People said something similar when I said “Nintendo is about to get people with their legal teams”. They said last year “oh Nintendo can’t do anything they’re not gonna do anything”. Yeah but if a judge made a ruling in this then anything yuzu has to say was confirmed by all parties not just one or two of them. This was not a forced lie of a statement it was a statement to show you that there are laws in place and picking and choosing laws is not okay even if your first intentions were not bad. Yes it's wrong they ended the emulator for good and yes it should not be blamed for what wrong doing others have done with it, but being a part of stealing money (which they did profit some) means they can be accountable for all the lost money because they made a profit on nintendos loss. Yuzu is the one to blame itself because they were the ones doing illegal activities with their own product and because they own it they have to shut it down. Other people using their product doesn't really matter but if you use your own product for bad they're going to find out

And Yuzu ain't squeaky clean, from having paid early access to emulator in still supported hardware, to release update for game compability on a game that haven't been officially released yet, to having pirated rom database that shared among dev and Patreon, to attempt to create a paid knock off Nintendo online... And all of this is perfectly recorded on their Convo on their discord channel. The lawyer simply said, going forward with the lawsuit means Nintendo discover all of these and things will turn from bad to very worse. And they settle. Flying to close to the sun. Thank God ryujinx is not that stupid or greedy

@@504Trey their apology said the took down their codebase. Sounds like it was open source and anyone who had a copy before they shut it down could have forked it and continued distributing.
My personal understanding is that Yuzu did not include (or *publically* develop) any patches/fixes for TOTK until after official release, where they then put into their early access version which was locked behind the patreon. Before the official launch date, no unmodified version of Yuzu could play TOTK, and using Yuzu to run the game required manually installing community-created patches. Additionally, there was nothing wrong with their patreon - my only guess was that the size of the patreon is what got Nintendo's attention (legally speaking). Why Yuzu would settle so quickly is where I get into conspiracy territory, but my guess was that it was a mix of factors ranging from "We don't want to risk setting a disastrous precedent for all emulators if we lose" to "This just isn't worth our time", but my main suspicion, is that the development of Yuzu itself involved some legitimately shady or outright illegal stuff, and Nintendo had hard evidence to support that, that would've come out should the case had gone to trial, and so rather than risk total and utter reputational destruction along with potential criminal charges, they settled. There were a few instances of developers making public statement regarding how/where to obtain pirated copies, etc, so I wouldn't be that surprised if it turned out Nintendo had some more comprehensive examples. Additionally, Yuzu is owned by Tropic Haze LLC - the LLC standing for Limited Liability Corporation, meaning (typically) the owners cannot be held personally responsible for business debts and liabilities, meaning the $2.4M fine should just go away if they file for bankruptcy, which is another reason why I think they settled. The biggest loss of this whole case is the developers themselves, because really, Yuzu was the best switch emulator on the market, and the lawsuit settlement states that any person, group, entity, contractor, etc. that ever received monetary compensation by Tropic Haze LLC to work on Yuzu is banned from ever touching anything to do with the source code or project. This is also why Citra got caught in the crossfire - because they were receiving monetary support from Yuzu/Tropic Haze LLC in a mutually beneficial aggreement.

If Yuzu allowed this to be settled in court, a new precedent would have been created. It could have been used against all other emulators. By settling out of court this possible ruling is avoided.

Usually im always against Nintendo in situations like this. But this time i can kinda understand where Nintendo is coming from. My question is why do we need emulators for current gen hardware? Emulation is supposed to be for platforms that are no longer easily available.
The Yuzu developers are completely aware that people commit this. Why? Because there are many people caught for doing it on their discord server. They set up a bot to detect it for a reason. So their statements seems like they're suddenly surprised this is happening. If Nintendo had not issued a lawsuit, they would've continued as they always had been. Granted, as most people pointed out, their statements sounds like something Nintendo would say and not the devs themselves.

That makes sense, maybe the Switch 2 was going to release this year but since the architecture is so similar it got delayed until next year especially since that Migg switch or whatever flash cart got released so maybe they needed more time to work on more encryption measures.

Another possibility related to the Switch 2 and why Big N may do this now is what if the Switch 2 is NOT backwards compatible and they plan on re-releasing current switch games remastered or reworked for Switch 2. Probably less sales of those reissued games if you can just pirate them or play them on PC.
Jobs protected by product keys being circumvented is cutting the hands off that feed you. Where is the incentive for Nintendo release switch 2 just so it can be hacked 6 months later.

The situation with Yuzu basically they were profiting from these downloads that is the biggest bowl of contention for Nintendo if they were not caught taking money behind their Patreon then Nintendo probably couldn’t be able to do anything legally But Yuzu shut themselves in the foot by doing that.
Like it was stated doesn't matter if you have a case anymore in this day and age because all of your time and money can't compete with the backing of big corporations. Personally it feels like we're getting closer to an oligopoly and the average Joe doesn't have a leg to stand on in the judicial sense when it boils down to sheer time and money.

The entire point of releasing an emulator for a current console, still sold at retail, is piracy. We can still get to these games on Switch and so the archival and preservation purposes go out the window. It was absolutely the intent from the beginning, aside from any distribution of roms by their team. Plus, they were making money from it. Morons. Developing the emulator is fine, but they really should have waited until Switch was at least off from store shelves. I think that there would have been much less of a chance of Nintendo going after them if they had done that. Unless Citra was included in the case, they should have kept that up though. That has much more of a use with the 3DS store being shut down and the console long off store shelves. There is a legit reason to use it for preservation now.
You need a modded switch to dump the keys into the emulator for it to work and need to buy the games to dump the ROMs onto your pc So you still to financially support Nintendo either way

In my opinion, Yuzu got a bit too much attention for its own good. If I were them I wouldn't have been so thrilled about having videos on them made by huge CZcamsrs like Linus Tech Tips. That kind of spotlight may have been part of what motivated Nintendo to go to the effort. And then of course there was that whole steam deck as that did them no favours either. Oh, and as dolphin found out, it's probably best to not try getting onto the big commercial app stores either!
Yeah, if the next Switch 2's architecture is drastically similar to the Switch's architecture then I can easily see something like what happened with Dolphin happening with Ryujinx and Stratos. For those who don't realise, Dolphin released in 2003 and for the same reason as above, it runs GameCube and Wii.

I’ve been thinking another theory after all that is remember Nintendo now own both the 3ds and the switch emulator, they can do what they like with it maybe it’s an useful tool they can use to emulate their games on the next gen switch. To be frank, Yuzu shot themselves in the foot with the whole charging people with their early access builds and plus being involved in rom distribution in their own discord server. So they basically screwed themselves over. Funny how they quickly put the blame on their supporters, but yet, the devs themselves are just as to blame as well.
Very interesting thing is that most repackers that do upload switch games bundle it together with yuzu emulator for ease of use already configured. Could be that this could also cause some issues and be seeable as oh, yuzu together with game and piracy.
Wrong. UltraHLE was around in 1997. Bleep was around the time of its console marketshare too. Almost no famous emulator surfaces (and works effectively) after the console dies. After the PS3, it's all a different story. But even the DS got emulated well before the 3DS was launched.
Pretty sure they (Yuzu) took peoples money via Patreon in order to teach them ultimately how to do this. I did not know this until several folks explained it to me. So given that info I’d imagine that this is why Nintendo did what they did.

I would've loved to give Nintendo games another try, since I had an original Switch, but it's not like I'm gonna buy the next Switch just to be stuck in Nintendos shi... ecosystem to be able to play a Mario, Metroid or Zelda title. Considering PS games are coming to Steam now and I have a capable gaming rig plus I ordered an SD OLED today Nintendo can do whatever the heck they want.

If you have not purchased the game on switch you should be no where near Yuzu. I do however feel for those who legit purchase the games and then play the far superior performance wise Yuzu version for their own enjoyment as they are getting the raw end of the deal here. If there was a way to confirm a person paid legit for a copy of the game so they could use Yuzu that would be great but as it stands pirates are the problem here. Stealing is stealing simple as. They should be going for android and Apple users only. The ones that emulate on PC/HANDHELD PC/JAILBROKEN CONSOLES. Have spent the money and time into it. Mobile users (Android/IOS) devices are just starting to come out with "good gaming phones" even if yuzu was decently good at playing some games. NEVER ASK FOR MONEY WHEN MAKING EMULATORS!
My personal understanding is that Yuzu did not include (or *publically* develop) any patches/fixes for TOTK until after official release, where they then put into their early access version which was locked behind the patreon. Before the official launch date, no unmodified version of Yuzu could play TOTK, and using Yuzu to run the game required manually installing community-created patches.
Additionally, there was nothing wrong with their patreon - my only guess was that the size of the patreon is what got Nintendo's attention (legally speaking).
Why Yuzu would settle so quickly is where I get into conspiracy territory, but my guess was that it was a mix of factors ranging from "We don't want to risk setting a disastrous precedent for all emulators if we lose" to "This just isn't worth our time", but my main suspicion, is that the development of Yuzu itself involved some legitimately shady or outright illegal stuff, and Nintendo had hard evidence to support that, that would've come out should the case had gone to trial, and so rather than risk total and utter reputational destruction along with potential criminal charges, they settled.
There were a few instances of developers making public statement regarding how/where to obtain pirated copies, etc, so I wouldn't be that surprised if it turned out Nintendo had some more comprehensive examples.
Additionally, Yuzu is owned by Tropic Haze LLC - the LLC standing for Limited Liability Corporation, meaning (typically) the owners cannot be held personally responsible for business debts and liabilities, meaning the $2.4M fine should just go away if they file for bankruptcy, which is another reason why I think they settled.
The biggest loss of this whole case is the developers themselves, because really, Yuzu was the best switch emulator on the market, and the lawsuit settlement states that any person, group, entity, contractor, etc. that ever received monetary compensation by Tropic Haze LLC to work on Yuzu is banned from ever touching anything to do with the source code or project. This is also why Citra got caught in the crossfire - because they were receiving monetary support from Yuzu/Tropic Haze LLC in a mutually beneficial aggreement.

If Yuzu allowed this to be settled in court, a new precedent would have been created. It could have been used against all other emulators. By settling out of court this possible ruling is avoided.

The Yuzu developers are completely aware that people commit this. Why? Because there are many people caught for doing it on their discord server. They set up a bot to detect it for a reason. So their statements seems like they're suddenly surprised this is happening. If Nintendo had not issued a lawsuit, they would've continued as they always had been. Granted, as most people pointed out, their statements sounds like something Nintendo would say and not the devs themselves.

That makes sense, maybe the Switch 2 was going to release this year but since the architecture is so similar it got delayed until next year especially since that Migg switch or whatever flash cart got released so maybe they needed more time to work on more encryption measures.

The entire point of releasing an emulator for a current console, still sold at retail, is piracy. We can still get to these games on Switch and so the archival and preservation purposes go out the window. It was absolutely the intent from the beginning, aside from any distribution of roms by their team. Plus, they were making money from it. Morons. Developing the emulator is fine, but they really should have waited until Switch was at least off from store shelves. I think that there would have been much less of a chance of Nintendo going after them if they had done that. Unless Citra was included in the case, they should have kept that up though. That has much more of a use with the 3DS store being shut down and the console long off store shelves. There is a legit reason to use it for preservation now.
Citra made sense considering the 3ds was dying and then the annoucement of the eshop closing it made sense
You need a modded switch to dump the keys into the emulator for it to work and need to buy the games to dump the ROMs onto your pc

The mod patch was created by the community, Yuzu has never sold or provided mods. Yuzu has NEVER provided ROMs behind the scenes. Everyone knows how to download a damn ROM.

In my opinion, Yuzu got a bit too much attention for its own good. If I were them I wouldn't have been so thrilled about having videos on them made by huge CZcamsrs like Linus Tech Tips. That kind of spotlight may have been part of what motivated Nintendo to go to the effort. And then of course there was that whole steam deck as that did them no favours either.
Oh, and as dolphin found out, it's probably best to not try getting onto the big commercial app stores either!

Yeah, if the next Switch 2's architecture is drastically similar to the Switch's architecture then I can easily see something like what happened with Dolphin happening with Ryujinx and Stratos. I’ve been thinking another theory after all that is remember Nintendo now own both the 3ds and the switch emulator, they can do what they like with it maybe it’s an useful tool they can use to emulate their games on the next gen switch. To be frank, Yuzu shot themselves in the foot with the whole charging people with their early access builds and plus being involved in rom distribution in their own discord server. So they basically screwed themselves over. Funny how they quickly put the blame on their supporters, but yet, the devs themselves are just as to blame as well.

Very interesting thing is that most repackers that do upload switch games bundle it together with yuzu emulator for ease of use already configured. Could be that this could also cause some issues and be seeable as oh, yuzu together with game and piracy.

This is pretty much the first time there was emulation for a current gen console on consumer grade hardware.
Wrong. UltraHLE was around in 1997. Bleep was around the time of its console marketshare too. Almost no famous emulator surfaces (and works effectively) after the console dies. After the PS3, it's all a different story. But even the DS got emulated well before the 3DS was launched.
Pretty sure they (Yuzu) took peoples money via Patreon in order to teach them ultimately how to do this.
I did not know this until several folks explained it to me.
So given that info I’d imagine that this is why Nintendo did what they did.

I would've loved to give Nintendo games another try, since I had an original Switch, but it's not like I'm gonna buy the next Switch just to be stuck in Nintendos shi... ecosystem to be able to play a Mario, Metroid or Zelda title. Considering PS games are coming to Steam now and I have a capable gaming rig plus I ordered an SD OLED today Nintendo can do whatever the heck they want.

If you have not purchased the game on switch you should be no where near Yuzu. I do however feel for those who legit purchase the games and then play the far superior performance wise Yuzu version for their own enjoyment as they are getting the raw end of the deal here. If there was a way to confirm a person paid legit for a copy of the game so they could use Yuzu that would be great but as it stands pirates are the problem here. Stealing is stealing simple as. They should be going for android and Apple users only. The ones that emulate on PC/HANDHELD PC/JAILBROKEN CONSOLES. Have spent the money and time into it. Mobile users (Android/IOS) devices are just starting to come out with "good gaming phones" even if yuzu was decently good at playing some games. I’ve always believed if you sell a system and games for it. I will buy it and buy the games but if you no longer support that system and no longer sell me those games what difference does it make? Would you rather we give random people double triple sometimes 10 times more than MSRP to play those games
Nintendo is also in the business of reselling their old games. Don’t want to pay for it? Don’t buy it. Why do consumers feel entitled to play all games? As if current gens don’t have enough games to play as is.
People saying that emulation is done even 10% of the time as an alternative way to play games they legally own instead of piracy is full of crap.
