      @@kirby21-xz4rx That may be true but I do feel like just the whole situation really angered Nintendos legal team. And they have not targeted other emulators “yet” but we will see what happens.
      People said something similar when I said “Nintendo is about to get people with their legal teams”. They said last year “oh Nintendo can’t do anything they’re not gonna do anything”. So I’m not trying to say they’re going to go after other emulators or not. I hope they don’t do that but….we don’t actually know until it happens.
      I wish Nintendo would actually kind of embrace having their games especially their older games on PCs with modern support like people would gladly pay for certain games especially popular games with modern support. I know they want their games to be accessible but now that I have a gaming PC I just wish they could actually be like “hey we can allow people to play our older games like Ocarina of Time or Smash Bros Melee etc. I almost want to write a letter to Nintendo explaining why it would be amazing for them to do something like this but I am not sure it would do any good at all….
      I also feel like if people didn’t emulate the latest Zelda and post it on social media maybe Yuzu would still be around. I just think it’s possible we could’ve avoided all of this.

      Honestly the thing I find funny about his denials is that Nintendo is the most retro game manufacturer atm... So as a retro gamer ofc it comes up he is a Nintendo 'tuber, because they are the bread and butter unless he goes PC only or actually sticks strictly to the oldest Sony consoles, the only real modern options on new systems are locked behind services and poorly announced to keep up his workflow.

      Yeah but if a judge made a ruling in this then anything yuzu has to say was confirmed by all parties not just one or two of them. This was not a forced lie of a statement it was a statement to show you that there are laws in place and picking and choosing laws is not okay even if your first intentions were not bad. Yes it's wrong they ended the emulator for good and yes it should not be blamed for what wrong doing others have done with it, but being a part of stealing money (which they did profit some) means they can be accountable for all the lost money because they made a profit on nintendos loss. Yuzu is the one to blame itself because they were the ones doing illegal activities with their own product and because they own it they have to shut it down. Other people using their product doesn't really matter but if you use your own product for bad they're going to find out

      They lawyered up, and the statement is from the lawyer that doing their job to ensure Yuzu team is safe.
      And Yuzu ain't squeaky clean, from having paid early access to emulator in still supported hardware, to release update for game compability on a game that haven't been officially released yet, to having pirated rom database that shared among dev and Patreon, to attempt to create a paid knock off Nintendo online...
      And all of this is perfectly recorded on their Convo on their discord channel.
      The lawyer simply said, going forward with the lawsuit means Nintendo discover all of these and things will turn from bad to very worse. And they settle.
      Flying to close to the sun. Thank God ryujinx is not that stupid or greedy

      Also, when it comes to "tort" lookalike / anti-consumer lawsuit, there are 2-3 non profits that will likely take on the case cause winning will set a nice precedent and expand the rights of end user

    My personal understanding is that Yuzu did not include (or *publically* develop) any patches/fixes for TOTK until after official release, where they then put into their early access version which was locked behind the patreon. Before the official launch date, no unmodified version of Yuzu could play TOTK, and using Yuzu to run the game required manually installing community-created patches.
    Additionally, there was nothing wrong with their patreon - my only guess was that the size of the patreon is what got Nintendo's attention (legally speaking).
    Why Yuzu would settle so quickly is where I get into conspiracy territory, but my guess was that it was a mix of factors ranging from "We don't want to risk setting a disastrous precedent for all emulators if we lose" to "This just isn't worth our time", but my main suspicion, is that the development of Yuzu itself involved some legitimately shady or outright illegal stuff, and Nintendo had hard evidence to support that, that would've come out should the case had gone to trial, and so rather than risk total and utter reputational destruction along with potential criminal charges, they settled.
    There were a few instances of developers making public statement regarding how/where to obtain pirated copies, etc, so I wouldn't be that surprised if it turned out Nintendo had some more comprehensive examples.
    Additionally, Yuzu is owned by Tropic Haze LLC - the LLC standing for Limited Liability Corporation, meaning (typically) the owners cannot be held personally responsible for business debts and liabilities, meaning the $2.4M fine should just go away if they file for bankruptcy, which is another reason why I think they settled.
    The biggest loss of this whole case is the developers themselves, because really, Yuzu was the best switch emulator on the market, and the lawsuit settlement states that any person, group, entity, contractor, etc. that ever received monetary compensation by Tropic Haze LLC to work on Yuzu is banned from ever touching anything to do with the source code or project. This is also why Citra got caught in the crossfire - because they were receiving monetary support from Yuzu/Tropic Haze LLC in a mutually beneficial aggreement.

    If Yuzu allowed this to be settled in court, a new precedent would have been created. It could have been used against all other emulators. By settling out of court this possible ruling is avoided.

    "piracy can happen on emulation". No it's the main thing that happens. The original court case from 30 years ago was you can make/use an emulator to play your own games you own physically or digitally. 90% of emulation is piracy.

    Usually im always against Nintendo in situations like this. But this time i can kinda understand where Nintendo is coming from. My question is why do we need emulators for current gen hardware? Emulation is supposed to be for platforms that are no longer easily available.

    The Yuzu developers are completely aware that people commit this. Why? Because there are many people caught for doing it on their discord server. They set up a bot to detect it for a reason. So their statements seems like they're suddenly surprised this is happening. If Nintendo had not issued a lawsuit, they would've continued as they always had been. Granted, as most people pointed out, their statements sounds like something Nintendo would say and not the devs themselves.

    9:55 Downloading a Game you own is still Illegal since it is a copy of a Game you do not own. It is the Copy of someone else Game. Each Game is unique. You have to Rip your own Game

      yeah but this is the vision of the law, we can't accept everything the law says, because the law already said many things to be true that was evil, lets not start with Slavery, and many other evil stuff stuff, lets not even touch the horrilble things law allowed, so the LAW is not a good definition of whats right and whats wrong here,
      honestly lets be real honest here, what really change from you copy of the game to mine? the files are the same maybe it change the serial key? yeah? who cares? the stages are the same everything else is the same, if you go to my pc downlaod a game on steam and compare all the files to you game all of then would be the same.
      so i don't agree with the law on this instance, if you paid for the game you already paid for it, theres nothing wrong to download it if you want, and then theres the preservation part,
      many games stop being produced, some games are not officially sold anymore, the older it gets the harder and harder it gets to find to the point it gets to be impossible, so in this case games that are not officialy sold anymore you should have the legal right to download it for preservation purposes, we need preserve art, we need to be able to preserve books, music everything.
      sure the law says is illegal to download a game you already paid for, but the question is is the law right in this case? is it trully any difference from my game to yours other than the serial key? im playing the game to see the serial key btw? or i want play the stages? will the stages change? i don't think so. so no i don't belive law is right here.
      yeah its illegal, but its a law that don't make sense to be honest atleast not for games that are not officialy sold anymore, i can accept this law for games that are still being sold because you can find then and get then, but games that are not sold anymore? nah, we need the right to preserve then.
      i use emulation my self, but if you see my profile on steam, you will see i buy most of my games even on microsoft store, i don't emulate switch games, because the console is still alive i don't think its right to do that, to be honest in my personal opnion emulators should be for consoles that don't are active anymore, a switch is still a active console so i don't agree at all for having emulators for it,
      i use emulators to play SNES/64/gamecube/wii why? because i love mario/donkey kong franchises, i already had the games as a kid i had super mario as a kid, i had dk as a kid, i no see a issue at emulating then. i already paid for the games im emulating for, and if the game is not sold anymore i think u should have the right to download anyway even tho im not really intersted in much other games.
      my ps2 stopped working around in 2015, i used to play a few games like ssx3, god of war and a few others, i still have the Dvd but my compuer don't have a dvd player whats the problem in downloading the games if i paid for then?.
      anyway thats just my opnion on this case.

    That makes sense, maybe the Switch 2 was going to release this year but since the architecture is so similar it got delayed until next year especially since that Migg switch or whatever flash cart got released so maybe they needed more time to work on more encryption measures.

    Another possibility related to the Switch 2 and why Big N may do this now is what if the Switch 2 is NOT backwards compatible and they plan on re-releasing current switch games remastered or reworked for Switch 2.
    Probably less sales of those reissued games if you can just pirate them or play them on PC.

    The situation with Yuzu basically they were profiting from these downloads that is the biggest bowl of contention for Nintendo if they were not caught taking money behind their Patreon then Nintendo probably couldn’t be able to do anything legally But Yuzu shut themselves in the foot by doing that.

    The entire point of releasing an emulator for a current console, still sold at retail, is piracy. We can still get to these games on Switch and so the archival and preservation purposes go out the window. It was absolutely the intent from the beginning, aside from any distribution of roms by their team. Plus, they were making money from it. Morons. Developing the emulator is fine, but they really should have waited until Switch was at least off from store shelves. I think that there would have been much less of a chance of Nintendo going after them if they had done that. Unless Citra was included in the case, they should have kept that up though. That has much more of a use with the 3DS store being shut down and the console long off store shelves. There is a legit reason to use it for preservation now.

      You need a modded switch to dump the keys into the emulator for it to work and need to buy the games to dump the ROMs onto your pc
      So you still to financially support Nintendo either way

    You should probably stop spreading rumors and actually get the facts about the situation.
    Yuzu *INTENTIONALLY* left the software broken and crashing for ToTK while it was leaked early.
    The mod patch was created by the community, Yuzu has never sold or provided mods. Yuzu has NEVER provided ROMs behind the scenes. Everyone knows how to download a damn ROM.

    In my opinion, Yuzu got a bit too much attention for its own good. If I were them I wouldn't have been so thrilled about having videos on them made by huge CZcamsrs like Linus Tech Tips. That kind of spotlight may have been part of what motivated Nintendo to go to the effort. And then of course there was that whole steam deck as that did them no favours either.
    Oh, and as dolphin found out, it's probably best to not try getting onto the big commercial app stores either!

    Yeah, if the next Switch 2's architecture is drastically similar to the Switch's architecture then I can easily see something like what happened with Dolphin happening with Ryujinx and Stratos. For those who don't realise, Dolphin released in 2003 and for the same reason as above, it runs GameCube and Wii.

      No, he said because the experience is so much better on a emulator(he didn't say he pirated the games either), as our lord and savior gabe once said, "Piracy is almost always a service problem", if you provide a equal or better experience than piracy brings, there will be a lot more customers and a lot less pirates pirating the game, so many people that pirate nintendo games prefer to buy games on steam rather than pirate them because steam provides a better service than piracy.

    To be frank, Yuzu shot themselves in the foot with the whole charging people with their early access builds and plus being involved in rom distribution in their own discord server. So they basically screwed themselves over. Funny how they quickly put the blame on their supporters, but yet, the devs themselves are just as to blame as well.

    Very interesting thing is that most repackers that do upload switch games bundle it together with yuzu emulator for ease of use already configured. Could be that this could also cause some issues and be seeable as oh, yuzu together with game and piracy.

      Wrong. UltraHLE was around in 1997. Bleep was around the time of its console marketshare too. Almost no famous emulator surfaces (and works effectively) after the console dies. After the PS3, it's all a different story. But even the DS got emulated well before the 3DS was launched.

    I did not know this until several folks explained it to me.

    That's the point. I would've loved to give Nintendo games another try, since I had an original Switch, but it's not like I'm gonna buy the next Switch just to be stuck in Nintendos shi... ecosystem to be able to play a Mario, Metroid or Zelda title. Considering PS games are coming to Steam now and I have a capable gaming rig plus I ordered an SD OLED today Nintendo can do whatever the heck they want.

We don't readily know how much these Devs were even making from their supporters all these years, but I feel like it was more than what they paid off Nintendo with. 2.4 while they pocket the rest and shut down everything.     If you have not purchased the game on switch you should be no where near Yuzu. I do however feel for those who legit purchase the games and then play the far superior performance wise Yuzu version for their own enjoyment as they are getting the raw end of the deal here. If there was a way to confirm a person paid legit for a copy of the game so they could use Yuzu that would be great but as it stands pirates are the problem here. Stealing is stealing simple as. Its not about Nintendo being a billion dollar company or whatever, its the principle of the matter. You are thought this as a small child FFS. Dont steal. Its not rocket science.

    They should be going for android and Apple users only. The ones that emulate on PC/HANDHELD PC/JAILBROKEN CONSOLES. Have spent the money and time into it. Mobile users (Android/IOS) devices are just starting to come out with "good gaming phones" even if yuzu was decently good at playing some games. By the way "good gaming phones" are ideally meant for pubg mobile/warzone mobile. Etc not emulation.
