    Alas this policeman's anger boils over towards the end. Another nasty piece of work giving decent police a bad name. He lies, section 43s me and sits in his car looking through my phone and refuses to give his name even when he is satisfied i am not working for B Laden, does not wear his mask when in my face, gets butt hurt and and aggressively trespasses me from the police grounds dragging Oscar by his lead to get us off the grounds. Would not like to be his missus when he gets home. Notice how he mocks those that are on benefits and those who only have a small house! Unprofessional and abusing powers all because he could not have my name. Saving grace was the lovely WPC who treat me very well and had a lovely chat with me while PC pervy was trying to find those pics of my wife on my phone!
    Sort it out Lancs police it only goes this way because you have police with over inflated ego's, it could of been so different!

      In fairness, I understand why they would want to speak to him. Filming vehicles is odd under those circumstances and we pay the police to speak to people who may be acting out of the ordinary. But the whole attitude and the way they speak to him is just terrible. They are aggressive, harassing, bullying, don't know the law, spout cliches, and the list goes on. The British police are awful. In this clip, they commit offences against this man: assault, battery, a Public Order offence, false imprisonment, wrongful arrest. It is really quite awful to watch.
      The second bearded officer left me astonished. It's clearly inappropriate for a police officer to speak to a member of the public like that, whatever the circumstances.

      Yes he was nearly crying when he found no grounds to arrest the auditor from the look of hs face. I bet a searcrh of this pairs records' would bring up heaps of misconduct. And after witnessing their abuse and threats I would not want them within half a mile of my children, elderly relatives, other vulnerable groups or pets. They are a danger to the public imo!

He had no suspicion of terrorism, he already adjudged you as a youtuber. He did not like what you were doing, so he used the act, illegally.

      Police stations aren't restricted like military bases for police stations you can legally film the outside that you can see from a public place. You can't film inside without consent though because of issues with data protection (other people getting arrested or reporting crimes)

      @Gavin Lisle no, not quite. Trespassing is a civil matter not a legal one, except for MOD, railways and a few places owned by the Crown. Police station car parks aren't restricted anymore than any other public service like hospital car parks. Every police station I've been too you can drive into and have visitors parking spaces.
      They asked his details because they thought his actions were suspicious not because filming in the car park itself was illegal. In none of the videos has he been charged for filming in the car park nor have any of the videos been taken down by police for 'illegal filming'. If a specific law exists that bans filming in their car parks they would have used this law to get his details and not used section 43. They had to because there's no specific law against what he was doing.
      The park of the car park he was in wasn't fenced off, you can see when he was leaving that he walked between the bushes straight onto the path.
      I do agree that they abused the terrorism act to obtain his details. I don't believe for a second that they thought that he was a terrorist. I do how think that they believed he could be a thief and wanted his details in case one of the cars was broken into later.
      Public place includes areas where the public generally have access too. You can drive into and park (specific bays) in police station car parks. You can't do this on MOD land.

    That cop said at the end that he knows you have been going to other stations, and lists them. If he knows that, he also knows that you have not been charged with section 43 following investigations previously. So him using that again and telling you he knows about you is proof that you are being targeted for harassment due to who you are.

      The only way to stop police harassihg you is to stand up and make them accountable. Unfortunatel they pick on the vulnerable or those they percieve to be in a loewer social racket than them; which is discrimination and profiling whichever way you look at it. They would not have the nerve to pick on the wealthier in society because they know they weill have to face the full force of the law for their 'mistakes'. On the clock they are not at liberty to address the public in such a derogatory manner or articulate their assumptions of his economic state etc. As they know nothing about this man who may even be disabled it implies they think he is a layabout, a scrounger, a criminal or less of a citizen in their opinion. They are quick to say if he swore in public his voice would carry but have no compunction in slandering this man where their voices may also carry. When you encounter police like this you either say nothing or turn everything they say back on them.

    Police Code of Conduct requires officers to identify themselves on request, when engaging with the public, by stating their name, collar number and their base station. To invoke Sect 43 of the Terrorism Act the apprehending officer must have reasonable grounds to suspect the individual is engaged or intends to engage in terrorist activity. In conducting a search under Sect 43 (including intellectual property on a smart phone) the officer must state before the search what he or she is specifically looking for. If the officer cannot cite what he or she is looking for they cannot lawfully search you under sect 43. Not only would you have a case for a civil suit for unlawful detainment and assault, there are also grounds for a criminal complaint under Section 26 of the 2015 Criminal Justice & Courts Act. This covers improper exercising of the powers of a constable and carries a maximum penalty of 14 years imprisonment, though in this case would be more likely to result in a fine (and a career ending conviction).
    The only area where this plank of an officer was within the law was where he trespassed the cameraman from the property. A Police Station may be publicly funded, but it is not technically a public place. As a serving officer PC Out of control ego, was within his rights to revoke his implied right of access as the cameraman was not on the grounds of the police station to engage in any kind of business with the force. Everything else he did was unlawful - I would contact Crimebodge and ask him about a private prosecution under sect 26.
    If the cameraman had stated he wished to make a formal complaint in person at the moment that PC Ego had trespassed him, then PC Ego could not have enforced it as the cameraman would have been entering the property on legitimate business. A police force cannot trespass any member of the public from a station if they are seeking to engage with the service.

    You need to state very clearly that it is completely legal to film anything you can see from public property, including police stations, police cars, police and ANYTHING else. Then tell them you do not need to give your details unless you have broken the law. Photography CANNOT be used as suspicion under section 43. They CANNOT look at your phone unless you are arrested or they have a court order.

      Number and station are all that is required for a Sec 43 stop.
      Sec 1 PACE, Sec 23 MDA etc require name, badge and station to be provided, but sec 43 and 47a stops are governed by a different Code of Practice, with different provisions.

    Fair play to you I'm impressed how you keep calm with some of these. Looking forward to hearing about some of these idiots getting sacked. You should do a follow up on some of these where you take highlights of the interactions and follow up on the complaints you make regarding the conduct and the responses you get. I'm surprised that the police complaints authorities aren't all over stuff like this

      They can't. They want his details to put in their system whereby they can track him, his home and his car. they will track where he shops, eats and worships. With over 6 million CCTV cameras and 11k ANPR cameras that submit 50 million reads a day, they actually can follow you when you leave home and return at night.

      I think that when we get abused under the colour of law by police we need to make citizen arrests and call 999 for back up to detain them and transport the to the station. Until we are in crime we have the same authority as they do and can make a citizens arrest for any indictable offence. Abuse under the colour of law carries a prison term so when the strp out of line in this way we should be arresting them! Just listening to their insults snfd threats was quite enough for me and if cops ever treated me like that I would certainly use my authority.

    And the moment he said... “ been to Kendal etc, to film only to get a reaction”... the search become unlawful, as he expressly stated he knew EXACTLY what you were doing and it was nothing to do with terrorism. But he searched you under s43 of the Terrorism Act! Bingo - sue.
    And as stated many times, the Police Code clearly states there MUST be prior national intelligence on the individual indicating “terrorism”. So the search was uncouth, violent, illegal, immoral and professionally unethical. What an ignorant clown, he brakes the law, meanwhile others don’t.

      Where in the police code does it state there must be "prior intelligence" to ONLY justify a section 43 search?
      Whilst I'm nlt defending this officer what you've said is incorrect, there needs to be reasonable grounds to suspect terrorism to justify a 43 search but that doesn't mean only prior national intelligence counts.
