    i got awarded 70 percent last month. i was just really honest with my counselor and told her what my life was like because of my condition and when i went to the c and p i was honest too. everything just fell into place. i am also retired with 21 years of service.

      You might want to apply for TDIU. If you're 70 percent in one dissabillity and can't keep gainful employment then you quallify

    I told them all those things you just talked about, in my re-evaluation in 2018, basically saying that I suffered from all those things, but since I was on medication, and was in therapy. (I honestly missed more therapy and hardly took my meds) The VA wanted to bump me from 50% down to 30% and I had to fight to keep my 50% rating. I even told them that I had flash backs when driving and would switch to combat mode even when home and they just chalked it up to regular road rage.

    when I served in the Marines, I served 4 years on active duty and was deployed to two separate countries.
    I was in Field Artillery which is Big large heavy Cannons/ Howitzers I saw many very dangerous situations
    I had more than one instance where I felt I was going to lose my life and I have bad dreams about those things I suffer from Anxiety as well as anger I went through a divorce and have had flare-ups at work with certain co-workers who have got me in a heated state I am for sure hypervigilant and afraid of leaving my car anywhere and etc..
    I've asked the VA for help and I am hoping they are going to give me the help I need I am not doing that well but I keep trying each day to hang on and not to give up. I loved the Marines but it took a toll on me.
    I am service connected for bilateral hearing Loss my hearing and equilibrium is really messed up. I'm doing my best but I for sure need some help. thanks for your video.

    I greatly appreciate this video. This was so eye opening. As a spouse of a vet I just wasn’t sure what in the world is going on. Thinking it was something I was always doing, but when trying to ask my husband he’d just clam up. This has really let me know some avenues I can take to help my husband. He’ll more than likely buck at the information, but this really tells me a lot of what is going on, and what I can hopefully do to help him, and our family. I’ve stuck it out for a few decades so I’ll just keep pushing through to get him the help he needs. Thank you so much.

    I’m so nervous and anxious. I have my PTSD c&p exam tomorrow afternoon. I have all those symptoms. I was stabbed by a fellow servicemember and have a huge scar on my forearm that reminds me of it everyday. I pray I get this rating.

    I'm currently at 50% for PTSD with a combined total of 70%. I know my rating should be higher based on this video! I will definitley put a new claim for an increase and talk to my doctor on documenting all of the things I told him for more evidence! This is a serious health issue with my life and what i'm going through!

    I was awarded a 30% rating for PTSD in 2016. I just had my C and P exam yesterday. I really needed more time with the doctor. I seen her look at the time and after that she started rushing me through the questions. I was all messed up. Too many questions way too fast. Not happy with how it went. Haven’t been able to relax today. I don’t feel things went good for me because I was rushed. Now I’m waiting to see what happens.

    So im appealing a ptsd 30% rate because im doing worse since that rate and they never took into account my civilian psychologist records. Currently, i will be going to a C&P exam in a couple of weeks even though my civilian doc sent in all her records AND did a DBQ. Why would they send me to a C&P exam with all the info and DBQ sent in?

    I need help having trouble explaining my symptoms to a c and p examiner and continue to get low balled in my rating. Combat veteran as infantryman in the USMC DIAGNOSED with ptsd several months after I got back from Afghan and still can’t get the proper rating. Also have other things rated as low as 0 %

      That is one of the most frustrating parts of this process is getting the C&P examiner to understand how bad your symptoms are and that translating into a proper rating.     I was at 70 but recently reduced to 50%. I check all the boxes for 70% except for my job. I've kept it for going on 8 years. I read meters, I work alone and as long as my routes are read I don't ever hear from my supervisor. I literally couldn't do anything else but apparently this is good reason yo be reduced

    How do you guys charge? Is it a one time fee or is it taken from the VA benefits payments?

      Hi Michael, we work on contingency so we only get paid if we are able to get you a lump sum of back pay on an appeal. We charge 20% contingency of the lump sum. Everything else month to month is yours 100%.

    Question! For anyone that can answer. If I submit my DBQ (from seeing my Doctor) to the VA. And the VA keep schedule me appointments to see their (contracted) Doctor. Do I have to make those appointments even though I turned my DBQ into them?

    They mixed my c&p with another veteran and gave me depression 50%. They put someone else's story in my medical report when I looked on myhealthyvet. I should be 70% ptsd. I'm gonna keep fighting I'm at 90% pushing for 100% P&T

    If someone has a 70% static mental health condition that finally starts to improve with medication, will the VA re-evaluate or potentially reduce based off of this improvement, even though it is considered static and has been in effect for 7 years?

      If a condition is not yet permanent they can bring you in for an evaluation at any time. Usually after 7 years that would be rare. If they consider a reduction they would have to first send you a proposal of reduction and give you an opportunity to provide counter evidence prior to them implementing any reduction.

    I just won my appeal after six years, I thought for sure I was gonna get denied again.
    I had to take a early retirement due to my PTSD, so I'm currently on social security disability.
    I have no idea what my rating will be as of yet because I just won my case the other day.

      I took my case all the way to the veterans appeal court and was able to state my case.
      I think what helped me was getting a Nexus letter.
      I also was able to get a letter from my platoon sgt verifying my story.
      I continue to seek treatment from VA, it's been a long road.

    Is a reevaluation at some point guaranteed if the disability is not coded as permanent? I am at 70% ptsd and not considered permanent..

      Hi Michael, thank you for your question. It isn't a guarantee... nothing really is a guarantee with the VA. Generally the VA will reevaluate within 3-5 years after initial grant but after 5 years the regulations indicate the VA should not reexamine. Also if the veteran is over the age of 55 they should not reexamine.

      im in the same boat. been 70 % ptsd for 3 years in october. i guess any time after that i could be reevaluated because im not permanent. i cant stop thinking about it. i feel that i have not gotten better. i dont take medication or go to therapy. i dont know i guess i will cross that brige when i get to it.

    I got 50% for ptsd 7 yrs ago. I got denied my skknn condition tho auto immune conditions that I believe I got with anthrax. I want to fight this again cause I am still having health issues and I want to bring up my ptsd can you help or someone.

I would recommend working with a Veteran Service Officer which you can find at www.nacvso.org.     So I have a question, if you get a single rating of 100% for MH, does that automatically make you IU? I've heard because in order to get 100%, you are considering socially and occupational impaired

      No, you can't be 100% and also get IU. IU is a way to get you paid at the 100% level if your overall isn't 100% but you are unable to maintain gainful employment. Hope that helps!

    Can you report a C&P examiner for neglecting to put information that you clearly stated, during the C&P exam ?
    I just got back a 50% PTSD rating, because due to her findings, I did not have -
    suicidal ideations [which I do] obsessional rituals [which I do] illogical speech [which I do] continuous panic attacks [which I do] impaired impulse control [which I do] spatial orientation [which I do] neglect of personal hygiene [which I do] etc.
    I have bad memory, so my girlfriend had to be the one to read the rating and she recalled the conversation with my examiner, as she was there. That’s what refreshed my memory.
    Nevertheless, please let me know if I can get a copy of the C&P exam video and how to report the examiner. Thank you, for all these educational videos.

      Hi Carlos, we recommend you submitting a VA form 4138 Statement in Support of Claim outlining the issues you see with the exam. You can submit one as well as your girlfriend. This will make it part of your claims file record. You can submit it with a supplemental claim as new evidence in appealing the 50% rating.     In 2010, I had to provide SIRs, statements, and psychologists statements and received 30% for PTSD. Then years after anyone could say whatever and get 70%+, I guess combat PTSD isn't such an issue, I already hated going to a shrink and after losing my marriage, several jobs, nearly my home and my vehicle repossessed which I got back. If you have PTSD or similar, it's difficult to talk to anyone at least for me.

      Yes, thank you someone who falls into the same category as myself. I am a combat veteran, had the provide SIRs, statements and combat awards. I got 30% in 2010,now people just say it and get rated higher.

    My VA Psych put a disclaimer in my file to prevent me from being able to use my diagnosis for filing a claim:
    **The listed diagnosis is based solely on the veteran's self-report of symptoms. The clinical assessment that led to this diagnosis did not include any measure of potential response bias, a review of the veteran's claims file, or a review of other collateral sources. The assessment results and diagnosis documented in this note is for treatment purposes only and should not be used to make legal decisions, such as VA Compensation and Pension determinations.**
    Can they do this??!? I literally can't file a claim bc of it.
    I've spoken with multiple other veterans who are service-connected mental health and none of them have ever seen or heard of this happening. Also spoken with multiple VSOs, they too have never seen or heard of this.

      I think it completely depends on where you're at in the process and in the country. There are good VSOs in many places and if you're reopening your claim I would recommend working with a VSO locally. If you're needing to appeal a decision, then of course we would be happy to review your case and see if we can help you. If we can't we can surely point you in the right direction.

      @@Veteranslaw Thank you, I just filed for GERD & Migraines as a secondary to PTSD. I file for lower back pain from time in service, I also applied for TDIU. I have a C&P this month for my secondary conditions. Depending on how everything goes I may or may not need your help.

    I've got three folders filled with packets and papers on suicide and depression, with everything I can relate to highlighted, and can't even get one single person to read one of them, I also haven't taken a shower in five months, nor washed my clothes, nor shaved, and I haven't washed my bedding in over two years.
    You think I can get 70%?
    Nah, I can't even get anybody to talk to me, much less go to bat for me.

    I explained all of that and still only got 50 percent. I think that my doctor did not understand and thats why there should only be American doctors and not foreign doctors who dont have an understanding for such things

    I was awarded 30% the end of last year. I feel that is way too low. If I appeal would my current girlfriend be allowed to attend the C&P with me? I ask because after discussing my last C&P with her she pointed out there was so much I missed bringing up, such as frequent job changes because I refuse to put up with their BS, frequent relationship changes for the same reason, she says I lose my shit while driving if someone does something I don't like (drive slow in the passing lane), my drinking has increased immensely, and SI. I have a lot of pride so telling a stranger that I am a weak failure and I suck at life is not something I can do.
