What is an employee is still with the company but is unable to take off their vacation days during the year because they were way too busy working to take any time off. We were planning on cashing in my husband's unused vacation hours in addition to his regular pay and having extra money for Christmas presents for the kids but now they're saying that my husband either has to use the hours and stay away from work or just lose them my husband can't even take days off of work because they have so many big projects going on that he is unable to take that time
I'm in this position too
I am in the same boat. I am in Canada and those days can’t disappear here. Use it or lose it is illegal. I just tossed it over to HR, legal, and project management to figure it out. Although a payout makes the most sense that is against policy so probably it’ll be decided to just carry over the time even though that is also against company policy.
Also. I’d like to know if my work place can make me come in on my days off. My job only gives a 12hour notice for the following weeks schedule. For example. The schedule comes out Monday for Tues-the following Monday. The schedule come out and I’m off on a Wednesday. Then on Tuesday the GM says I need to come in Wednesday for a meeting. Can they make me come? I’m getting fed up with this and I know it’s gotten worse simply because I usually just comply. Thank you for your time.
I am waiting on the results of my physical for my new job to come through which is the final pre-employment step. Then I will be able to give my resignation notice.
I have a question though!
I have 8 days of PTO accrued. With new California law, it’s “use it or lose it” so there is no payout.
I would love to do put in a 3 week notice. 2 weeks of work & 1 week of paid leave as a buffer time between jobs.
How do you recommend I approach this??
PLEASE HELP🙏🏼
Yes, I live in Kentucky and I was recently terminated from my job and I have vacation time coming a weeks vacation and four days PTO I don’t think they have to pay me for my PTO but from what I understand they do have to pay me for my vacation time is that right?
Every state's laws are different. Since we're in Colorado, we won't be able to help you on this matter. Our advice is to contact the Kentucky Bar Association. They'll be able to provide recommendations for employment law attorneys in your neck of the woods.
Another question we work 10 hrs monday tru Thursday lets say i want to take vaction on friday but employer asking to take vac time on friday is that even legal even after i work my 40 hrs?
My employer Defense Commissary Agency Broke there contract that was supposed to last a year at the 6 month mark. I’m not sure what Hawaii’s laws are for suing an employer for unpaid unused leave.
I want to sue them for also with holding my pay from me.
We strongly encourage you to reach out to the Hawaii Bar Association to get recommendations for employment law attorneys in your area. We're in Colorado, so unfortunately, we cannot assist you.
I worked two or three jobs with a salary and accrued vacation days which were mine to take during employment. I recorded my day's honestly I took when I had the days. I never took time off without the clearance of my manager or direct report. Some of my coworkers did not record theirs honestly and hot rewarded for it based on political affiliation or fraternity or sorority affiliations. I was unaffiliated and it was held against me illegally at these places Uab Von Braun center and Randstad Huntsville and Birmingham. I was pointed by these places but others were not.
We're sorry to hear what happened to you, Jonathan. Since it would appear you're in Alabama, you would need to get the assistance of an attorney there; we're based in Colorado. The Alabama Bar Association should be able to assist you with finding an attorney in your area. Best of luck to you!
They told me I got fired cuz my points went over 8 but it went over 8 cuz they gave me a point for an approved day off and the supervisor said I could come back and I did but hr said I was fired before I got that accidental point but the supervisor fired me for it yet I still got denied lol

What about unused vacation time law June 2021 (in colorado) that accrued unused vacation time must be allowed to carry into the new year. Can a company loophole out of that by stating "it will be pushed into the next year but you can only used the same amount given per year/earned time". Meaning that you don't get any additional time if you have unused vacation time. Can they limit the amount of vacation time per year which would loophole that law useless.
Thank you for the question. If a Colorado employer provides paid vacation time, it must be paid out upon separation. However, Colorado employers are not generally required to provide paid vacation time in the first place (as opposed to some other kinds of leave, such as medical or jury duty). As such, they can set certain limits on how and when the time is earned, such as setting a maximum hour cap as detailed.
What if you’re not terminated? Do they still owe you vacation pay or is it use it or loose it? At the end of the year?
In many states, being fired also is not relevant to this issue. Although many employers try to make it an issue. They are hoping you are ignorant if the laws in your state.
In Colorado are employers allowed to deny cashing out PTO at the end of year if they let you roll over 40hrs?
Hi Nick: Here's specifically what the Colorado Wage Act says about paying out unused PTO: "(III) Vacation pay earned in accordance with the terms of any agreement. If an employer provides paid vacation for an employee, the employer shall pay upon separation from employment all vacation pay earned and determinable in accordance with the terms of any agreement between the employer and the employee." My job just cut my hours to 0 for 2 weeks I work fast food so I don't think I get pto
Same but if there’s a slot on your paystub that says pto I believe your entitled to that time off sick of not . My job only allows pto for sick leave
Are you talking about one state or does it apply to all states?

Is this also for California? What if they still have a policy in place?
Thank you for your question. We're a Colorado- and Texas-based firm, and this video applies only to Colorado state law. You'll want to reach out to a California employment law attorney to find out how your state handles unused vacation time.

Do AZ pay out vacation if fired? My job Petsmart let me go and it’s said in handbook they pay out vacation pay long as you been there for a year and I have been there a bit over a year. But last week they sent me a direct deposit payment of 300$ just for the 2 and half days I worked but at termination meeting they told me that my last check will be mailed to me. So far I have not gotten my 60hours of unused vacation pay.
Hi there, we're sorry to hear about what happened. Unfortunately, we're in Colorado, so it's tough to say what the laws are in Arizona. We strongly recommend reaching out to the AZ Bar for a reference. Best of luck to you.
is it legal for employer not give accrued vacation days to their employees in California?
No. It is illegal in California.
how about Ohio?
Hi there, if you have employment law issues in Ohio, we strongly recommend you reach out to an employment law attorney there since their laws will differ from those in Colorado. The Ohio Bar Association is a great resource for locating reputable attorneys. Best of luck to you!
I don't understand how they HAVE to payout something that isn't even required to give to begin with. I have worked plenty of jobs that don't even offer PTO. PTO is 100% a privilege in America
Why you getting all emotional?
Need a tampon buddy your drippin a little from your emotional outburst
paid time off is a benefit offered at a job. It's not handed out, it's earned - you have to work for it.
Why are you so commie triggered? Also, there is no Federal law in USA requiring it. It is a state law.
@@hectort8383termination lose it all 🤣 that mean you don’t earn shh
