Equality under the law is the best true north. Everything else is never equal.
However, if the distribution of law is manipulated or judgement corrupted then nothing is equal, and justice impossible.
Lincoln’s wisdom, if this is historically accurate, is sound even today.
Cruelty in justice is never tolerated, even if it is supported by the law, or correct in its jurisdiction.
In all things justice must be metered out with temperance and mercy.
Churchill is one of my favorite historical figures. I agree. He saw things in its entirety and understood before most what was necessary to not just survive but win. His clear message in every speech articulated not only to England but to the world what was necessary, but also the way through.

To be fair, I don't think he should be immune to criticism, though I believe he was indeed a great man. When we as a free people cannot analyze and critique the actions of any leader, past or present, we are in fact not free at all. The only exception I can think of is perhaps for religious leaders, but even then you should be able to question them legally--but it may mean not being part or their congregation, or cult, or compound, or societal institutions, or whatever. Criticism has consequences, but as long as it's based in fact it should still be given as a legal and moral option.

Lincoln has always been met with criticism, most people never bothered to learn more about him. He did what he did, not to free the slaves, but to free/save the country, which means no mater what side you are on, he is going to disappoint you. Back in the late 70s, all sides of this were still being taught. I have no idea what is being taught now, but it definitely sounds like only the side of the teacher is currently being taught. Teachers are people, and they need to be questioned just like everyone else. Critical thinking...

  • @newspin2477
    @newspin2477 Před 12 dny +62

Lincoln's pardon is also the strongest legal precedence for the recent immunity ruling by the Supreme Court. He pardoned everyone who had previously supported the confederate Army, and would even return land, which was seized by the government, so long as that person swore an oath to the United States.
This ruling was challenged by congress, who did not want to return the land, and the Supreme Court ruled in favor of the President's power because the power to pardon is a core power granted by the constitution.
To apply this more broadly - if congress could simply pass a law that would take away power from the president, then you no longer have balance of power in the government. This is why SCOTUS recently ruled that in order to prosecute a president for official acts, you have to justify why those official acts would not diminish the power of the executive branch.
SCOTUS did not grant the president complete immunity; they laid out a groundwork for the hurtle that would have to be overcome to prevent the legislative branch from getting more power than was laid out in the constitution. Congress already has the option to impeach. If they can't impeach and convict, then this doesn't mean they can pass new laws or try to re-interpret laws to take power.
If the people prosecuting Trump can put together an argument under these terms, then they can continue their case. Maybe if they wouldn't have waited until an election year to bring this case or if they would have considered the balance of powers when prosecuting Trump, then they would be in a better position in their case against him. (Or maybe they expected this outcome. Now they can not only criminalize Trump, but they've also given themselves ammunition to use against the conservative judges in the Supreme Court).

And it led to the left INCREASING the investigations and indictments of dissent. Now we are told to fear trump in case he decides to hold them accountable? Too much else to do to bother with much past ensuring the agencies are no longer able to be weaponized against either side

Well said. The court recognized their role as an equal branch of government and they preserved another branch just as the founders intended. However, President can rally a small group of supporters that will go on to put an end to opposition in Congress.
The dead cant speak and remnants would be too terrified to do anything against.
Mandate to rule from the public can be given through total and utter bloodshed on the streets by the hands of militarised police.
      Silence is complience, after all.
Now President can do whatever he pleases.
      This is called a monarchy.
SCOTUS did not specify what is and what is not an official document- now it would take years upon years for lower courts to find all possible solutions to this dilemma.
Right now presidency is going to be a playground for the wealthy and corporations- any and all official acts, however insane and destructive, will be passed to down to be fullfilled.

Reports of Lincoln describe a high-voice with a blend of an Indiana and Kentucky accent, but one thing was certain: his tone, style, and delivery was unusual. Author Harold Holzer, a leading Lincoln scholar, poured through reports to find a consistent audience report as he researched his book, Lincoln at Cooper Union. Holzer says "Lincoln's accent was a blend of Indiana and Kentucky & it is hard to know whether it was more Hoosier or blue grass.” The way he spelled words, such as “inaugural” as “inaugerel,” gives some clue as to how he pronounced them. Despite his twang, Lincoln was “no country bumpkin,” Holzer clarifies.

Logic and Empathy is what yo think necessary. Empathy creates connection and understanding - that’s what’s missing, and logic (to me) is on the other side of that spectrum - where people make truly objective observations and don’t try to sell their interpretations or prejudices as facts.

We must hold onto the principle of equality in front of the law, of allowing the law to determine who is guilty and who isn't. Churchill was able to see the big picture of the course of the 1939-45 war and the growing threat in SE Asia from Communist China, which ultimately came true. The UK troops just wanted to go home after Japan surrendered and not be kept on in uniform and it was this factor that swung the General Election of 1945 away from Churchill's Tory Party to Atlee's Labour Party. This was seen in the USA as an act of betrayal and a move to Socialism which in American eyes equated to communism and prevented an immediate post war loan that was so vital to the UK economy. Fascinating period in both time frames.
