Thanks for all the info you are providing. Just got 100% P&T TDIU after HLR informal conference. No lawyers, no vocational experts, just good medical evidence from private doctors and a good C&P exam. My VSO submitted the proper forms and that was about it.
THANK YOU, THANK YOU THANK YOU! I just got my decision, and I’m now 100% P&T. Your videos helped so much!! I can say it enough, Thank you!
I am so happy for you and it’s a good feeling knowing these videos aren’t useless!! I hope this lessens the financial burden on your life.
- Clay
I'm 100% PT but really enjoy watching your take on disability claims and tips. I've passed your channel to others who are trying to get there. Keep up the good work! MB
Dude…awesome and thank you so much!!
- Clay
Also, I was able to get one emailed to me in minutes from calling the 800 number. Thanks for the info Clay!
What’s the number? Thanks
Great info, thank you for all your hard work
Veterans, this the best channel on CZcams! Thank you so much for what you do for all veterans
Good job going over the details of re-evaluations.
Thank you for this video !!! From Los Angeles but over here Big Island Hawaii!!
5k views, should be 5k likes. He's providing valuable info
^^^^^ I’m sayin’

Good video, I was gonna ask you if there were a certain number of statics you need for P&T and you answered it. 👌🏼
Word! Yeah they have to = 95% (VA math) to reach P&T.

Thanks for helping us Brother❤
For me when I am speaking especially to our younger veterans I Harp on them to 1) get in the VA health care system 2) get in a primary care provider group 3) make at minimum annual check ups 4) at these annual check ups talk about your Service Connected illnesses and injuries. Be frank and open have they improved have they gotten worse what medications seem to work and those that no longer work.
I had a VA scheduled reevaluation and since I was not using the systems I was down graded. Once I showed my civil doctors records I was promptly given it back with back pay. The VA did a records review only I never seen a Provider. This was 2003 I believe.
My RFE was done 15 years after the initial award, so needless to say, it took me by surprise. Either way, it worked in my favor as I was awarded an increase and it went static at that point.
Just so you all know… best way to ensure you get an actual copy of this info is with the FOIA request. 99% of VSOs will NOT print from VBMS. Also, going to a regional office will most likely lead to them having you fill out an FOIA anyways.
I filled out a FOIA from my regional office and got my updated sheet the same day. I hear they don't do this anymore.
They do

C-File takes forever but if the veteran just wants their RCS or completed DBQ or whatever else…the RO is the fastest way.
- Clay
@@TheCivDiv Interesting. I just spoke with a veteran that went to the Baltimore Regional Office to get their Code Sheet and they were told to "Please fill out an FOIA request and we will process it and it should arrive in a few months. We do not provide that information at this office." Also, can you point to a resource that lists the Regional Office phone numbers (as you said to call in this video) because EVERY place that can be searched just lists the 1-800 general number. Thanks!
My decision letter does not mention static or not. It also does not mention further exams any where. I can make an appointment 3 months out at the Hampton regional office or simply file FOIA.. Or try y luck at a walk in, which I may do once just to see… You mentioned your decision sheet tells you but order a rating sheet if you like - I just don’t see it.
I called the va and got my va code info emailed to me which was nice. Not all operator callers will do it. I would just call again and ask.
BUILD YOUR MEDICAL WITH YOUR PRIVATE DOCTOR JUST IN CASE. GO RESEARCH YOUR ISSUES AND BRING YOUR MEDICAL EVIDENCE TO YOUR PRIVATE DOCTOR AND TO YOUR PRIMARY CARE DOCTOR SO THEY CAN GO TO WORK.
Thanks!
Oh my goodness!? Thank you so much!!
- Clay
Thnks brother
I called the VA Regional Office in my state and asked whether the conditions were static or not, and she told me over the phone. Not sure if all offices will do that or not but this one did
^^^^ calling is always step 1
- Clay
👍 My c-file took 6 months. RCS with diag codes took 1 week after calling VA and them mailing.
^^^^^
- Clay
Did you just call the generic VA number or did you call a special number?
Hello Clay and thank you for all the great info. I just received a denial on a suplemental for tinnitus. I submitted everything, diagnosis, service event, personal statement, nexus. What do I do next? Thanks
I have the same plaque. My daughter got it for me. 2 light sabers. :0)
Nice! Mine needs to be updated to add a 4th 🤦🏻♂️
- Clay
I was told to fill out a foia request to get my recent c&p notes and rating code sheet.
I believe that the VA benefits web page should provide all Vets the ability to download our C-file directly to our computer. Why should a VSO or attorney have access to our data but we do not. It is another delay tactic (~6 months) making it more difficult to file additional claims, in spite of a ITF. If we all submit this with your position to your legislators we could influence their support to direct the VBA to make this happen.
I totally agree. Jason from Veterans Info Tap and myself talk about this same subject with the ‘Green Button’
- Clay
The dates on the code sheet is good to know also before submitting a ratings increase. So you known when your 5 years is up.
👍💯
I requested my c file in September and they closed my foiaa request a month ago but I never received a letter or my disk. i called 800 to ask what status was. now va opened a new foiaa request! hopefully not a long wait....
So if I happen to have a reevaluation on my current service connected compensation disability where on the award letter should say the future date/reevaluation? Thank you
My letter I received with my initial ratings showed the rating code for each of my rated disabilities. Is this not normal? Or is the c- file just different in showing the static non static ratings?
So in my decision letter if none of the things that I got awarded disability for state a future reevaluation date then that means that it's static?
What about letters you can get from myVAhealth ? I was at 100 7 years ago and the letter would state 100%. After a new evaluation 3 years ago the same letter now states 100% Total and permanent.
I’m in Indiana and my VSO did print my code sheet for me but he did ask me why I wanted it which I thought was more weird. 🤷♂️
Some VSO offices go the extra mile and kudos to them!!
- Clay
My county VSO said that they do not allow them to print the codes out anymore. She filed a FOIA for all my stuff. I haven't received anything yet.
I have claims pending atm. I just turned 53, so if i get current claims service connected, i wont have a reevaluation ? in 2 years i will be 55
I just checked my original award letter from 7-8-2011 and the only thing it states is "An examination will be scheduled at a future date to evaluate the severity of your service connected xxxxxxx" I've been seeing my VA provider regularly since then and have never had a re-eval. If I'm understanding correctly, I won't because it's been nearly 14 years?
Clay where could a veteran seek and find pertinent information about his military service if they don't find it in the c-file or str? How can you find those missing military records that are missing?
National Archives through your service and I heard that’s a nightmare
- Clay
4:05 I guess things have changed. I have read my decision letter multiple times and it doesn’t state anywhere that I’m due for a review or that I’m static.
That means you’re static. The absence of the RFE is the indicator.
- Clay

I am 55 just got my initial rating am I exempt from future exams?
Let me ask you this. I went up to 90% for PTSD and headaches about a year ago and I'm 57 years old. Am I going to need another examination in 5 years or since I'm over the age of 55, or am I safe from having another examination? Thank you for all you do for the veterans.
The VA's 55-year-old rule protects veterans' disability ratings from being reduced after they turn 55. This means that veterans are no longer required to attend periodic Compensation and Pension (C&P) examinations to prove their condition hasn't changed, unless there's reason to suspect fraud.
Damn i just realized im not 100% p&t. Im 80% rated , and I recently submitted a claim for sleep apnea which i was diagnosed with in October. Hopefully that takes me to 100% pt
Doing math…a 50% rating for OSA will not push your 80% to 100%.
- Clay
@@TheCivDiv wow really?. Well I claimed it secondary to sinusitis which im rated at 10%
Question. If recent claim doesn't get approved, should I submit an increase for anxiety which I'm rated at 70%?
Hello Clay. I have printed all my service treatment records put them in dividers inside a 3 ring binder. It has everything I was getting seen for, diagnosis and physical therapy. So what if i do not have a diagnosis for some things but have complaint for it is that valid for evidence, for examples i was having sinus issues went to the clinic they gave me medications and put Allergic Rhinitis but was not listed as a diagnosis. Also how soon can you file a claim for PT if your conditions are static.
Your documented symptoms from service are SOLID evidence and will suffice as the in-service event. You will need a current dx and other than that…VERY strong claim.
- Clay
@@TheCivDiv I see thank you so much
Took 8 months in 2023 to get my C-file. Just for another reference.
Awesome and thank you for sharing!!
- Clay
I just separated and got 100PT from VA and 50% with the Air Force. Do I need to be looking to do anything else?? Thank you!
Just understand your benefits both federal and state. I’ll put links…
Federal: czcams.com/video/jLvo3GVANrY/video.htmlsi=052zep1EI_TL8lX1
State: czcams.com/video/sHu31_t1WMo/video.htmlsi=dvqVXucYChkXWgl_
- Clay
So the static conditions just have to be 95% to get to 100 P&T? I thought the static had to get to 100% or over the 100% mark. Thank you for all you do.
Yeah they need to = 95% to reach P&T and that 95% is VA math.
- Clay
@@TheCivDiv I learn new things from you all the time. Thank you.
What if your decision letter doesn’t have a future appointment and also doesn’t say static anywhere on it?
My question as well...
None of my static ratings have anything on the letters. I don't think he's correct on that statement. You have to call or FOIA to find out the status.
@@59thfsaviation79 roger that, thanks.
What if you’re over 55 yr. Does this make any and all claims static. ?? Like any new claims.
It exactly but what you’re getting at is your ratings are protected outside final circumstances. This is discussed towards the end here.
- Clay
@@TheCivDiv ya I saw the end. Sorry brother have a habit of making commits prior to watch full video. Lol.
Thnks for answering.
Is getting the C file also 6 months for the first two paths as well or via FOIO?
A C-File will be 6-9 months.
- Clay
@@TheCivDiv, ah ok, so regardless of going through the regional office or a VSO. Does the 6-9 month rule apply to getting DBQs as well?
I just checked my letters. Not a single one of them says whether the condition is static or not. Calling and asking or FOIA is the only way to find out.
If it doesn’t say RFE on your letter, then it’s static…that’s the whole point.
- Clay
@@TheCivDiv I appreciate that, and I may have missed it, but you only said your latter tells you. So in this case, nothing means no RFE, but I didn't get that from the video. Thanks for the clarification.
What if your "award letter" has no mention of "re-examination"?
Then you don’t have a reexam
