      @@raghavendranaik2877 Parallel Judiciary, Unlimited Power on Revenue claims, which violate human rights on a regular basis. The Act empowers the Body to snatch any land of anybody without any defence from the Executive. File a memorandum to claim a land, it will be theirs! If anybody has an Objection, they should approach a body inside the Waqf board which is constituted by Muslims appointed by Waqf. And it neither works based on affirmative action nor the act is required for arts 25-30. Regulation is not done like this!

      Merits? I'll tell you about demerits. Here in West Bengal people are coming in from Bangladesh, giving our public exams and SOMEHOW getting the jobs and college seats???? Is it fair to me and my family as a taxpayer; seeing Bangladeshis illegally settling over here day in and day out? Not just the CAA, enforcement of NRC is also required.

    Absolutely agree, this gentleman is speaking from the highest level of truth, the highest level of inclusiveness. But for the country we reduce the world inclusiveness to nation inclusiveness since nation is the most practical solution for well being of a large section of the world.       This is a master stroke of BJP, BJP is playing both the muslims and SC. Why?
      If SC rejects CAA on the basis of “all religions have equal rights and should be treated equally”
      Then on the same basis UCC can be enforced in the whole of this country.
      One needs a brain to see the bigger picture. CAA is nothing but a bait.

    Dear M/s India Today. Thank you for Mr Abhinav Chandrachud's speech on CAA. He speaks volumes on secularism. Was the undivided British ruled India divided on secular principles? Are the Islamic Republics of Pakistan and Bangladesh secular? Why and how the non-Muslims of the two have been drastically reduced while the Muslim population of truncated India increased many fold and increasing creating a permanent demographic change in many states? He seems to be some what uncomfortable referring to atheists and agnostics. In a hypothetical question, can he say this in an Islamic country? All the same, I congratulate him being a good speaker.     Ok, if we buy your argument and decide to allow muslims from Pakistan and Bangladesh to take citizenship under CAA then we will have to brought back the land from these two Pakistan and Bangladesh to accommodate them! Because partition was based on Religion and a sizable mass of land from pre independent india was allocated for those muslims! Are you agree with this? See there are many questions in this world which are very difficult to answer! Every Indian should take great care when speaking his or her mind when matter is very important for our Nation!
    Muslims willingly migrated to Erstwhile East Pakistan and west Pakistan as per their own dream of having their own separate country! On the contrary most of the hindus and Sikhs had no choice to leave the land of newly created country Pakistan due to dangerous consequences of communal violence during partition as well as sugar coated promise of Pakistan leaders about protecting religious minority!     Please also explain the pacts signed by Mr. Nehru & Mr. Liyakat Ali and the 2013 parliament records of Mr. Manmohan Singh accepting the need of bringing Hindus & Sikhs from these 3 nations. If Israel can be formed as a Jewish nation, if Pakistan can be formed as Islamic Republic why can't we bring our fellow Dharmic brothers from these extremists nations? Don't always read and refer the laws, please act from heart.
    As per our constitution and the system we choose, we are a democratic & sovereign country. Then what is democracy? Whether anybody accepts or unaccepts, likes or dislikes, the plea/vote/voice of majority is heard, accepted and functions. Now majority of the Indians are with CAA, why can't it be accepted and implemented.... damn hell with the rules of book.
    As per constitution, if every citizen is equal, then why the need of personal laws and muslim waqf board?
    Why common civil code is not being implemented since seven decades.
    The only solution for this problem is to voice out public referendum or public poll. How can a person sitting on a verdict bench decide, let the citizens decide and this is truly democratic.

After so many decades they are getting justice. Even the deadline should not be there. They discriminate minorities by law. Hindus get discriminated in India by law as well.     whether Waqf Act is constitutional, abhinav baba. if tomorrow waqf board issues notice to supreme court for the ownership of land on which the hon'ble supreme court is build. supreme court has no remedy then to appear before waqf board, and waqf board will decide on the basis of representation made by the suprme court. is it consititutional abhinav baba

    That is why the Collegium system must be aboilished. Parivarwad is not existing only in politics. There is ample evidence of nepotism in higher echelons of India's judiciary. The present CJI might not have become even a high court judge had his father not been CJI. His choice of which cases the Supreme Court must hear proves this. He decided that the Supreme Court would hear the petition for legalising same sex marriages. He wasted almost a week of a large number of judges hearing the case which he should have declined to hear in the first place. When he sensed the groundswell in our traditionally Sanatani society against this, he meekly stopped hearing the case. He is fond of interfering in the legislative and executive domains. Only abolition of Collegium system is the answer. If not, this chap will one day head the judiciary because he would be entitled being the son and grandson of ex CJIs.

    Ahh the future CJI of India, indeed. This great collegium system is the reason why people like him get an audience in the first place. So, all this time he kept on recalling Muslims who wanted to come back to India were being hurdled by the permit system, but then he didn't for once mention why the muslims went to Pakistan after all. Muslim league won in muslim majority areas because they wanted a separate dominion and the reason for that was they couldn't live under a Hindu "majority". Now you voted for the two nation ideology and took away around one third of the Indian landmass. When things didn't realise as they wanted them to be in Pakistan, they wanted to come back but the landmass was already gone. INDIA HAD BEEN TORN APART ALREADY.
    So, it's just like saying that you've a two storeyed building. On one floor you live and on the other your uncle lives. Your uncle doesn't want to live with you and creates a "Khilafat", sells his floor to somebody and moves to a different place. After getting to this new place of his choice, he realises it's worse than his earlier place and now wants to live with you on the same floor. And now you're being judged for not taking him in.
    Sorry, the majority of this nation is done with your ideals that gives us a new kashmir every decade.
    As far as this "esteemed" fellow is concerned, we'll take lessons from him on transparency, democracy and inclusiveness when he talks against the collegium system. Judiciary is the most autocratic arm of the Indian democracy. His father said that there are no better alternatives to the collegium system currently (basically, for him, the best system of appointment of judges is to let the judges appoint their sons/daughters/in laws). So, first you get competent enough in your business, then only let's talk history. Stop this judicial over reach, you guys are not that efficient at all to be discussing matters such as this.
    Citizenship comes under the Union List and it is right there for the Parliament to act upon. And the Parliament, by nature of its elections, is the reflection of the democratic tilt of the nation. Everything comes after that.

    "Secular" is a myth in our Indian Constitution, otherwise there wouldn't have been any partition of our country, and Pakistan has declared their country as an Islamic country, and India declared as Secular" country. I very well know , as to how our ancestors bore the brunt of partition and came to India as refugees Hindus in the Indian soil. There was no rehabilitation programme for them. The leaders of our country during that time hardly took notice of refugees from East Pakistan, now Bangladesh.

    The boy is mixing up issues...sounds typically like a "librandu intellectual"... Wish he had carefully considered the historical contexts of the Nehru-Liaquat Pact! Next he'll be asking for the persecuted Uighurs in China to be included in CAA. Bharat is NOT a _dharamshala_ that just about anybody can demand Bharatiya citizenship. At least he should have appreciated that after decades of inaction and apathy, the incumbent govt has vowed to take the matter to its rightful, logical conclusion. Even if there're indeed *other non muslim persecuted minorities in pakistan, Bangladesh and Afghanistan,* their case can be considered at a later date but only after ascertaining that they were indeed the citizens of the undivided Bharat prior to 1947. Choosing 31st Dec, 2014 as cutoff date can't be an issue as any date chosen can be questioned and hue and cry raised over it. Sad to see that such seemingly bright young lads don't apply themselves before expressing their views based on half cooked, part information which is simply out of context of the main historical reference.

      Yes, Bharat is Not a dharmshala. Why allow even the persecuted minorities to become a citizen of India ? Our resources are already finite and accumulated in the hands of few and we are bringing more people and increasing the competition for these resources. Jobs are already less and these people are going to get their own share of reservation under EWS category. Perhaps you are connecting with their religious identity only but despite being a Hindu, I can not connect with them because of their former national identity. They also made their choice to stay in those countries just like majority Muslims did to leave India. The developed world is giving citizenship to the "crème de la crème" of other countries that could bring talent and skill with them and here, India is giving citizenship to extra economic liabilities. It took CJI DY Chandrachud almost 40 years to disown his father's ADM judgment, but with no consequences to the senior judge, for all the human rights violations that were justified by that ruling. Now here comes the grandson talking inanities about the CAA without even knowing that the CAA does not affect Indian citizens at all. I have heard even not-so-erudite Muslim women tell a former high court judge, Kamal Pasha, the same thing, that is the CAA does not affect them, who are Indian citizens. Strictly speaking, the Supreme Court, sitting on a bunch of petitions against the CAA, since at least 2020, has no jurisdiction even to consider these petitions.

Or do you not know that unless until some petitioner or party challenges the said ruling in the court, the Court can not on its own overrule a precedent ? Aur bahut kaam hai Judiciary ke paas re baba. Jab bench ke saamne case aayega tab hi toh overrule hoga. Khaali nahi baithe hote judges ki pending cases ko side me rakh, already decided cases me hi ghuse rahe.
      Also, what consequence to the senior judge are you expecting ? Former CJI had already left for heavenly abode. Plus, law and its understanding evolves. CJI Y V Chandrachud gave his opinion and judgment according to his understanding of law at that point of time and upon the arguments presented to him by the counsel in that case. The understanding of human rights of accused and arrested person have undergone a massive change since then. Just like the law of s3dition, the same SC which had earlier upheld the law of s3dition has now put it in abeyance.

    We all can praise him for his intellect and clarity in thoughts. Nothing wrong. We must also understand that as an educated/well informed and independent lawyer, he has the freedom to express his personal views be it backed by facts or opinions.
    But as a judge you can't express your personal views but must only evaluate the matter based on the facts presented to you by both sides and make a decision sticking to the rule of the law.
    It's simple (not necessarily easy) to give your opinion/argument as a lawyer but it's very complex to give your judgement as a judge. I wish people understand this to prevent themselves from comparing him with his father when the judgement on CAA in the near future goes either way.

    If you argue that under the constitution all should be treated equally, then why should there be opposition for UCC? Secondly the act is to provide citizenship for those that are tormented butchered across the border based on their religious belief. If so, what is wrong in providing citizenship for the tormented? Those who are living in India never faced persecution and attacks and racism. They are living a healthy life.
      Ahmadiya are Muslims, they have 57 countries to choose from where they wanna go.
      Still they are allowed to get Indian citizenship through a regular citizenship portal.

    These lawyers and law students do not realize that not all laws are made in a society by the people now or in the past is fair to all. The laws are made to govern the country in the way the majority (in a democracy) or by the ruler (in kingdom or autocracy) wants. Nobody can guarantee a law to be fair to all. There is no point in fighting in a court about it and debating too much about it except for academic purposes of the law students. Court is not a place to make laws or policies. They are there only to interpret the law made by the people (parliament) and to enforce it. These days, we see courts trying to step outside their boundaries. People through their representatives (parliament) can over-ride any ruling of the court with appropriate majority, including amendment of the constitution, if needed.

    He asks, if a child born in India (child of illegal immigrants), what crime he did to deport him without giving citizenship. Well, in that case, most of the immigration rules in developed countries need to be changed. They simply don’t give citizenship to a child if he/she is born in such country to a parent who is either citizen of that country or who has a form of settled status, such as indefinite leave to remain, at the time of the birth.
    So, the points he argue have contra arguments too. It seems the matter is more complicated than what we think. Hope a fair verdict will be out soon.
    Humans problems will not end till the last human on earth gets eradicated.

      Well if we talk about western countries, then both usa and canada provide citizenship to children born in those countries. And even if we assume for the sake of argument that they dont, why should india follow them? Is india not equal to them? Can it not make any ground making decisions on its own without relying on other countries to do it first? Why cannot we place humans first without making it about religion all the time, especially in the case of children who dont even know a thing about the world around them.

    Since America and dreamers was quoted,
    when ppl enter us on work permits along with their spouse and children and have been in queue for 20 years to get a GC followed by Citizenship. But it takes less time to get asylum and GC followed by citizenship by entering illegally.
    I dont understand the rational in incentivizing acting against the law.

    Next step by the Govt should be judicial reforms.
