Land Law - Easements
zhlédnutí 16KPřed rokem
Easements are a strange part of land law because they are all about using a piece of property without actually owning it. The legal definition comes from the 1955 case of Re Ellenborough Park which identified four pre-requisites: *Dominant and servient tenement *Diversity of ownership *Benefit the land *Subject of a grant A dominant and servient tenement means there are two pieces of land. The ...

Contract Law - Conditions, Warranties and Innominate Terms
zhlédnutí 19KPřed 3 lety
Some terms of a contract will have more importance than others. Originally s. 11 of the Sale of Goods Act 1893 makes a distinction based on what should happen when there is a breach: breach of a condition give the right to treat the contract as repudiated breach of a warranty only gives rise to a claim for damages However this distinction was somewhat problematic because it was extremely simpli...
Contract Law - Implied Terms
zhlédnutí 20KPřed 3 lety
Contracts do not stand in isolation but rather exist within specific contexts, especially when it comes to business and commerce. Firstly terms can be implied by customs that exist within certain sectors (Hutton v Warren (1836)). It is important to note however that customs cannot override the express terms of a contract (Les Affréteurs Réunis Société Anonyme v Leopold Walford Ltd [1919]). This...
Contract Law - Express Terms
zhlédnutí 17KPřed 3 lety
The terms of the contract are the agreements that parties agree to be bound to but discovering what constitutes the terms is not always straightforward. In the case of oral contracts the courts take a look at what was agreed between the parties (Smith v Hughes (1871) while for written contracts the courts look objectively at what is in the contractual document (Chartbrook Ltd v Persimmon Homes ...

A psychiatrist isn't supposed to be less sane than a patient. Why would anyone continue trying to cause harm to a former client, who is also a DV victim? That's how you lose your license and your job.
Hi is free movement of workers question similar to free movement of persons?
A psychiatrist who fails to take action when you report abuse, exploitation, or any physical harm, physical needs not being met, is obligated to either help file criminal charges, lawsuits, help you obtain domestic violence shelter or protective care, etc.
Self defence is also covered by Common Law.
Do you please have any explanatory video on the Beneficiary Principle or non charitable purpose trust
Brilliant as always. Thanks Marcus.
Very good lecture , easy to understand 🙏👍
have my final alevel tommorow and this was such an amazing quick revision session!
My Neighbour has A House on Wheels on his drive for over 2o Years..Breaching his Covenents Can I get him off ?
I'm a bit late to the party here but as I am studying for my law Alevels in a few days, I just wanted to amend: although Jones V Padavatton [1969] did hold an ICLR, the mother later appealed and was successful in arguing that there was in fact no ICLR as "the lack of formality regarding the agreement showed there was no intention", and thus Jones V Padavatton showed that it was purely a family agreement, with no contract.
Alodial title and land patent
Have a land patent and stop contacting with Washington DC and their states agency and the England government
arsenal actually won for a change, i almost spit out my water ahahahha
Your videos are brief, clear and very useful. Thank you for your efforts!
Couldn't find the pattni case you spoke of, but the Ghosh test was pretty decisively deconstructed in Ivey v Genting Casinos [2017] and applied to theft by DPP v Patterson barely a week later. The new standard isn't obvious to a first year law student beyond "objective"
Not bad son, you news to put my case in there too... 😢
Hi is this ocr a level law and can I use it for my exam Thursday
Thank you marcuscleaver. Finally nailed down Lord Coke's date. A cursory look gave 1797, which was presumably a restatement? Your clips are a great help to the independent candidate. Paper 1 in 6 days!

Which Law? We have 3 types of Law here in the uk. The common law, customs and statute law. The common law being the law of the land. I'm not trained in law but History is my passion and it seems very clear to me intelligent men like yourself are taught a polluted version of Law, Parliaments overall sovereignty and our constitution. No one is above the Law which is part of the rule of law, that is our birthright to all be equal so legislative law has to not go against this and must not cause any of us harm. Parliament have legislative sovereignty only. Parliamentary sovereignty is a theory and I can tell you it does not stand up to scrutiny or logic. We do have written constitutional documents. The legislation must be legal and the courts are responsible for that. The Law is our Birthright.
Thank you so much Marcus, these are so helpful :)
it doesnt say the guide is free unless you subscribe with a payment -
this has been immensely helpful as exams approach - thank you very much
Thank you!
Is there a way to get access to these slides?
Thank you!!!
It's also referred to as a conditional acceptance
Thank you so much! The video was so well explained and helped me understand EU judicial review so easily when I was struggling to grasp these concepts.
Thank you!
question: when it gets to indirect effect and the state has to interpret the EU law with MS law, how come it ever goes to state liability then, doesnt it just get inrepreted?? what are the reasons that indirect wouldnt work??
Pretty good stuff, I just realized that Mario updated his favorite way to tackle ED and it's crazy! Although what he previously talked about was pretty decent, it was difficult to follow, I just go'ogled the latest by Mario Volpstein, it's so much simpler and potent now!
Thank you very much. You've actually demystify this topic for me, and I'm grateful. It's been a struggle all along. Thanks again
Good lecture
So Driving is not legal unless your government license it at a price, breaking the law is okey if you pay us so debt notes.
Is there any cases for divorce under the new law
I absolutely appreciate these lectures. I am looking for one on the law of leases. Do you by chance have one?
Hi. I am new to judicial review, but what I am wondering is what is the grounds of review? Is it illegality, irrationality and procedural impropriety? Where does proportionality fall in?
You are him. Well done sir.
do you know if he does anything for evaluation (AO3)

When police make illegal vehicle seizures with third party recovery companies, its the police they are the customer. They called the recovery company! They can pay! Sue the buggers. You don't owe anyone anything.
