    Does signing an agreement to acknowledge 50%/50% ownership of the home help when going thru separation for common law partners?

    My gf's sister bought a property with her (now ex bf, common law relationship). They bought it together, he's been living in it for 2 years and he's been paying about 70% of the mortgage while she's been living and paying rent elsewhere and paying the remainder 30%. The down payment was 50/50 between the 2 of them but now they're wanting to sell, what's worst case scenario? Could he totally rinse her?

    what if you are are common law, have a child together but you alone are the financial caretaker paying all the bills that include mortgage, hydro, internet, property taxes, insurance, car etc ...
    can your common law still get a piece of your property? i am the only one in the house deed btw

    What form do I use to evict my common law in Ontario. I owe the house

      You evict tenants, do you have a tenancy lease? That would be very weird if you did. If no, contact a family lawyer about proceeding with any property division hearings etc. If you owned the house before the relationship, you will almost guaranteed be fine. If you own it but acquired it during the relationship, no guarantees. Probably still fine but unclear/depends. Once that's been settled, and the court confirms it's all yours, then just tell them to get out, and call the sheriff if they don't.

    Partners contribute has been dealing with one partner with a Narcissistic personality disorder compulsive addictions to ALCOHOL hidden. Mentally illness and on going threats from man like my partnere irratical behavior.

    I'm sorry, but I bought my house alone, already paid half of it's value & bear all the risk... I wouldn't want a bf to just swing in and steal part of it. He has to pay for it and under value rent doesn't count toward it.

    "Considering how unfavorable to couples they are" No, they are unfavorable to "Partners who didn't do anything to earn a house but want a free half of a house". That's not remotely the same thing as "unfavorable to couples". It's almost logically impossible for any contract to be somehow unfavorable to BOTH signatories, in any sense... If somehow that ever was the case, then they would simply both agree not to pursue it or ever press it in court. So "unfavorable to the couple" is not what you meant. You meant unfavorable to ONE person and favorable to the other.
    I mean, I agree not to just hand over random undocumented money to someone "for a mortgage" under the table, of course, that would be very dumb to do. But again, even that most extreme example given is not unfavorable to the "COUPLE", it's unfavorable to the ONE person that handed over random undocumented money under the table. There's still nothing inherently good or bad about common law to the "couple" overall, since every loss of one person is a gain of another person (minus, ironically, lawyer fees. Not saying people shouldn't get a lawyer, but it is ironic nonetheless.)

      Yes I agree. It was weird when he said 'unfavorable to couples'. In my book, anything that gives the government less power in family matters between two people, is favorable to the people.

    I was thrown out after 2 days after I was dumped with no money support and threatened with the police because I " am not on the lease." I paid rent for 3 years and bills.
