    In a 33-minute interview to Karan Thapar for The Wire, Dushyant Dave said Justice Chandrachud as Chief Justice of India must follow the example of Justice P. D. Desai, a former Chief Justice of the Himachal Pradesh, Calcutta and Bombay High Courts. Mr. Dave said Justice Desai “didn’t give a damn about the executive”. As Chief Justice of India that is the example Justice Chandrachud should follow. This point was made when comments made by Justice Chandrachud in his P. D. Desai Memorial Lecture in February 2020 on dissent as “a safety valve of democracy” were being discussed.

    Three cheers for this extraordinary interview on the eve of Justice Chandrachud assuming the office of CJI for a two year tenure. A most objective assessment of the future of the Institution of Judiciary in India in the short term prompting optimism and hope in its revival from the disturbingly low level it has reached during the recent past. Thank you, Mr. Dave for a brilliantly structured analysis with alarming frankness. And thank you, Karan for your masterly handled interaction with your illustrious and highly respected guest, Sri Dushyant Dave.
    We have confidence that the Indian Judiciary will be in good, safe hands of a highly capable CJI when we needed it most.

    Brilliant discussion. Dushyant Dave is the foremost lawyer protecting human rights and democratic principles and constitutional rights, facing threat from Modi regime.     Justice Chandrachud gave judgements in respect of IPC Sections 377 and 497,which are of distinct orientation. The way bail application of Arnav Goswami was heard in a tearing hurry with the lofty ideas speaks in itself. SC has become pro-establishment. The trend is irreversible. This govt. will not give any moment to heave a sigh of relief by adopting various means.

    Mr Dave is spot-on on Justice Chandrachud. Most, if not all, judges are totally divorced from the reality on the ground. His prompt availability to the Arnab Goswami case, his granting an extension to Jay Shah despite a previous judge denying such extensions, smack of fear of the executive or something not quite right in the judgment handed down, esp given the circumstances surrounding our lives today.

    Among recent CJs it was Justice. U. U. Lalit who turned out to be a welcome surprise. He doesn't have an aura of a liberal judge. But he constituted multiple constitution benches to take up sensitive matters which were languishing for years. It was a great loss to our country that his tenure is only 77 days

    From what I heard from Dhave's evaluation of Justice Chandrachud's performance, I tend to be skeptical about his role as CJI where he has to stand up to the Executive. Except for one case ie Mohammed Zubair's Acquittal, all other pivotal cases which mattered to India's democratic interest, he has failed. Therefore, Zubair's case is a flash in the pan and future of the highest court's independence leaves no room for hope.

    Justice Chandrasud should revisit 2002 Gujarat riots and best backery case and should consider the report of Supreme court appointed Raju Ramachandran where the currupt RK Raghavans view giving clear chit and and should be punished who were involved. He should also investigate Justice Loya suspicious manner he was died. He should take the Election Commission where the EC contention that they burnt the VVIP pad. The justice should survive the 2024 general election as the people have lost faith in EC and revisit the Election Law where Modi go away all constitution and fixed time till the expires his term from party in which he was elected and those person should not allowed to contest from another party for nearly 10 years as present govt purchased MLAS AND MPS are purchased from opposition parties with the currupt money and also bring the PMCARE FUND AND ELECTROAL BOND under GAG audit

    Why judges should be afraid of powerful executive? Are they not protected by the constitution of the India? One thing I noticed in the new incumbent CJI is he lacks consistency. One day he gives landmark judgement rising the bars and on another day he delivers a lackluster judgement.

    It was a very honest and brilliantly articulated discussion between 2 highly qualified veterans of Law.
    It was the exact reflection of the same thoughts and fears and apprehensions, that each Indian is currently going through.
    It is almost more than 3 months since Justice Chandrachood has taken the highest position in our Judiciary.
    As a person from Kerala, I was expecting him to give immediate attention to the high profile Lavalin Bribery case of Pinarai Vijayan, the Chief Minister of Kerala, which has dramatically and deliberately been dragging for more than 25 years and which has been shamefully postponed more than 32 times, during these 25 years.
    Pinarai is even involved in smuggling gold bars through the Diplomatic Cargo of a Foreign Consulate.
    The NIA and the ED seem to have pushed these cases under the Carpet, because of the Governmental pressure from the Central Executive, as Pinarai is very much the blue-eyed boy of Modi.
    It appears that Justice Chandrachood has already succumbed to the pressure of the Prime Minister ; this case is therefore likely to drag on for another 10 years, depending on Modi’s tenure.
    It appears that we are not going to see any positive change or progress with our Judiciary ; it appears that it is the same old wine in a new jar.

    Another great interview regarding judicial integrity under the present circumstances. Being highly intelligent, well educated, well informed, and a highly regarded legal authority does not mean that a jurist will always deliver a just verdict. This is the reason verdicts delivered by eminent jurists are critically evaluated and reevaluated the world over for their pros and cons. Advocate Dave has very succinctly and objectively analyzed the judicial record of justice Chandrachud.

    One of the most constructive assessment of Chief Justice designate Dr. Justice D.Y Chandrachud I've ever seen. Albeit his ineffectiveness in politically sensitive matters as put forth by Mr. Dave, I presume my belief that after commencing his tenure as the Chief Justice(an office of tremendous responsibility and duty), Justice Chandrachud will exercise his powers as a true custodian of constitutionalism judiciously by making the executive accountable and thereby reinforcing the vibrant democracy. Moreover, his dissenting opinions in highly illiberal judgements of the Supreme Court like Elgar Parishad, Aadhar Act, Hadiya etc where he disagreed with the majority decision to truly uphold fundamental rights as enshrined in the Constitution. Even as the Chief Justice, I believe in Justice Chandrachud's intellectual prowess as it is...

    Mr.Dave has brilliantly, courageously called a spade Spade.
    It appears CJI Designate is great Judge except when top executive in picture. For a layman viewer like me it appears top executive may be knowing some secret about him and won't be hesitant to use it. Hope CJI Designate will rise above it and prove me wrong.

    Dushyant Dave is saying that the Ayodhya judgment was erroneous by justice Chandrachud which means that the bench caved in to the pressures from the saffron government and gave the judgment which went not against hindus or Muslims but against the secularism and unity of the country. Also Dave is absolutely right when he says every single mandir masjid case should be thrown out of the window and never reopened again. This country needs Jobs, economic revival, strengthening of the rupee, the lowering of the costs of petrol, diesal, gas and other basic commodities used by the common man for everyday consumption. All these rebuilding of temples and other sites is not going to help the majority of the poor sections of this country who have been struggling for the last few years surviving with a hand to mouth existence.

    Hope this CJI doesn't bend down to the Executive and for the sake of democracy takes up the issue of payment to political parties through opaque bonds and counting of all ballot papers alongside counting of votes through EVMs. Under such rapid success of Electronics, computing and related fields it becomes doubtful to many that fully transparent system of voting is being adopted

    I completely agree.. the smiles that I saw on Mr Chandrachud face after his ascension to CJI just showed 'I me myself'.. there was no maturity in that smile.. sad but the stark reality..
