    To be clear, I'm not against the police, I think they do a fantastic job in New Zealand. When I'm talking to him, I'm only asking him about the law to get a clear understanding of exactly which law he using to enforce our removal from the road, and that he also understands the it is totally legal for us to be using the road.

    Land Transport Act 1998 Section 115 Subsection 1B details what the enforcement officer may do should they feel a vehicle is not to be driven on a road way;
    Section 2 Preliminary definitions includes Skateboards(Longboards fall under this category);
    The enforcement officer saw you use the vehicle in a manner which he felt was unsafe, which gives him the power under the aforementioned reference to the Act, to restrict you from using the vehicle on the road.
    Like your longboard videos though :)

      FYI, my uncle was a cop for 30 years, he did this shit to kids if he didnt want to do anything else. its not an enforcement they et told to do. they do it because they get paid for doing just about anything. I'd rather get paid same hourly wage for pissing off a kid than trying to put my life at risk. His words, take it or leave it. believe all the other cops though lmfao, they're doing the right thing ;)

    I just hate how people overreact on skaters... When I'm longboarding and greeting someone they stare at me like I'm a serial-killer. I also had some messed up cops coming after me which had no proof it was illegal to skate on the road. They're just damn right annoying.

    This seems like a confused police officer. I'm guessing he just wanted you off the road due to dangerous behaviour and made the mistake of making an incorrect argument for why.

    If this happened in the U.S you probably would have gotten arrested, meaning if you talked to a cop like that here. Everytime I gave a cop a hard time I got arrested, they are pretty power hungry here. Btw I was so happy at the end of the video when you gave zero fucks and started shredding again. You guys rock.

      In Virginia we're only allowed to ride in parks, in other words we can't be on the street or sidewalk. How does that make sense? There aren't even that many longboarders in the state. -_-

    3:43 - "You can't skateboard down *THIS ROAD*"
    He is using his powers under s113 Land Transport Act 1998 to prohibit you from skateboarding down that particular road under reasonable belief that it is an issue of safety. Even if legal on the roads generally, a police officer's request trumps your right here. So stop arguing with him, you are in the wrong here.

      biggest difference may be because bike got brakes? here in germany skateboards are declared as toys because of the missing brakes / traffic safety. you are not allowed to use them on public roads.

    The law you have in NZ is cool - I'm personally all for it. To give you a perspective - I travel often between Germany and Poland. I have an electric longboard (Evolve Carbon) and the story is like this:
    - in Germany you're allowed to use a riding device on the sidewalk if you go below 6km/h, you're not allowed on the road and you are not allowed on the bike lanes - but the practical thing is that if you do not pose a risk nobody will bother you - Police will stop you to ask what's the speed, the range, how much does it cost etc - if you act nice they'll be nice ;-)
    - in Poland you're allowed on a skateboard ONLY on the sidewalk (which are in crap condition usually) - riding on the bike path will cost you about 12 euros, riding on the street will cost you 60 euros minimum (up to 120 euros). Therefore in Poland you can only use the sidewalk and try not to kill anybody's kid...
    Don't complain too much about what you have :P

    - (Section 11)
    (3) A pedestrian or driver of a mobility device or a wheeled recreational device using the roadway must remain as near as practicable to the edge of the roadway.
    (4) A driver of a mobility device or wheeled recreational device on a footpath-
    (a) must operate the device in a careful and considerate manner; and
    (b) must not operate the device at a speed that constitutes a hazard to other footpath users.
    (5) A person using a wheeled recreational device on a footpath must give way to pedestrians and drivers of mobility devices.
    You guys are right... It's illegal to ride a skateboard on a footpath if you are travelling at speeds that put others at risk (ie above 10km/h in land transport speak...). There's no law preventing you from riding on the road, as long as you stick to the left.

    Yes, you can be arrested for failing to comply with a police officer, EVEN IF what you were doing was fine (assuming it is, and I don't actually know that it is).

      No, you cannot be arrested for failing to comply when you are complying with the law or doing something that is legal. Half the reason that there is a law stating you can skateboard down the road. Is to protect people from the police acting unlawfully. Cops cant just go round telling people they cant drive there car down the road or they will be arrested for failing to comply can they? Because thats called 'unlawful use of power' which is the problem with the NZ police. They are incompetent and if something dosnt go their way they will illegally bully you with their 'power' and threaten to arrest you. (and whilst all this is going on, real crimes are happening which they take so fucking long to get to that they because they would rather arrest a kit for riding his skateboard down a road...)

He cant tell you to not take a drink from the water fountain and if you do, arrest you.       Juvis Wilshon Okay, so the police can arrest you for not following a police order. An arrest takes you into custody. It is not jail time, nor is it a conviction. Sometimes the police officer is wrong, but that is why our court system exists.
      However in this case, the officer is not wrong. He cited the relevant legislation (section 113 Land Transport Act 1998 of NZ) which gives police the power to remove a vehicle, which a skateboard/long board is, from the road for safety concerns. So no, he is not "coming up with reasons," he has reasonable grounds from a point of safety to request a vehicle not to be used on a specific road(s). He told them this, citing the legislation.
      They then argued with him, stating that they have the right to be on the road. This is true, however, the police have the right to supersede this. If they couldn't police would be useless. So continuing to argue would be no complying with police, and grounds for an arrest.
      So while I'd struggle to think of a reason why I would be asked not to drink out of a water fountain, I should still listen or I could be arrested. Maybe the fountain was part of a drug investigation and I just washed the drug residue down before they could swab, I don't know. Thats not important. I could still be arrested, but I would be able to argue the point in court and maybe get compensation for the arrest. An arrest is not a sentence to jail, its being taken into custody.

It might be in your interests to listen instead of ignoring because "its my right, how dare police having a reason for telling me to do or not do something". As I said, if you feel you were mistreated, take the issue to court and settle it there. Because arguing with police undermines their authority and takes away their ability to do anything. Either listen or ignore them and face potential arrest and settle it in court. And as my account name shows, I'm only 22 dude.     Land Transport Act 1998, Part 9.
    Section 113
    (2) Without limiting any other powers conferred on an enforcement officer, an enforcement officer, in enforcing any provisions referred to in subsection (1), may at any time-
    (d) direct the driver or person in charge of a vehicle on a road to remove the vehicle from the road or a specified part of a road, if the officer believes on reasonable grounds that it causes an obstruction in the road or to a vehicle entrance to any property or its removal is desirable in the interests of road safety or for the convenience or in the interests of the public.
    This is exactly what the officer did and he explained this to you. You're very lucky as most officers wouldn't bother. Try listening next time.

    I think the Cop is right overall, morally and legally. Crunchie is right legally, but not in this situation. I'm not certain of the laws so will stand corrected otherwise but this is my take:
    Law 1 states that skateboards can be used on the road, just as cars/bikes can too,
    Law 2: (refereed to by cop): Under LT Act 1993(I'm pretty sure?), cops have full jurisdiction to remove road uses (defined by Law 1)based on the particular conditions at that time i.e. drunk drivers, illegal drivers and in this case, the long boarders.
    The cop does have grounds. They were crossing the centreline, probably above 50kph on a few of those runs, generally in a much less controlled state of motion than a bike or car.
    Morally: Lets be honest, if he didn't stop them and they went under a car, its his ass on the line now, the kid is dead, lives ruined.
    Conclusion?
    It was a tricky situation but that's what making tough calls are all about. The cop is ultimately the mature one regardless of his persona when he was dealing with them. The kid thinks he is making a winning point but fails to understand the big picture which is also the same reason the cop is getting involved.

      No, the police should not believe they have any control over you, they serve the citizens, they are no more important or higher tha you or me.
      Just because they have a badge does not mean they should be able to remove the peoples freedoms, and in this case their freedom was being allowed to skate down a road if they wished.

      I'm not thinking about myself only at all, if anything I'm thinking of the people, and the fact that they are perfectly fine to skate on that road and it is their freedom to do so, whatever the risks, as there is danger in most things but you just have to be careful.
      There is no need to remove freedoms like this.

    Just watched the older vid of you guys being pulled over by the cops and you guys are absolute Legends. I live in Queenstown and there are only a few cops here but a couple are actually good they pulled me up once and that was because i was riding with out a helmet ( my own fault but no ticket) but now when they see me they just wave. But good on you for standing up to them and keeping your cool thats really good man.

      If they had printed or even read their penal code in the first place, this video would never have happened. Unfortunately, they didn't, and made this recording that puts a calm and correct police officer under a negative light. In the video, the officer stated that he was enforcing the following:
      Land Transport Act section 113 and 114

      Which he states again at 3:50. The officer, at that point, has already directed the longboarders off the road, and any attempts at disobeying this will in fact be "against the law".
      And this ignorant skater keeps arguing with a man of the law, who has already clearly proven his point. Using a rather rude tone at that. My props go to the police officer for keeping his cool and responding calmly to the almost provocative questions of the skater who clearly didn't know an better, although I find that he should have stood his ground on the basis of the Land Transport Act better, and simply
      Because under the Summary Offenses Act 1981 section 23...
      Resisting Police, prison, or traffic officer
      Every person is liable to imprisonment for a term not exceeding 3 months or a fine not exceeding $2,000 who resists or intentionally obstructs, or incites or encourages any other person to resist or obstruct,-
      (a)any constable or any authorised officer, or any prison officer, or any traffic officer, acting in the execution of his duty; or
      (b)any other person acting in aid of any such constable, authorised officer, prison officer, or traffic officer.
      (c)any Police dog working under the control of a Police dog handler.
      It could have ended much, much worse for this guy. Don't try to fight the police unless you have thorough knowledge of the law.

    If an officer issues a prohibition, and the prohibition is not adhered to or complied with the officer then has grounds to arrest on the basis of refusal to comply with a lawful prohibition. The Land transport act is irrelevant if the prohibition is shown to have been beyond all reasonable doubt in the best interests of safety and preservation of the law.

    I've only been stopped by the police twice, both times was because I was riding on the sidewalk haha. It was by a highway though! Both times, same highway!(luckily different cops) Did they expect me to weave through the traffic? So now I always ride the streets, and if I get hit by a car I'll say the police told me to ride in the streets xD

    Well, in Italy law says that skateboards/longboards/scooters/rollerskates or rollerblades/bicycles or every other transportation vehicle, except from wheelchairs and those things where they put babies (I can't remember their name), MUST travel on the road, because they are velocipedes (vehicles powerd by humans, not engines) and could possibly be a danger for pedestrians on sidewalks, except for pedestrian areas wich usually are large enough. I suppose that this is the same law everywhere, so you guys had the right to be on road. The problem is that even if you have a lot of self confidence in your skills and are really skilled you're not safe from car drivers that see you and panic because they think you are going to integrate with their front bumper, start doing shit because of that fear and could provoke an accident or have their fear become reality. This is the real problem, I guess that the cop thought of that and hoped you didn't know the law so you would go home in hope nothing bad would happen. Btw you bomb hills really good ;)

    Bro, Land Transport Act section 113 and 114 - he says it at 1.40.
    "2)Without limiting any other powers conferred on an enforcement officer, an enforcement officer, in enforcing any provisions referred to in subsection (1), may at any time-(d)direct the driver or person in charge of a vehicle on a road to remove the vehicle from the road or a specified part of a road, if the officer believes on reasonable grounds that it causes an obstruction in the road or to a vehicle entrance to any property or its removal is desirable in the interests of road safety or for the convenience or in the interests of the public:"
    I understand you respect the police, but dude, you were just trying to argue. He did tell you the law, very clearly.

    Section 11 of the New Zealand Land Transport act says that any 4 wheeled recreational vehicle (including skateboards and longboards, they're mentioned in the act ) may travel down any New Zealand street as long as they are on the correct side of the road and do not exceed the speed limit. That is the law. If i was you guys, I would've just skated down it and gotten arrested.

      Section 113 of the same act gives police the power to, on reasonable grounds, prohibit the use of a vehicle on a particular road....so, the cop was in the right. He was asking them not the skate in the area, nothing more, nothing less.

      Yes then how about the person in the car they ride into if it happens. What if it severely injures or kills the skater. That person will most likely be traumatized by it. I personally have no issues with them doing this as long as its safely and on quiet roads (with them drifting across to the other side lots then it is not safe).

    In australia it is completely legal to skate on roads i that satisfy these conditions:
    - a road with no dividing line and no median strip; and
    - a road on which the speed-limit is equal to or less than 50 kilometres per hour; and
    - a one-way road with less than 2 marked lanes.

    I don't know about Papakura, but in Massachusetts a cops orders overrides any traffic laws. Its technically for directing traffic but this sort of thing is covered by it. This happens to me all the time, but if I come back the next day I can't get in trouble, only told to stop boarding or else again.

    Find the law or bylaw that states the legality of boarding on the road, print it off and carry it in an envelope when you go boarding as proof of legality ;)

      But regardless (even though it may help the situation) the cop is legally allowed to order someone off the road (whether it be car/skateboard/bicycle etc) for reasons (typically) of safety, and can arrest you for not complying.

    That legislation is for ordering vehicle owners/drivers to move their vehicle out of the way (e.g. prevent blocking roadway, driveway etc), not for banning specific people from using a certain piece of road.

    Could you send us a link to the law you're referring to? Over here in the UK skateboarders are only allowed to skate in parks but if you press the fact that its a longboard then we're treated as push bikes (allowed to be on the road as long as being respectful to other road users) but that kinda falls apart a little when its dark and we're then expected to have hi visibility clothing and lights -.-
