Interesting that you were released without charge due to a lack if evidence. Everything relevent happened in the presence of the arresting officer and was filmed. If there wasn't evidence to support a charge, then how can there have been grounds for an arrest in the first place? The arrest was clearly unlawful and possibly retaliatory. You were actually arrested because you declined to stop lawfully filming when he told you not to. He arrested you out of anger and frustration, and with malice.

    • @Aidankiwi
      @Aidankiwi Před 2 lety +24

Technically the one thing they had the authority to do was to instruct the uploader to cease recording while on Derbyshire Police property. While it is publicly accessible, that access is an implied right of access. Any constable or authorised person could lawfully issue an instruction to stop filming.
The correct action the inspector should have taken when the uploader refused to stop recording, would be to revoke his implied right of access. From that moment onward the uploader would be trespassing (a civil matter, not a criminal offence) and the inspector could instruct the uploader to leave the property immediately as he was not there on legitimate police business. If the uploader refused to leave the inspector should then have used minimal force to remove the uploader from the property, only if the uploader then resisted the use of minimal force to remove him from the property would criminal law come into play. In resisting physical removal from any property from which a person has been trespassed, that resistance is an act of aggravated trespass which is a criminal offence.
In this instance that inspector just lost the plot and committed several criminal offences as well as major breaches of the Police Code Of Conduct. I would be pressing for criminal charges to be laid against that inspector and all those who were accessories to the act. A civil case would almost certainly be successful.

@@Aidankiwi You're right in some of what you said, but just to clarify the police inspector has NO authority to instruct him to stop filming, there is simply no legal basis for him to tell him to stop filming. Whether or not he has the right to 'revoke his implied right of access' I am not too sure. I can't find anything in law about 'revoking an implied right of access'. What I can find is the criminal justice act 1972, section 33 which states: “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise. I can find nothing from a legal basis that allows someone to revoke that section of the Act.

Sect 33 of the 1972 act has no relevance. Or the RIPCC "The REALLY Independent Police Complaints Commission"
Aim to get 100k subscriber signatures on a unique petition linked to each police overreach event, requiring it to be debated in the house of commons. That'd really pee them off.
Also, assign an RIPCC incident number to every video uploaded, so that people seeing one event on youtube get to follow a link to RIPCC and comment/support the petitions on the site, .. in order to increase awareness on ALL the events and raise the profile of the site.
Could also subscribe to an event to know when meetings, vigils or protests are taking place - or when key court dates are happening. Organised public support keeps an uncomfortable spotlight on them and makes real action more likely.
Break it down by incident type, force area, dates, outcomes, etc - so it's searchable for general reportage.
Publish a league table of force areas and monthly/annual stats
For each force area, let visitors vote their satisfaction/dissatisfaction across various metrics to properly show areas where they've lost public confidence, or can no longer be said to be policing by consent, and need urgent reform.
Could be a damned good site, if done properly.
If taken seriously, you might even get some legal types looking to make a name by championing the cause. It'd be nice to have some public-minded solicitor or barrister provide time to the cause, give a legal view, or even take on the stronger cases.

If, this is correct then the council must once a year in its annual report, report in that document how much ligation has or is occurring and how much damages where paid. Usually this information is carefully hidden within the report so that people don't pick it up or raise it at council meetings. As it is using ratepayers money to pay for police ligation and thus the council can be sued by ratepayers in a class action for unauthorised use of ratepayers money.

Sad for the guy to lose his life in Police custody. Judging by the Police Officers physical attack on yourself it looks as if they have learned nothing!! God bless the family and friends of the young man. Great audit!

That Inspector is a prime example of why our police force is a laughing stock. He's good at retaining information to pass exams but has zero people/policing skills. What a dribbling melt. Embarassing.

Take full legal action against that inspector and his gang for robbing you, kidnapping you, assault and battery.
He might have had the legal right to ask you to leave the premises. He did NOT have the legal right to attack you, rob you and kidnap you.
You fully deserve a large amount of compensation from them.

What an absolute plonker - When you obviously win your case against this officer - why don't you take a letter to the Police station stating that if the officer comes and hands a cheque over to charity - and makes a public apology to you. The charity (of your choosing) can have the money - or.....you will just keep it for your pain and suffering otherwise.
Because obviously paying out is from the Governments pocket - Not his personal pocket - but it will show remorse if he does make an apology and hands a cheque over.....

Held for 8hrs and 45mins and your belongings given back to you at a later date due to insufficient evidence. This is something you would expect in a 3rd World Country. And they wonder why there is so much animosity felt towards them.

So let me get this straight, the Inspector detains/arrests/assaults outside the Professional Standards building which has signs on the door for the express purpose of advising visitors of their activities. That would suggest that visitors are welcome to come to that place which would certainly assist you in your civil claim. Another is that none of the other Police you came into contact with displayed any actual concern about safety or suggested that you posed a threat to people or property and so the question i would be asking is , what action or circumstance occurred that caused the reaction by the Inspector and the other Police that differed from anything you had done prior to you being confronted by the Inspector? It also displays the utter disregard that they have for Professional Standards...........The fact that they waited for you to drive off indicates harassment, and if they turned off the camera wouldn't that be interfering with evidence...... All the best to you and well done.

You cant let them away with doing that. You MUST put an official complaint in and take them to court. They refused to tell you which act and section you were being detained under, they interfered with your camera equipment, you have a lot of grounds. Audits are pointless unless you hold the misconduct to account.

When it goes to court it should advise what day, what court, what time, what courtroom do the public can turn up and see if the courts are bias against the plaintiff. But I bet that if the court find out this has happened the hearing will be held at another day, a different court, a different courtroom and a different judge as it will be stated for security and safety reason this is necessary. Ah well! Nothing like seeing justice at work.
