The charge was misdemeanor DV phone harrassment. DV means domestic violence even though I had not lived with the woman in 5 years at the time. Total b.s. 15 years ago, I pled guilty to a felony I did not commit to avoid a potential 12-year sentence if I lost at trial. My roommate had brought drugs into our apartment without my knowledge, and when the cops showed up, they just *assumed* I was involved and charged me too. Since the prosecutor didn't care about the truth, I said whatever they wanted me to say to get control of my life back as quickly as possible. I would have confessed to shooting Abraham Lincoln if it would have allowed me to avoid a prison sentence. If the courts don't care about reality, why should I???

I don't know about FL but in CA you are not required to be read your Miranda rights until the are lawfully arrested.

I disagree with your analysis. He was seized but was not physically restrained. He had personal agency to scratch his nose if he wished. He provided way too much information and they will use it to try to justify their actions. The only thing to say is I do not answer questions. Especially with an adversarial LEO. 2:15

Reduction from felony to misdemeanor is not a full dismissal. Sounds like it's the best deal you could get for a criminal who didn't commit a crime.

I'm in Barnstable, Ma. and they have repeatedly violated my rights. I mean blatantly. I could write a book about my last experience alone. On another occasion I was bleeding in 5 places, had a severely sprained ankle, and am permanently disfigured. When the police arrived I was talked to like little kid that had just broke grandma's antique cookie jar, threatened with arrest twice, told not to come back outside, called a liar, and accused of faking injuries. Not even a police report was filed. My attacker was allowed to go on his way while they ran checks on me and were verbally abusive. All I was attacked because I was recording in public and they guy didn't like it.

You do not have to talk to police under the 5th amendment, which protects you from saying anything incriminating, and you should invoke that right 100%. This was a 4th amendment violation against unlawful search and seizure which would suppress any evidence obtained after the fact and dismissing the charges.

First of all; he shouldn’t be answering all of their stupid questions. Second; Im guessing there is no policy at this department about treating the public with respect.
