    If I’m a postal employee and want to switch crafts can they use my use of fmla as a reason to not accept my craft switch?

    Looking for a lawyer in Portland Oregon for intermittent FMLA.
    I believe my employer and the life works team are purposely and specifically putting burdens in my way to file for FMLA and be covered.

    I work for a security company as a third party contractor to a large corporation. It has come to my attention that my employer lets only certain peple take FMLA, and they notify the day of, usually when they don't want to get held over. There is no paperwork trail to speak of and the shifts are magically deleted and " filled" before the client sees them empty. Any suggestions how to deal with this type of management?

    Hypothetical question. What if an employer does not have a moonlighting policy & HR sends you a letter stating that you cannot have a second, unrelated job or the FMLA agreement is terminated?

    may choose to, or employers may require them to, substitute accrued paid sick, vacation, or personal time for FMLA leave. Substitute means that the paid leave provided by the employer will run concurrently with the unpaid FMLA leave. An employee’s ability
    to substitute accrued paid leave is determined by the terms and conditions of the employer’s normal leave policies. Employers are also required to continue paying the employer’s share of workers’ group health insurance premiums on the same terms as if they were not on leave.”

    I have vacation and sick leave from work.
    Can it be used when taking FMLA for my daughter who has cerebral palsy?

    When can the paternity father leave for
    Flma…Mother is having child in a country 24 hrs by flight and I don’t have Pto/vacation left. Can I request my FLMA time to start on the due date not actual birth date ? I don’t know when it will be so
    Can I start on due date and then notify employer of dob when it happens? Planning months out but need guidance
    Never used flma before.. but I can’t risk or afford ticket on the day of birth

    i got a good one for y'all. An employee work for a call center, If said person has a documented disability that causes them to use the restroom at unforeseen times which could say, cause them to have to disconnect a call abruptly to use the restroom or be away from the phone for an extended amount of time, could they retaliate if you told them AFTER the event occured (example: person 1 disconnected a call and due to high call volume continued to take the calls as he was instructed to do so, didn't tell the supervisor until a couple days later when the supervisor reminded him when asking why the call disconnected, 2 months later this person was given a final warning for this incident and eventually terminated due to it happening again) would this event be considered a retaliation for their FMLA taken leave, which the supervisor never recorded?

    If you are already enrolled in a college and taking classes during non-working hours, then have a medical emergency requiring a FMLA, will you be allowed to stay in school? Can your FLMA be denied because you are attending school?

    Im sorry- but there is NOTHING stopping your employer to make you work during FMLA unless they threaten you. I got this direct from the US Labor Dept. so what’s the point? They aren’t going to threaten but will still push the issue.

    Can your employer force you into taking FMla 2 weeks into an on the job injury and not knowing how serious the injury is two weeks into a workers compensation claim and not even knowing that you were on fmla until a month after

      Check your state laws, and get a psychiatrist on board. You need a doctor to sign off on the paperwork or it's not happening.

    What if a coworker calls out using FMLA obviously faking the issue but your hands are legally tied such as asthma and even walked in said he had a attack on way to work says he is calling out and walks away has only worked 4 weeks this year

    It's amazing how lazy and entitled people have abused the FMLA, it's not for calling in sick

      Agreed this is unfortunately a problem, however there is intermittent leave, and then there is continuous leave. Intermittent leave is where your condition isn't bad enough to require you to not be at work continuously, but you will have days or several in a row where you cannot work affectively. This is typically seen in chronic conditions that will have a random worsening of symptoms, making it much more difficult or impossible to do your job within reason.
