@@RattlePokemon yep :P my first thought was that they know nothing about IP / trademarks in the first place. So many LGS / card sellers infringe trademarks in their names or logos / merch. Even not considering the fact that they put their capacity to earn money at risk with all the TD infringements, they are setting their business (growth) to fail with no brand recognition potential. In a market in which everyone is selling the same stuff at about the same price, for the most part, the 2 differential factors are service/reputation and branding.

The North Carolina couple did not steal anything. Nintendo does not own the rights to "Catch Em." They own the rights to "Gotta Catch 'em AlL!" A company in Delaware owns the rights to "Catch Em." Even though they own the trademark to that phrase, it doesn't mean they can stop another company form using those two words in their title. They can stop a company from only using "Catch Em" as a title.

That's not the name. The name is "Catch Em Collectibles." They registered that business name with the state of North Carolina back in February 2021. It means, among other things, that only they are allowed to conduct business in North Carolina with that name. The couple from South Carolina are not.

As a local it’s really fun watching all this unfold because the NC store owners are CONSTANT drama in the community. This is just the first time they have actually been called out for their BS. Joe snapped at me during a trade night because he offered someone in the store like $30 for their base set unlimited charizard. I paid them $100 for the card and he snapped at me saying I screwed him out of a deal and that I’m stupid and over paid. Then snapped at the other guy for not selling him the card since it was his trade event.
I went to their first card show ever and never stepped foot into that store ever again!!!!! If you are not giving them a hawk tuah hourly you will not be in their circle jerk !!!

Correct. The assigned lawyer already refused the application, citing consumer confusion with the existing nintendo/pokemon trademarks.

@@michaellashock9769 It's not even an issue of trademark. That has to be decided at the federal level. The US Patent and Trademark Office has yet to give their final ruling. What is the issue is who can operate in North Carolina as Catch Em Collectibles. The North Carolina couple registered that Doing Business As (DBA) with the the state in Feb. 2021. One of the things it means is they are the only business that can use that DBA in North Carolina. The South Carolina couple can not.

The NC shop went to that show on a war path to serve that couple. It’s obvious they went to cause drama. They won’t reveal their footage and NC’s story of the events are full of holes and/or they dismiss what they said or yelled. No one cares who sponsors card shows. I don’t think I could tell you the name of any card shop at a card show or Collect-A-Con yesterday or if they sponsored it.

People were accusing him of the break in being fraud wayyyyyyy before all this. He had inventory that wasn’t selling and everyone who frequents there knows it. The only things stolen were those inventory items that weren’t selling. Him mentioning that in regards to this makes him look so guilty! 😂
This non-sense about a “common law trademark” is absolutely hilarious. If you don’t own the underlying IP or have a trademark on the source material, your common law trademark isn’t enforceable or applicable. Did these people pay a dollar store lawyer to just agree with them? They have zero chance of winning anything and if they just go forward will just be wasting money that bankrupts them or closes their business.

1st couple are definitly clowns. I got kids too. I curse too. Not at a kid friendly place other peoples kids are not my kids. I also love how they tried to argue every point you make with "im a man" or "we are truthful people" the second couple or dude specifically definitly seemed to just want atention from this. However id also say i dont care if they sponsored the event or not they should have been kicked out for causing the scene . Sponsors should be held to a HIGHER standard. If you cant run this show without that 1 sponsorship you got bigger problems with your show.
Anytime someone says “being 100% honest” is a HUGE red flag that they are full of shhhhhh. The number of times the NC people reference being truly honest or 100% honest is comical. They don’t own a the trademark, it’s brain dead to think they have standing here. I hope all this ensures TPC/TPCi shuts them both down

They used Catch 'em in their title, but it doesn't infringe on the trademark owned by the Delaware company. Nintendo owns the trademark for "Gotta Catch 'em All!" It doesn't mean it owns the rights to each of the words in that title.

Hilarious these people are worried about intellectual property, these people stole my ebay photos and used them as their own after I basically went from nothing to one of the top 5 pokemon sellers on ebay. They even messaged me a few months before stealing my photos asking me how I could be selling so many items but charging 20-30% more than the other sellers. I made the mistake of telling them it was probably because of my pictures. Them stealing my photos halfed my sales INSTANTLY and ebay would not do anything to protect me because the photos weren't the original photos I uploaded to the listing, I even offered to provide them with unedited copies of the photos proving they were mine and they still would do nothing telling me I had to add a watermark (which was then ruled as "not allowed" soon after). I can tell you that was one of the most frustrating times of my life. Horrible people make me mad, but not quite as mad as hypocrites.

Yeah NC is definitely in the wrong even if they have legal right to hold the name, come with the cops or a court order. Don’t harass people and if the show is the real issue then bring it up to the show operators.
Yeah just like in TV. But in reality, when these things take time and money. Like getting a court order or bringing the cops. Are the cops just waiting around like they do on TV? If they felt their companies interest were at risk, why not try to handle it like real people instead of TV style.
