Thats legally not stealing, if the employees stamped the receipt and handed you the system thats a legal transaction. Its their responsibility to make sure they got all the money, not yours. (I work retail)

I worked for Toys R Us the year before they went out of business, and I can confirm that stuff like this happened a LOT at the store I worked for.... I don't know that I was ever the employee who gave stuff away, but I definitely saw it happen a few times because my coworkers were dumb

I believe it would vary state to state but since it was actually the employee's fault for not charging him, it's not really stealing. This usually results in the employee getting fired but no legal action from anyone unless they found out you were doing it on purpose and doing it often to sell that stuff. It would be stealing if he didn't attempt to pay for it.
Marumo - I'm not sure if they did it back then but nowadays there are two receipts. One for picking up your pre-order and the other you get after paying for it.
