So the cops mess up but the client has to pay attorney fees for their mistake.
That's how it works.
You sue them and have the coos pay for your attorney fees.
You sue them and win. Thise cops need to go on the Brady List.
When some cops lie and get caught they think that Qualified Immunity will save them not all the time now.
Yup. Qualified Immunity makes these Government Goons feel invulnerable. And I've found that lessons not learned in BLOOD are often quickly forgotten. And IMNSHO it is obvious that these Bullies with Badges need to be taught lessons that they NEVER EVER FORGET!

Furtive movement, stop resisting, gimme your ID. All the statements of a lying fiend
Exactly on point... Why the courts allow this behavior to continue escapes me....
Any time an officer is using profanity, he is being overly aggressive and purposely trying to escalate the situation.
Cops get angry when you claim the 5th and claim the 6th Admendent rights.
Your not going to answer any questions without an attorney pressent.
Not necessarily
@@deshizle Oh yes, necessarily. Use of profanity equals failure of self control.
@@deshizle There is no other purpose then to provoke a response from the person/people it is being said to.
Everybody MUST SUE if we're ever going to end this abuse
And eliminate qualified immunity!
Exactly on point Randy....
No, here's the answer: When it comes to Police, this is what needs to happen, Legislation must be passed requiring police to carry malpractice insurance. A Doctor, a Nurse Practitioner, a Lawyer and so on must carry malpractice insurance. The purpose of the insurance is not to pay out to someone if you mess up, but to make you mind your P's and Q's. Just think, you get into an accident, your premiums go through the roof, not because someone made a claim against you, but because you have proven yourself a liability. If any of the professions that I mentioned mess up, their rates increase as well, mess up again and they won't be able to get insurance anywhere without mortgaging the property. If you still continue to mess up, well,, you will never be able to work in the field again because you can't get the insurance required to practice, Same should go for PIGS. Same goes for driving, mess up to many times, you loose your license, and nobody will insure you, resulting in you not being able to drive. With all these points made, wouldn't it make sense for Police to carry insurance? Rest assured, they have to start paying out of pocket for violating the rights of people, I'm sure by strike three, they would have to quit because the can't afford to pay the insurance required to possess an Officers Certificate. One may argue well they are working for someone. Well, all these professions are under some sort of contract, which mean these people are all working for someone else, why is it the people they work for just be held to account? Doctors work for hospitals, Lawyers work for Law Firms etc. But they are all still mandated to carry insurance because they still have a responsibility in the game, a responsibility to do the right thing. The police are working for someone else to, so the whole, well they are represented by the Government so they all fall under the Governments responsibility. Personally, that is a moot point by my reasoning of it all. I'm sick and tired of seeing all these lawsuits because police can't stay within their lanes so to speak, lawsuits that we the Tax Payers are paying, (3.2 BILLION, thats with a B), just last year alone. Of course that doesn't include any litigation that is still ongoing. Make police accountable, make them carry insurance and I assure you, the attitude and practice of a lot of these PIGS will change.
Hard to believe that we allow ourselves to be policed in this way by these clowns.
We don't allow it. The people who attempt to stand up against it are always harmed in retaliation and most will not take the risk of joining the dissent. Force and violence are being used to coerce us into tolerating this. "Allow" has got nothing to do with it.
imagine if EVERYONE started carrying. they'll fuck off with their nonsense real quick.

We allowed it. Your right. And we can't take our freedom back ever again cause we all won't come together and protest the police... illegal immigrants. Spending our tax money in places we will never see receipts for but we gotta show ours by April 15th. We get to travel but they gotta screen us at the airport and know when I'm coming n going but the illegals we have no clue
I agree. We all have the right to defend ourselves.
The body cam has been one of the most revolutionary inventions in the past 20 to 30 years.
Still very hard and expensive to get
Is there a sherriff department in Florida that isn’t corrupt as hell?
There isn't a police department in the country that isn't completely corrupt.
No
Theres no shortage of cops acting unlawful on video....every freaking day!
We should all have dash cams, the Avylet A1(only $50) has good quality and all the features, but it also swivels to capture a cop at driver's side window. Also buy an endurance micro SD card ( memory card)of 128 gig, $15 more
I'd like to see a deposition where a police office says a suspect made furtive movements, and to be asked to define the world furtive.
They love speaking big words that they don't even understand (if they were to be called on it).
They'd have no problem , they got that particular lie down pat !
@@user-gx2yy1df6f I can see in my mind an officer defining furtive as the action that I saw him do.
I would describe it as what this camera is doing during the video.
Seen the deposition of a 30 year career officer. Was asked if he knew and understood the 1st amendment and the 4th amendment. You would think they would know these by heart. His testimony was an embarrassment to say the very least.
“When you have good lawyers . . . we can expose the lies.”
What if have a corrupt Gestapo judge?
Better question is "what if this happens in Florida?" We already seen judges side with police in response to cops infringing on people's rights and then doing nothing down the road when those decisions are overturned at a higher court. Its disgusting how the oath these tyrants took matter less than a hole in the ground that they piss in.
Wow..he didn't even sue. That's why police are never held accountable! #NoAccountabilty #AbolishQualifiedImmunity #BackTheBlueUntilItHappensToYou

Theyre the street gang for the jewish mafia ruling over america.
Same/same.
Nice to see some good lawyers still out there. You are a rare breed my friend keep up the good work.
If the police say they smell marijuana, take you out of the car and then search the car without reading your miranda rights, this could be grounds for a dismissal?
We lost all our rights under this zionist occupied government
The Supreme Court in several states has ruled a "smell of marijuana" is not enough suspicion. If they say they "smell marijuana", tell them you have no idea what that smells like, smells can come from anywhere, they aren't drug dogs, you don't consent to a search and you want your lawyer.
No. The smell of burned marijuana is enough probable cause to search a vehicle. Miranda only applies to questioning, not searching.
What would be testimonial about stepping out of the vehicle after being ordered to do so?
The way they talked was about as unprofessional as it gets!!!
Aren't false or perjurious pleadings in affidavits to the court Brady offenses?
The Brady List is the ultimate prize for cops. Meaning they can't be trusted and have lied to get convictions.
How many innocent people sitting in jail due to corrupted law enforcement ?
Yes, it is even criminal if you're not a cop.
Cops that purposely lie, lie on reports, to the courts, etc should be charged
I’m a little confused by what you said at the end. Was it a complete dismissal, or was there a misdemeanor charge? If so, what was the misdemeanor?
Also, the cops seemed to really have it in for this man from the very start. Did they know him from a previous interaction? They just seemed determined to “get him” for something, ANYTHING. Bullies with badges. 😡
He was saying that the prosecutor didn't even try to argue for misdemeanors or to offer a better plea deal. He went straight to dismissing the case in full, no negotiation.
Furtive movement reminds me of the incident in which cops pull a guy over for not using his turn signal or stopping pass the stop bar. It took the cops all the way up to handing the guy his ticket before they mentioned furtive movement and how they wanted to search his vehicle. In the end both cops get dragged by the guy and he ends up in jail for over a year before a judge throws out his case stating the stop was over the minute the guy was handed his ticket and any injuries the cops sustained were at their own actions.
excellent video, I see you are the type od Lawyer that actually cares about his clients, I am impressed
One of the longest ads I've ever listened to on CZcams. Well done guys!
You'll be glad that you watched this "ad" when the cops pull you over and starting making false assumptions.
@@mikeelek9713 you are correct! Especially since I live in Arizona, where our public servants are as bad as they come.
This is why I keep lawyers on retainer and have dash cams in all my vehicles. Thanks for taking time out of your day to not only read but also comment on my comment!
Officer what reasonable articulate suspicion do you have to stop me? Officer If I'm not under arrest and you're not citing me I'm leaving. Officer if you want to talk to me I want a lawyer. I am citing my Fifth Amendment Right to remain silent.
Officer- I don't need one. License & Registration, Proof of Insurance.
You- No probable cause!
Officer- Don't need one.
You- I have rights!
Officer- Correct. You have the right to purchase a vehicle, and to tag/insure it, per state law, and the state requires you have a drivers license while you operate it.
You- That's not what I want to be stopped for!
Officer- By law, I don't need your want to have a reason to stop you to check your license, registration, and proof of insurance, and to make contact with you.
You- B-b-but...
Officer- Not to worry, some internet ambulance chaser with an extremely poor understanding of law will get you off on a legal technicality, but in the meantime, now we know what drug network you are involved in, and where it and your friends are generally located, so can focus on it more effectively.
You- B-but...I feel like...
Officer- I feel like our next encounter when you are carrying illegal drugs and weapons will prove more fruitful. Oh...and don't forget, now we know to keep an eye out for your specific vehicle that is involved in the local illegal drug trade because we have witnesses ID'ing you, and your vehicle, and known drug houses.
You- B-but...the constitution and laws and stuff!
Officer- Neat. Oh, by the way...there is no constitutional or legal right of yours to engage in criminal activity or that I have to tell you, while you are in commission of criminal acts, any kind of "probable cause truth". My job is to make contact with criminals, sometimes in commission of crimes. Surely your internet ambulance chaser will help you understand that. In the meantime, get in the back of my car so we can get you on down to the pokey to get processed & booked. Because take a guess at what we found in your center console, and hidden under the seats.
All that really matters here, is that now the coppers can focus on illegal drug networks full of stolen property, illegal weapons and the sale/distribution to minors. Those poor, innocent criminals. If only those mean old cops would stop focusing on them all the time, and "focus on real crime", amirite?
And let's face it...without internet ambulance chases, and drug dealers or their customers being brainiacs who literally lead cops right to their dope house nests, they really couldn't do it without you guys. Not this easily, for sure.

@@TheCaptainSlappyCalifornia is a state where the police now MUST tell you why they pulled you over.
@@TheCaptainSlappyNice fantasy, but its not reflective of reality. Even in stop and ID states, all have clauses requiring reasonable, articulable suspicion that a crime has happened, is happening, or will happen. Saying that those who don't want to be harassed and heckled are drug dealers is a huge stretch and fallacious at best.
@@TheCaptainSlappy I don't smoke drink or do drugs. All I care about is citing my rights and allowing the officer to voluntarily revoke Qualified Immunity. Most the videos of cops on CZcams they obviously don't just want to violate your rights, but retaliate against them. You have a smug almost doper attitude.
That is something else you can do when tghe officers voluntarily revoking Qualified Immunity, "Officer it's obvious you don't want to violate my rights but v retaliate against my rights. That is a very unique way you have chosen to voluntarily revoke your Qualified Immunity, thank you".
So you accepted a criminal conviction even with his rights violated.
No. There was no conviction. The guy can't sue the police if he plead or was convicted and he clearly states that was an option
@@perrymeril he said they plead to a misdemeanor. A misdemeanor is a crime even if less than felony. 8:40
@@stevek8829 he CANNOT sue the police if he pleads to ANYTHING. The lawyer clearly states in the video that they could have sued the department.
I understand his wording in that section confuses people but this man plead to nothing and all charges were dismissed with no attempt at negotiation by the prosecutor. He added those sentences to emphasize how odd it was for the prosecutor to dismiss the charges point blank and how strong of a vindication it was to do so.
@@perrymeril i gave you the exact time the lawyer says it was reduced to a misdemeanor. What don’t you understand? That means they plead guilty. Who told you the criminal case controls the civil case?
@@stevek8829once more, I understand the audio does not help the situation, but the guy did not plea guilty. There was no negotiation of his charges. They were 100% dismissed. If they were not, the client COULD NOT SUE THE POLICE.
Great job explaining!👍🏻👍🏻👍🏻

Please read this and lets get to work.
“whenever any form of government becomes destructive of these ends [life, liberty, and the pursuit of happiness], it is the right of the people to alter or to abolish it, and to institute new government.”
Clearly state you do not consent to a search, then you want to use your constitutional right to remain silent. Then shut up.
Excellent job, need knowledgeable attorneys like y'all 🤠
This guy should of held these cops accountable so they wouldn’t do this again
How so? If he sued them and won, taxpayers would pay. Cops aren't accountable, .
Cop: “Am I gonna get hurt?”
Me: “I sure hope so.”
First of all you don't have to tell them where you been and where you're going it's none of their business
So every traffic stop is custodial custody because your not free to leave so as soon as a cop asks for license and registration are thing obtained without being notified of miranda
That very thing is going through the courts right now.
@howlinwulf good they need to understand that miranda applies to talking to every government official even getting a driver's license those government officials would use all you say and do against you
If the government wasn't criminal, they wouldn't force us to surrender our 4th and 5th Amendments during a traffic stop.
The dmv has no lawful reason to get your personal information like address name and social security number
@@howlinwulfwhat case? Because SCOTUS ruled there’s no Miranda required for basic traffic stops 40 years ago in Berkemer v. McCarty.

Power from one point has too much power.
Does he realize that he doesn't have to answer the revenuers.. um,um I mean.. cops question right?
It’s difficult to tell what is going on because of the brakes from the video to yourself
I'm in Barnstable, Ma. and they have repeatedly violated my rights. I mean blatantly. I could write a book about my last experience alone. On another occasion I was bleeding in 5 places, had a severely sprained ankle, and am permanently disfigured. When the police arrived I was talked to like little kid that had just broke grandma's antique cookie jar, threatened with arrest twice, told not to come back outside, called a liar, and accused of faking injuries. Not even a police report was filed. My attacker was allowed to go on his way while they ran checks on me and were verbally abusive. All I was attacked because I was recording in public and they guy didn't like it.
NWA didn’t write a song about the fire department….

As a lawyer who has the authority and responsibility to refer criminal civil rights claims to the DOJ. Specifically for 18US241 and 18US242 issues. I think it is strange we have laws like this on the books but cops are rarely charged and prosecuted for them like in this case.

And they should do both less.
Looks perfectly normal for today's America. We're not going to change it, so deal with it!!!
Did he drop charges or reduce. This sounds like you making it up
8:42 reduced from felony to a misdemeanor is not dismissing all charges is it?
Isn’t that a plea deal?
Thus, he plead guilty and has a criminal record??
He took no plea. The quantifier is that the prosecutor offered to drop all charges in the sentence prior and after the confusing remarks he states the guy has a case against the police that they would take up had the arrested taken them up on it. You CANNOT sue if you plead guilty.
The sentences there were to emphasize the flat nature of the end of the trial - no negotiation ( didnt try to get a better plea, reduce chargea ) as is what normally occurs.
It's hard to hear but the guy does turn the statements into a negative ( no reducing to misdemeanor, didn't try to give a better deal ).
Great job getting the man off we need more attorneys like you but I wish the officers would’ve been held accountable for their actions. That way they might not do it again to someone a civil lawsuit would’ve been great and they lost a qualified immunity because those Blue Line Gang Members were extremely rude And they violated the man’s civil rights Thanks again for all you do for the people.
