Leaves of Absences in California FMLA, CFRA and ADA

  • There are quite a few laws that govern leaves of absence in California. There is FMLA, expanded 2021 CFRA and the ADA. During this webinar we will talk about the different leaves, how they overlap or don't overlap and what are some best practices that employers can engage in to stay compliant.

    I have CRFA every time I miss work do I have to bring a doctor's note showing proof to them to HR office because I think the certification should be enough they have a copy I'm caring for my brother he has cancer every time I miss work I keep telling him with her medical reason I don't want to give too much information??????

    Does FMLA now cover for pregnancy, it seems like it didn't before based on this presentation. I had understood that it only started covering for a new birth, placement of foster or adopted child.

    Hello, I just came across your video on leaves. I have a question, i have a female employee who just came back from having a baby and was off for 13 weeks. Just to be sure, she still has another 11 weeks available to her for baby bonding correct?

    How often can you go out on medical leave ? I was out for a year from October 2019 to October 2020 with a serious injury and was out once again due to a worker compensation injury for 80 days from late July 2021 to early October 2021 . And (2-7-2022) now I have a serious knee injury that I injured off work and worried if I can get fired for another leave .

      I don’t think so you would be fired for this if it’s a serious health condition…. Please submit the health care providers form and HR team would surely take care of it

    Is CFRA paid leave??? I know FMLA is but I'm running into an issue where I thought I had 12 weeks of paid Baby Bonding time but the EDD rejected my claim to get paid for the last 4 out of 12 weeks.

    Very informative thank you very much. I have one question. When you're explaining with example. He used a total of 14hours of protected leave with 2 weeks of PTO. So there are still 4weeks of FMLA left. can that be used as well if something happens shortly?🙏

      Thank you for your question. In the example with Christopher, he used 12 weeks total of CFRA and 12 weeks total of FMLA. There is no leftover time at the end of all his leaves. Of those 12 weeks of FMLA, 6 ran concurrently with the CFRA as you can see from the overlap on the diagram. By the end of his leave time he would have exhausted all of his available leave once he returned.
