- The plaintiff and his wife say they moved into his grandmother’s home after she passed away, as did the defendant, his aunt. They say she’s trying to force them to move, even calling the police 23 times and falsely accusing them of poisoning her, so they’re suing. The defendant says the plaintiffs put toilet water in her food, which put her in the hospital for weeks. She’s countersuing for defamation and emotional distress.

I work in hospice care and I have run into these plenty of times. People have burned their bridges to the point that no one want to help them.

Shame on you. I'm an RN, and I see elder abuse often occur amongst relatives. The defendant is elderly and appears to have some cognitive dissonance issues that frequently accompany aging. The plaintiffs had no legal standing to move into the house. Instead, they took advantage of an elderly family member by free-loading off of her. Pathetic.

My aunt tried to kick my grandma out of her own apartment until the judge basically put the fear of god in my aunt and told her to GTFO or she’ll be arrested (this was in the early 90s before squatters rights.) years later, even after the humiliating incident of being forced to leave a home that wasn’t hers and getting boxed upside her head by my own mom, my aunt is still a selfish, no good, moron who has the IQ of a goldfish and she still hasn’t learned a thing. It still makes me grind my teeth when I think about it because according to my mom, my grandmother did everything for her children and family and she was a loved and respected woman. The aunt is the one who should have bought them to court. Who moves from Texas (one of the cheapest places to live) to California (the most expensive place to live). The old lady is about to lose the little mind she got left with these strange grown folks living in her house for FREE!
First, how do you know they living there for free? Her name may not be on the deed. My sister has the same first, middle and last name as her mom. When her mom died she claimed the house was solely hers because her name was on the deed. Her brother and sister took her to court and she had to sell the house. As for her paying bills she said she pays the mortgage but what about the utilities, taxes, insurance, food and upkeep of the property. Big girl doesn't look like she missing any meals and that SSI check and $23 a month food stamps can only get you but so far especially when diabetic meds cost a arm and a leg especially in California.
The aunt took a mortgage out on the house as the nephew stated it was a family house the aunt went down to county and paid for the deed and got everything turned solely in her name! I highly doubt they was staying there for free! Are y’all listening to hear or just to respond? The man clearly said when they moved in she didn’t have a deed! So the aunt had to get sole heirs to the family home! This happens when the family don’t wanna deal with the upkeep of the home or the taxes the aunt had the funds and switched over to her!

The defendant may be a handful but the house belongs to her. It's not clear why she hasn't gone through the proper channels to have the plaintiffs evicted if she has the deed and the mortgage. It seems like the plaintiff moved from Texas back to California because he thought his grandmother's house became family property after her death and that he and his wife could live there rent and mortgage free. The defendant should stop calling the police on the plaintiffs and call whoever handles legal evictions if she's got the papers to prove it's her house. She may not have a likeable personality, but I think she needs help getting squatters (the plaintiffs) out of her house.

Judge Mathis missed what's really going on. The Aunt wants those two out. They obviously have arguments that attract neighborhood attention as well as inside the home and auntie has no idea the correct way of getting rid of them. She instead fabricates a story to damage them enough for them to leave. Probably from bad advise of neighbors and relatives. Auntie did lie but the other two are basically squatters. I have seen and dealt with families of this dynamic and it is sad when the correct questions are never asked.

For real property, please make sure it is formally in writing or make sure the person you want to inherit your home is on the deed. For instance, I have older siblings that moved to North Carolina with our father 1974 because they wanted to. They did not want to live with our mother in New York nor the house mom owned. When I turned 18 yrs. old, I went to work and helped my mother finish her mortgage a few years later. In 2018, my father dies in North Carolina. My siblings that grew up with him sent me paperwork(June2020) to sign off my interest of his numerous properties and land in North Carolina for free. I signed it because I never lived in North Carolina. Now, my mother dies and the Children that grew up in North Carolina contact me that they inherited an interest in mom's one house in New York and want to get paid some money to give up their interest. So make sure your paperwork is legally tight to prevent very bad people without souls from coming after you die seeking money and did nothing to deserve it.
