  • Justice Mukeshkumar Rasikbhai Shah is perhaps one of the very few judges of the Supreme Court who witnessed the top court or entered one of its courtrooms only after being elevated as a Judge of the apex court.
    Justice Shah who demits office tomorrow, has authored close to 712 judgments, making him the judge who has delivered the highest number of verdicts in their limited tenure.
    However Justice Shah in this freewheeling interview with Bar & Bench’s Debayan Roy speaks on why he thinks heated exchanges in courtrooms are often a deliberate act on part of a counsel to achieve an oblique motive, to how there has been no deliberate delay on part of the government to clear judges names.

    Collegium System adopted by Supreme Court must be scrapped now without further delay by Modi Govt!!! Let these Judges comes through competition and not through Collegium System!!!

    There is a need to make changes in the Indian legal system in that the Supreme Court judges should have a security of tenour and they should not be compelled to retire when they reach a certain age. The reason is that it is difficult to replace such experienced judges like Justice MR Shah.

    A judge can be known by the judgements he delivers, not by the ways he speaks,nd philosophy he shows on media.
    Sometimes the judgements given by such polite judges out of prejudice affects the life of many innocents.
    And keeps on affecting when their judgements are used as citations.

    Politicians are appointed by people, IAS are appointed after completing exam and interview. How are judges appointed? Are they clearing any entrance exams for judge-ship?

      Judges are appointed base on multi-recommendation by the bench....sometime the bar also involved .. Recommendation are base on the merit of condidates who are practicing in the courts of these judges.

    He appears more a theocratic judge.what is required of a good judge is reading, knowledge of law and jurisprudence. He needs empathy , compassion sense of fairness , justice and passion for truth. People don't have faith in judicial system whe it take 15 to 20 years for conviction or exoneration. The justice system has no social balance, the system is dominated by manuvads.

    Bail will be granted according to perception where the law gone so according to judge the law can be change while bail hearing or equating someone

    collegium system is the best process to achieve the soul purpose of Article 50 of the Indian constitution. separation of power is the ideal thing that our constitution has given to achieve the faith of the people. and as Consultation mentioned in Art. 124 has to be read as Concurrence.

      Collegium system is one of many sources of corruption country is facing. I means SC literally become a chacha bhatija court without even iota of responsibility for the common man who actually feed these mfs.

    God forbid, how did he write the judgments through all the years in SC 😮😮. he speaks aloud of disposal rates, his judgements speaks of dictatorial tendencies supporting high handedness of state against common man.

    If there was no collegium, then Congress would have made Rahul Gandhi as judge, and BJP would have made Jay Shah as Cheif Justice.
    I accept that collegium is not perfect, but those who know the history of judiciary should not speak against it.

      Appointment of judges are not the basis of merit but recommendation that'reason not just behind this poor English but also poor judgment delivered by various judge.

And English not being his native language he can be forgiven his Indian accent .As far as recommendation and judgement of cases are concerned, that is subjective ..everybody has their own point of view and no one Point of. View is correct

    Sir why are you making a common man fool? Everyone knows you are doing nothing for the common man. Not a signal common can afford SC advocates, you are biased towards money 🤑 people as you not allow common man.
    Give me a single judgement which you pass for the common man (Don't tell it's affect the common man 😂 show me petition added by common man and you listen to him)
