    In this episode of the Italian Citizenship Podcast, hosts Marco Permunian, an Italian citizenship attorney and founder of Italian Citizenship Assistance (ICA), along with dual citizen and content creator, Rafael Di Furia talk about how the spouse of an Italian citizen can become a resident in Italy and how a spouse of an Italian citizen can also become a resident in another EU country. Marco and Rafael will also compare getting residency in Italy with getting Italian citizenship through marriage and the benefits of each. For those who already have Italian citizenship by descent (Jure Sanguinis) being able to have the ability to bring your spouse to live with you to live in Europe can be a large benefit of having Italian citizenship. Even for some who are in the process to get Italian citizenship through ancestry may be able to have their spouse legally reside in Italy.

    Very informative video, thanks for sharing. I’m a nonEu spouse of an Italian and I always go to the nearest Italian embassy to apply for a visa just to enter Italy. I didn’t know that I can enter Italy (or any Schengen countries) without a visa for up to 3 mos. It would have been a gem if I’ve seen this video ages ago. Nevertheless, I’m thankful for this info.

    Thanks guys for all the information - you are fantastic people and I'm starting to see a clearer picture on what to do when we are finally allowed to come to Italy. I believe I will need to show some proof to the Australian government that we will be allowed to stay for longer than 3 months in Italy. I understand from your video that my husband (dual citizen) needs to register at the comune to re-locate in Italy and I will need to apply for a permesso di soggiorno per riacquisto di cittadinanza within 8 days. I have my Italian Marriage certificate, my Australian passport, Australian citizenship and my Italian Birth Certificate so I should be ok.

    Very helpful! Thank you so much! There is conflicting information from different lawyers on whether one is authorized to work with the permesso di soggiorno in attesa di cittadinanza. I understand you said it's possible but many say it's not.

My husband and I are going through this right now moving to Milan 9/12 and this video confirms our research and conversations with the consulate! --QUESTION -- As the non EU citizen/IT resident, does the 90 day travel restriction outside of Italy work the same as the Schengen visa? 90 days total in any EU country in a 180 day period?

    If you are a dual citizen US/EU and spend, for example, 4 months in France, 4 months in Italy (residing in the EU more than 183 days) and 4 months in the US would you be liable for income tax from any of the EU countries?

    I was Married in 2001 and I would be going through with a 1948 Case. With that being the case, if after I gain Recognition and would like to go to Italy with My Wife, would My Wife have to Wait for Permission of Stay?
    Would My Wife be able to apply Immediately after I gain Recognition since We would by that time be Married for 20 or More Years?

    Interesting... in my case i'm british and already a resident of spain for 5 years on my own merit but my partner is italian and we are thinking of relocating to Italy this coming year. We are not married but are registered as non married partners. would the residency process be the same?

    I’m the spouse of an Italian I too had the PR but it’s expired as I’m living in Australia for most of the time.Can I still visit Italy for a holiday with my husband.He too was in Australia for 10 months.He is a pensioner drawing an Italian pension. I would love to make an appointment with you hoping I get to Italy. Thanking you

    I have a specific question relating to a topic you covered in this video. I understand that the couple must stay married and the Italian citizen must be alive for the duration of the first five years, but what if (heaven forbid) the Italian citizen passes away before the five year mark, but they have a minor child who is also an Italian citizen registered with the local municipality? Can the non-Italian spouse stay in the country to continue raising their child? Do you know if the same rule applies to all EU countries if they lived in a different EU country? What about divorce and the non-Italian citizen keeps custody? Can the non-Italian citizen stay and raise the child in that case?
    My wife and I are planning to move to Portugal once my Italian citizenship is recognized. We’ve been married 30 years, so divorce is out of the question, but we do have a 4 y/o son. Heaven forbid something happened to me, I would want her to be able to stay in Europe.

    Thank you for the information. I am the de facto partner of an Italian citizen. So I apply for the D Visa Business/Student, but I don't have the enrolment into University or Business invitation letters, what supporting documents do I supply to prove our relationship etc and wont the application be rejected because it does not have these requirements?

    If I gain Recognition through the 1948 Case and My Wife comes along with Me to Italy and requested a Permission of Stay, would My Wife be able to Stay in Italy even if I had to leave Italy for any reasonable period of time like a Weekend or a maybe even up to a Month or would She be able to stay in Italy while I'm out of Italy for reasons that might be needed?

      My husband and I are going through the repatriation process right now. We were told once my residency application is completed and I have my card, yes my husband (the Italian national) can travel as needed. But during the application process it can be iffy for him to leave as they do come to the home to visit to make sure it is a residence and you both live there.

      I’ve tried this one before and the residence permit is acceptable to go around Schengen countries without showing the passport

    I read in multiple places that you must have a family unification visa, and the non-eu spouse will not be given a residency permit while in Italy on a tourist visa. This would be a big difference as the unification visa requires the Italian spouse to already be in italy. can you clarify, please?
    The way you presented in the video seems so much better for us!

      I read this too, I am british so non European now but husband has dual nationality Italian/British and now I will need a family unification visa before applying for residency and can't do it on tourist visa. However I have been advised by European advice department and another law firm in italy that i don't. I am very confused also and would like clarification as getting conflicting information.

      Did you ever find out the answer to this question? I'm currently dealing with the same issue and it will be a big problem if I can't enter on a tourist visa and change it.

    Excellent and thank you for the high audio quality. But I am still confused about residency permit for the non-Italian spouse and the permesso di soggiorno. From what I understand, a non-Italian who is recognized as a resident of a commune must still have a permesso di soggiorno to stay in the country. So, for example, I am an Italian citizen. I get married to a woman in Trans-Dnistria. I bring her to Italy. My commune grants her residency. But she must still have a permesso di soggiorno, which must be renewed every 3 or 6 months. Or are you saying that a "residency permit" is different from being a resident of a commune, and allows the non-Italian to stay in the country without a permesso di soggiorno?

I am from USA and have been living in Italy for 10 years and I still do not understand anything. I can stay here because I am Italian citizen by ancestry. Italy system is very very complex and difficult to understand.

      @@tonytony1035 It's a walk in the park compared to the US system. It took me almost a year to get a green card in the US and my paperwork was at least 4-500 pages. I paid about $3,000 in immigration fees, excluding all the paperwork, and process, for naturalization. They fingerprinted me at least 10 times (each time I had to pay a fee, at the time $90) and went through at least 2 FBI investigations. A Green Card through marriage is still one of the easiest, so to speak, processes; with one caveat, the Green Card is valid for only 2 years after that you have to apply for the removal of conditions on it and guess what? More fees LOL. In my case, everything was squeaky clean and linear, no shenanigans going on, etc. I can't imagine the headache for somebody with a less-than-perfect situation.

      As far as I know, it also applies to same-sex unions, but you need some way to prove it. Contact a lawyer specializing in Italian immigration
