    I came here legally in 2016 and have worked my ass off. Proud of everything I've achieved in this great country and I truly believe in the American dream because I experienced it first hand through hard work but I do not believe illegals should be given the same rights as me. It took me years to be able to come to the US. I worked my ass off to get here and it's disgusting that they're being allowed to claim asylum, take people jobs, money, etc.

    In the view of the founding fathers, yes these rights are extended as human rights or god-given rights. However, until the 2nd Amendment is applied to regular American citizens first, then I don't think the illegals deserve the right at all. The government needs to apply the Second Amendment the way it was meant to and get rid of all of these unconstitutional gun laws before I agree with giving the Second Amendment right to illegal immigrants.

    Courts have long held the bill of rights, or portions of it, apply to illegals. Think Miranda, search and seizure, etc. I believe this will be overturned.

    Doesn't possession of a firearm while in the commission of some misdemeanors bump them up to felonies and lesser felonies up to more serious ones? Since they're by definition, committing a crime just by being here, I'd say absolutely not and if caught with a firearm, they should be immediately deported, no appeals, no exigent circumstances, no hearing, put them on the first plane, train or automobile outta here.

      It's even clearer in the Constitution. People, not citizens, are specified. They're people. Citizens are specifically called out in the Constitution when citizenship is taken into account. Maybe read the constitution.

    The fundamental question is does the bill of rights apply to people who come here illegally? If not can we imprison them without charging them, deprive them of property and essentially treat them as a lesser human? I think a reasonable person would say that they do have rights. If they have any rights then they should have all of them. 2nd Amendment isn’t a second class right.

    Let me say I hate going to the gun shop! It's because I feel 2A is inalienable, and the 4473 is a violation of my Constitutional rights! Especially when my NICS check goes into delay and I have to wait till the following day to pick up my new purchase. I don't understand why sometimes, NICS gets approved in 5-10 mins, where other times it goes into delay and I have to wait till the following day for the approval.

    There's a difference between purchase and possession. From what I understand this ruling would make it legal for an immigrant to possess a firearm, it does not mean that they can purchase one from an FFL.
    Basically this ruling is in holding with the precedent that the Bill of Rights applies to everyone. Weather or not they are a legal immigrant in the US. It's also funny because citizenship wasn't even clearly established until the 13th amendment.

    The way I understand the ruling is it only applies to possession of a firearm. Illegals cannot be charged for possession of a firearm. It doesn’t mean they can acquire firearms in the U.S., if for example they bought the firearm with them that would be ok. Being here illegally is also a crime and that should be the issue they face in court, as well as any potential crimes they commit.

      Illegals have driver’s license in some states and also have an ITIN taxpayer ID, plus you don’t need a social security number to fill out a 4473

    The way I see it is the constitution recognizes the inherent right of all people to keep and bare arms. The bill of rights however protects citizens from government infringement on those rights, it does not protect non-citizens from infringement of those rights.

    Gun ownership is a human right that applies to all people the world over. It existed long before the constitution. The 2A simply says the government shall not infringe it. Other countries violating their own citizens rights does not mean the right does not exist in other countries. So if a foreigner comes here, even illegally, they didn't gain anything new. The constitution simply says their right shall not be infringed.

      Therefore all illegal migrants within the USA are either criminals who are to be deported, or felons who are also to be deported, neither of which are capable of legally purchasing a firearm.

      @@petyrbaelish1216 that is not true. Anybody found to be illegally residing through unlawful entry, overstaying a nonimmigrant visa or various criminal grounds is subject to deportation. Aka all illegal migrants.
      Additionally, it is unlawful for a non-resident to purchase and carry a firearm, so if that is also a factor they are in criminal possession of a weapon that was illegally purchased.

    Ok, before I watch this… it matters not what we think SHOULD be. We are the side with principles and so we must be consistent and base this answer on what the 2nd amendment says. Rights from “the Creator” (God) are not dependent upon fake lines on a map that God did not make. If we don’t like that, we must change the constitution.

      I don't like the idea. Though at the same time am self aware enough to realize I've argued for inalienable creator given rights for to long. Got to stay consistent with the principle.
      That's not to say that something shouldn't be done about their being here in the first place. Otherwise they will soon also be handed the right to vote. I think that was the intention of this ruling.

      @@matthewbeaver5026 100% that’s exactly what I meant. The rights enshrined in the constitution are the rights of all mankind, not just American citizens. At the time the constitution was ratified the phrase “citizens of the United States” had never been uttered before, and would not be until the 14th amendment was passed in the 1860s.

    My understanding is that the bill of rights enumerates the rights that all peopl are endowed by their creator. If the person is in the nation illegally then they should be deported. If that comment a crime then that should be treated as a criminal. All people have a right to protect themselves. If they are criminals then they need to be held responsible for their criminal actions.

    The judge was absolutely right. The People includes everyone. You can believe that they deserve 2nd amendment rights AND they should be deported. This ruling is a win for us.

    I'm pretty sure Constitutional rights aren't meant to apply to the entire world population. When the Constitution mentions "the People", such as in "the right of the People to keep and bear arms...", they're definitely referring only to American citizens. That's why a person in Russia can't appeal to the 2nd Amendment when a Russian court accuses them of violating Russian firearms laws, etc. I mean... C'mon, it's not that complicated!😀

Now, if you're saying it somehow doesn't count because it was officially British colonial soil... Well, yeah, of course, unless you were a flippin baby born on or after July 4th, 1776! And the Constitution shouldn't necessarily be construed to be from the time of the founding, at least not the Revolutionary War period. Regarding the 2nd Amendment in particular: it wasn't drafted until 1791.
