  • Amber Heard's attorneys at her defamation trial against ex-husband Johnny Depp have asked the judge to dismiss the case, arguing Depp and his attorneys have not proven their case. Depp has sued Heard for $50 million, alleging that she irreparably harmed him when she claimed to be a victim of domestic violence in an op-ed in the Washington Post.

Yes, this lawyer says that he has to prove that the statements Heard made were false. How does he prove a negative like that he never abused her? She could say that he turns into a purple elephant at night and he would then have to demonstrate to the court that he doesn't have those powers??? It makes no sense. She should have to prove that her derogatory statements from the OP-ED were all true.

    1. The police report, audio recordings, body cam footage, etc show she lied and in fact was herself guilty of DV to Depp. Her claim was that he physically struck her, not that he called her mean things. So he’s met the first burden.
    2. She did push the OP Ed, the publishers didn’t just make up that story they got it from her directly. Second burden met.
    3. She DID cause damage. The fact he lost multiple jobs and still is barely working meets that burden.
    4. Lastly claiming her intent was not malicious is laughably stupid.
His entire argument boiled down to that the WP wrote the article not her… as if she didn’t go to them, give them all the details specifically so they could post it and then later shared it and thus somehow isn’t liable for openly sharing known lies to damage him. Disgusting.

She has to be accountable for her actions. No one alive completely disregards themselves completely of any and all responsibility. Most victims even blame themselves for certain incidents though not their fault but there's so much emotional abuse on top of the physical as they're blamed for getting the abuser to lose control & attack. She's making it that much more worse for victims to come forward. She doesn't even cry. Oh she's acting like she's crying but it's an act because there's no tears and no flush of cheeks like trying to hold back her fear because she never feared him which is obvious. It's clear of the contempt she has for him but that's all anger with smugness and blame, not true fear in any way which being a victim myself, you carry that with you and remember it vividly even with help and moving forward. We do not discuss the incidents using present tense!

But as a general rule of thumb a Judge should give a bit more space towards the defendant.

In many recordings, she’s yelling at him and he is still replying to her calmly. Personally, if someone raises their voice at me - I raise my own automatically. It generally happens.
