    I have a pending case which I opened for damages 9k (October 2023), the defendant opened in return the false counterclaim which is not related to my claim and is claiming the same damages from his side (for damage to his imaginary side extension for which only proof he has is his statement- we are neighbours. Last year I was replacing my fence and long story short he wasn't happy with my property improvement. He was expecting payment for allowing my replacing my fence, I did not agree). On the top of that he opened the additional claim which is exactly the same as the counterclaim....the only difference is that he added my partner to this new claim as the second named third party (he called us 20 part defendants on additional claim application, were pd20 5.2 says that i always should stay as a claimant). I had a hearing on 29/04 for jurisdiction (he send me an unsealed claim form in oct 23; invalid (in my opinion) sealed claim form arrived in april 2024 with court stamp but without court stamp date or court written date of issue) judge decided that court issued the claim on oct 23 because this is equal to service date the application to the court by defendant. I lost. On that hearing I raised up the issue of duplicate claims...judge wasn't interested that topic...is it normal ?? Res judicata doesn't apply here?

    Counsel should avoid making comments on the witnesses response. Although it is common and difficult to avoid such responses, but the judges dislike it.

    Hi please help. I just found out that I have a CCJ against me due to unpaid gas bill. I have contacted the provider it came to light that this was due my former tenants not paying their bill. As set on their tenancy agreement they are liable for any outstanding bills and utility provider agreed to this and changed the names on the accounts. However they are asking me to complete N244 form to request CCJ to be put aside. Doing some research it says that via a consent order from claimant and defendant this will be a quicker process. Where do i get a consent order and do i send this with the N244 form? Thank you in advance

    His obligation is to deliver goods to the buyer, its not the claimants fault there was no reserves available, which is a proper contingency of which may or may not be in the contract. Force major is a liability clause, usually stating where there is no liability in those events, if the the defence has sold his entire capacity on a future contract without taking into consideration the liability that's the defendants issue of negligence, however its also negligent on the claimant for offering to buy and rely on the entire capacity given there is no liability, so in reality they must do better at business, the claimant isn't entitled to damages and should pay the defendants costs

    And on top of that, a person whom isn't associated with the agreement between the person A I.e the claimant and defendant, there should be no other signatures that are paying for an goods agreed to be exchanged

    The purchaser is the individual whom has paid or the account wich the transaction has left, now if there is no evidence that the money left that bank, the defendant is not the purchaser. Can't remember off the top of my head which act this is in, but it's there, the counter claim would be, extortion.

    The invoices must be signed, by the man who entered into the agreement, else the goods belong to the original owner wherever them goods are, and ownership of those good doesn't pass to the recipient until the invoice is signed, unfortunately for the claimant unless those invoices have been signed he's give his goods away in good faith

    We can’t ask: - Did you go anywhere this morning? Because that’s leading (unless agreed then we can ask) which means that she actually went somewhere ( she could be home as well). Basically, for examination in chief we should ask non-leading questions unless agreed then we can lead.

    Can you make an application to get the court fee cost back? I believe it is £275? Ridiculous that a Claimant can issue proceedings against someone (e.g. Wrong address), get a default judgment and enforcement. As a result the Defendant has to pay £275 to get the judgment set-aside - even though they knew nothing about it!

    When referring the judge to a document, it should be mentioned clearly to which annexure in the affidavit (and who's affidavit) contains the document you are referring to. i.e when introducing a document as evidence in your submission :-) Referring the judge to the document in the "documents" is incorrect with the basic Rules of Evidence.

    I’m not looking for advice but have done lots of research. My default judgement was served when at a time I was homeless and during what would have been the litigation phase of this claim was in and out of a mental health hospital. I sent my N244 application for 2 days ago with no dispute the claim. Although I owe the amount owed would bring homeless and being in and out of a mental health hospital at this time, with providing evidence would be enough to set aside the CCJ?

      @@edameo2435 I was in court yesterday for about 5 minutes. And the judge set it aside. It’s important though you draft a witness statement, draft defence and include any evidence. I included my medical records, emails regarding my abode. Best of luck. DM me if you need any advice/help

    Well done. I question the frustration angle though...I think a counter would be arguing that as an experienced potato farmer, they would have reasonably foreseen a risk such as potato blight (I guess that was what caused the destruction of the crop). Once the risk was foreseeable then it would cast doubt on the applicability of the frustration doctrine.

      @@mckenzielaw2940 Actually I have a question! Lol 😆 ! Can you explain to me why in my Llb i had almost 1 in every subjects and now i struggle to get a measly pass? In class i am always praised and in the exams 🙃 😪 well not so! What does it mean that the LPC is practical? I thought that was a continuous process from the LLB but instead no matter how many pages I write nothing seems to please them. What do they want from us? A mean when I proposed the ethical principles found in Aristotle's thesis they weren't impressed . Most likely they didn't even know who this philosopher was. How can they judge what they fail to process? I feel like this LPC is a big scam but ehy.... Any suggestions?🤣🤣🤣🤣🤣

    Too many .. Your Honours .. good presentation speed but draw your speech as if talking to a friend rather same tone voice. You have a tendency to over explian .. talk to the magistrate id judge as though you do this all the time ..
