked how he didn't provide his name which he is required to do by law if you were to ask which you did.

  • @marcusnz232
    @marcusnz232 Před 10 lety +1

    Legally the Police officer is incorrect. The NZTA website says
    "Skateboards and scooters are legally defined as wheeled recreational devices. Bicycles with wheels less than 355mm are also included.
    While usually powered by foot or gravity they can be fitted with motors up to 300 watts. If you do fit a motor, your 'device' then becomes a motor vehicle, which means you must register and license it. It also means that you'll need a driver licence to use it.
    Using your wheeled recreational device
    While you may need a driver licence to operate a motorised wheeled recreational device, they are not required to have a warrant of fitness or registration. But there are requirements for where and how you can use them:
    On the road, you must keep as close as possible to the edge of the roadway.
    On the footpath:
    you must ride carefully and be considerate of others on the footpath
    you must not ride at speeds that put other footpath users at risk
    you must give way to pedestrians and drivers of mobility vehicles."

In other places you only have to make you name and no other information known to the police. Additionally, you can ask the police if you are being detained. If you are, you're required to stay. • @neriwshbgisnvghbsnib
    @neriwshbgisnvghbsnib Před 10 lety

    I was once stopped by a cop that had received a complaint about me skating. He apologized and asked politely to move somewhere else to keep the resident happy. So I did, if only all cops were this nice then we wouldn't have so much hate for them. Since it's New Zealand law that skateboards are legal on the road then they had no right to threaten arrest but they have the right to ask you to move and similarly you have the right to stay but it's always better to move if asked imo.

    "it´s against the law bc i say it", he couldn´t even explain him why exactly or show him the paragraph
    and these guys are called cops
    i´m sure he´s right and he also knows what he´s doing
    but he should be able to explain the 19year old exactly why he breaks the law here and not getting annoyed or angry
    otherwise he should prob take another course

      AdurxIsd Well, ignorance of the law is no excuse if you break it. So you SHOULD know the law in your country / state.
      Though your comments prove you're probably too young to be let out of a stroller yet, so you might have a decade or so before you're old enough for the law to affect you.
      However, my point was that they were breaking the law. The cop doesn't have to tell a person exactly which section they're breaking to make it the law.

    There are some key points hereFirstly this video was shot in New Zealand and New Zealand laws apply.Section 114 of The Land Transport Act (New Zealand statute) states "(3) An enforcement officer may require the driver of a vehicle that is stopped under this Act to-(a) remain stopped for as long as is reasonably necessary for an enforcement officer to obtain the particulars referred to in paragraph (b), or to complete the exercise of any other power conferred on an enforcement officer by this Act; and(b) on demand by an enforcement officer,-(i) give his or her full name, full address, date of birth, occupation, and telephone number, or such of those particulars as the enforcement officer may specify;A vehicle includes under section2 of the act:"vehicle-(a) means a contrivance equipped with wheels, tracks, or revolving runners on which it moves or is moved; and(b) includes a hovercraft, a skateboard, in-line skates, and roller skates;"(So yes the skater is the user of a vehicle on a road and must comply.)The actions of the rider of the board could be deemed as "dangerous: as defined in the Land Transport Act Section 7, Drivers not to be reckless or dangerous"(1) A person may not drive a motor vehicle, or cause a motor vehicle to be driven, recklessly.(2) A person may not drive a motor vehicle, or cause a motor vehicle to be driven, at a speed or in a manner which, having regard to all the circumstances, is or might be dangerous to the public or to a person."A person includes the skateboard rider.Additionally any constable under Section 113 (2)(d) the officer may direct the removal of the skateboard from the road in the interests of road safety.Finally unlike other countries there is no statute demanding a Constable to state his name when enforcing traffic legislation.He is a Constable in uniform and his identification badge is visible.Contrary to the guess work of many on this blog, the officer has acted lawfully.

      in NZ police are not required to give their name, just their badge number. That aside we still skate that hill and have a letter from NZ Police's head office stating we do have the right, but some cops just wanna flex. So we let them flex a little and come back another time.

    What was the end result? In the future, ask am I being legally detained or am I free to go. Just keep giving them that response for every question they ask you. Then when they ask for your details, tell them am I legally required to give it you. If they say yes, ask them, what am I being charged with. When they ask you a question respond with, I don't answer questions.

    (1) “Obstruct pedestrian or vehicular traffic” means to walk, stand, sit, lie, or place an object in such a manner as to block passage by another person or a driver of a vehicle, or to cause another person or a driver of a vehicle to take evasive action to avoid physical contact. Your boards would make other road users to take evasive action if they saw you, in court, you would lose. if you argued you were a road user you would be charged with "Careless Use" either way again you would lose.
