Self-defense incidents can turn deadly in the blink of an eye. I now have a felony and a possibility of a 5 years prison sentence for using my firearm in self defense.
Also keep in mind the state and prosecutors and police will do everything in there power to make you the aggressor.

@@USCCAOfficial I just saw a commercial from your organization talking about how you do not have the right to open carry in Florida you absolutely do just like you had the right to conceal carry anywhere in any single state it is your right as a person to bear armaments armaments was a term to describe cannons back in the day which were the most powerful military equipment that they had so in translation from what the Constitution says every single person has the right to the best military equipment including nuclear weapons! The Constitution is the supreme law of the land any law that comes in conflict with the Constitution is to be treated as null and void! Also the Constitution is treated like a contract and when it comes to contract wall the person that did not create the contract or write up the contract has all discrepancies in their favor! The Constitution said nothing about having to conceal or open carry it just says you have the right to bear arms that means in every single way shape and form including every single piece of land in America including Banks and schools! A lot of people do not know their legal rights you do not try to fight anything in the lower courts... the people who win win on appeal. In other words if you have money then you can win if you don't then screw you peon!
I already respected Colion as an intelligent, level-headed, and knowledgeable commentator, but to see him humbled by the experience makes me admire him all the more

We need this to show how the law is gonna try and screw you for trying to defend yourself in your everyday life. "We have to determine when there's a deadly threat!" Ummm, they weren't taking her to tickle her, and the first guy already killed someone!

As a newer gun owner, I really think we need more of this. Imagining a scenario is not the same as really seeing all the different moving parts of it and all the different ways it can go wrong for you. Thank you.
Yeah right, it is really hard in such situations to do the right thing. I mean critical thinking stops for most people at this moment, when a gun is drawn all you think is to survive, so you have to train your self to process those situations even by only watching videos. Having a gun is one thing but using it is the other and training is probably arround 90%. I life in Germany and here it is even harder as a gun owner, i cannot carry a gun but i can defend my home but even in that cases where someone is breaking into your home you have to think about thousands of possible scenarios. But yeah if i am really 100% sure that my life or the life of someone i love is in danger i would shoot.

This was awesome. Staged or not, that is closer than most people will be to a violent scenario like this. It was cool to hear Colion's thought process and see how he reacted knowing how well trained he is. His indication of how there is a lot more out of your control than you think, even with all the training is definitely eye opening.

That 2nd scenario, never draw from the drop, which Colion never did and showed excellent restraint. He waited for the perfect opportunity. Love this video, very educational. More please.
But he telegraphed that he had a gun. Why wouldn't the robber take Colion's gun ?
Yes and no. He at one point reacted by reaching for his firearm but hesitated, indicating to the robber that he had a gun. The robber could've easily shot and killed him. So in that regard Colin made the mistake which could've cost him his life. Never draw from the drop, wait for your opportunity. Sometimes there is no window of opportunity and you have to comply.

I stopped video at 5 min 15 sec to say, most gun laws are made to do just this! make any one with a firearm not want to use it even if you are morally right, not to use it at all! The use of force with a firearm is so narrow to use it legally and the timing in which you are lawfully permitted is just absurd! I believe this to be by design. In short most gun laws are made to do 1 thing to a law abiding citizen, make them a felon in order to take away their constitutional right to bear arms!

It's all about balance. We want people to be able to defend themselves if they *have to*, but we don't want people running around committing extrajudicial killings. Thus, we end up with strict, narrow circumstances where lethal force is justified.
Most jobs tell their employees who carry not to do anything about a robber or someone trying to hurt someone which is basically saying hey if you or anyone else gets hurts oh well. I think that's just corporate bs and why wouldn't that be a form of negligence on the company's part?
There should be absolutely no duty to flee. If someone shoots someone committing a crime with a gun, fair game.
Having reviewed many hours of YT videos as part of preparation for a variety of possible self/3rd party defense scenarios, this video is, in my mind, hands (and guns) down the best of the best.
Watching Colion as he interacted with perps and bystanders in a very real world setting, with all of its unavoidable messiness and multiple moving parts, was very instructive.
The opportunity to review each scenario in the presence of an articulate prosecutor & defense attorney is priceless.
If Colion, as a respected, practiced and knowledgeable 2A advocate, can gain new perspective from this, the impact this has on the average viewer interested in legal defense is that much greater.
Bravo on a great presentation. Please consider making this a regular USCCA series!

The important thing to take away from this is he shot eight times and Miss six. As far as Target isolation is that the bathroom behind that thin little wall he just shot through six times?
First scenario: Utah is a stand-your-ground state, meaning there is no duty to retreat. So just because the GF made it out the door doesn't mean Colion gave up his right to self defense, or defense of another.
It depends in other states how you articulate. We’re you covering your GF, hoping to escape but things turned deadly too fast? Is your state where you can use deadly force to protect someone you don’t know? There was 4 innocents (assumed) in room yet. Cheater, blue shirt guy behind Colion, Colion, and employee. It might be enough that you were joining with cheater to stop robber without using deadly force. But robber drew, was threat. But some states that’s not going to fly well. So don’t go into details. Run things past Lawyer before details to the Police.

I don’t see it as fun like playing a video game. Its real life scenario which is frightening to think to be in. I don’t like the thought of having to kill someone but more importantly, I don’t want to be shot, lamed or killed from not having to incapacitate the perp trying to harm or kill me. Its stressful looking at it from all angles.

We truly want to see and hear more realistic training scenarios like this, especially the most common types. There is always something for us to learn from them and remember.
Second scenario: Correct, never draw from the drop. Feign compliance until there is the opportunity for a surreptitious draw. Well done by Colion.
2 attorneys were part of this demo, (Colion Noir and Tom Grieve) and neither one commented that Colion should not have answered the question about how many shots he fired. That's the point of the legal coverage offered by USCCA: Inform the police in the most raw and short sentences that you needed to defend your life against criminal deadly assault. Period. Then inform them that you will cooperate once you speak to your attorney who would coach you about NOT trapping yourself with specific questions like how many shots were fired. Neither attorney saw that; they were too intent on showing Colion the mistake he made without pointing out how to correct it. Kevin representing USCCA should have also caught that.
This was a FILMED staged event, which it's main purpose was to inform us: the viewers.
Of course in real life you're not going to say how many shots you fired, if you fired shots, or what your name is because as soon as the "authorities" show up, you STFU until YOUR attorney shows up.
But that's what this video, HOPEFULLY, made everyone understand by proving that after a low stress (can you imagine a high stress) fatal situation where you shot some one up, YOU DON'T KNOW WHAT THE F YOU ARE TALKING ABOUT, so that's why you/me/everyone needs to STFU until your attorney gets there.
Remember, LEO gets 72HRS!!! of rest time after a shooting to get "their story" straight for this reason.

Are you serious? That was literally the first thing they mentioned. Kevin asked Colion how many times he fired. Colion answered "3", but he really fired 8 times. Then Kevin talked about answering questions like that without an attorney.
@@rick467 they could have articulated it better by saying to use your 5th correctly and not give a statement outside of “I feared for my life or the life of others and would like my attorney before answering any further questions.”

It would be really informative to see a random off duty Leo go thru a couple of these with the critique. Seeing the reaction/decision making and then talking it out is a powerful learning tool.

Be real. A LEO has qualified immunity. How many bullets did they put in that unarmed man? 60? As a civilian they are going to criticize you for a shot in that back because he's still up and moving. He can turn around and shoot and you have to wait until he does that. A cop has no such restriction.
Civilians and LEOS are scrutinized different ...LEOS have the duty to act...civilians can escape if they choose.
@@1stinlaw917 LEO's have absolutely no duty to act. Yeh supreme has ruled on that at least twice. Categorically they do not have to protect you under any circumstances unless you are in their custody.
I was a victim in an armed robbery and I can totally relate to Colion's helplessness/anger/frustration emotion. You're so angry but there's nothing you can do. I was unarmed at the time. Maybe for that specific instance, it was a good thing. They only took wallets and jewelry and then left. While they were using guns to intimidate people, it might be argued that they didn't pose a deadly threat. Fortunately it all worked out. No one was hurt and the criminals were later caught.
Interesting note: When the investigator asked me to describe the gun the bad guy pointed at me, I told him the man was holding a howitzer. Because when your on the wrong end of a gun, your eyes get wide and all you see it that barrel.
Don't forget all the social media to create a character... which the prosecutor may use for or against. In the case of Colion, an anti gun prosecutor may say he trained his whole life to get in a gun fight with someone... overall this was an excellent scenario and video breakdown.

The best live scenario I've seen to date! Glad I'm a uscca member & am able to watch and support informative videos like this. Colion much props for being a part of this video. The 2and scenario seemed put your mind in a real defensive moment because of the suddenness & being 2 criminals not 1.
What this scenario taught me is that prosecutors are almost as evil as the shooters.

Those were two great scenarios. I've trained with those guns in shoot houses before. A lot different than hitting paper at the range. It's great training to be put in a stressful situation. Everyone reacts differently. Keep the great videos coming!
When the prosecution loses their case against Colion, they should go to jail too, for trying to protect criminals on some B.S. technicalities.

I watched this video earlier on Colion Noir’s channel and right after the video I went and signed me & my wife up for USCCA.
I can’t express how much I truly hope I never have to use my firearm in self defense or the defense of others. That is why we carry. For the possibility. But man I really hope I never have to. I hope to prove right all those people who say “ you don’t need a gun, you’ll never be in a situation where you need to use one”
I feel the same way. BUT: I wouldn’t hesitate for a second if I felt my life, or a loved one was in a life, or death situation. As a police officer would say: “ I was in fear for my life “, and do what was necessary to protect myself.
I carried for 5 years hoping I wouldn’t have to use it until the day came unexpectedly when I had to. Even though I was justified it still haunts me every day knowing that it could happen again.
What about red light incidents and road rage? I had someone follow my neighbor home over a driving incident and he was getting violent and angry. I was just a neighbor. We live in the country. It's like little cottages on a river. So there's a few neighbors. We all watch out for each other. very rare anything happens. But from time time we'll have a small incident.
But I feel like road rage and red lights are getting deadly. What about people coming up to your car. Like a few people. Gangs are real.
2nd scenario taught me another lesson....keep your wallet in the opposite pocket of your concealed piece (for me this will me hard to adapt) but what if they would have seen his firearm when he went for his wallet?
Scenario 1: Who drew his weapon first? If they guy that was having an argument with his GF/wife did, and the "bad guy" drew in self defense, then Colin may have fired on a guy that was just defending himself. Even though the "bad guy" was commiting a crime.
Senerio 2: I think he did the best he could in the scenario. Great job

But isn't "self-defense" ruled out if your act of committing a crime is the underlying cause of the situation?
Basically, you go in and are committing a robbery. You cannot, then, claim self-defense if someone draws a gun on you. They would not have drawn, if you weren't committing a crime to begin with.
Also, the simple fact that you were in possession of a gun, during the commission of a crime, means it was a deadly-force incident on your part.
@@MSgt_D Did you watch the video? They went over that. Basically the robber has the right to self defence because he was not a threat to anyone's life until the other customer drew a gun on him. He was making verbal demands and escalated to yelling first, you cant shoot someone for verbal threats. This was an interesting scenario because its lose lose, Colion was in the wrong place at the wrong time. Colion either shoots the robber who is acting in self defence and is tried as a murderer or he shoots the other customer in defence of the robber and is either shot by the robber or maybe tried as an accomplice in the robbery.

I live in Texas. I am NOT a lawyer. Under the Texas penal code, using deadly force in "self-defense" is not justified if the person using deadly force is in the act of committing a crime greater than a Class 3 Misdemeanor.
In this scenario, the person was committing a 1st Degree Felony; i.e., an aggravated robbery.....a robbery while exhibiting a deadly weapon.
Further, a person is justified in using deadly force: when and to the degree the actor reasonably believes the deadly force is immediately necessary: to prevent the other's imminent commission of aggravated robbery.
A person is justified in using deadly force against another to protect a third person if: the actor reasonably believes that his intervention is immediately necessary to protect the third person.
@@MSgt_D Interesting, it makes sense that things would work that way in Texas. Here in Colorado we have more restrictions on when we can and cant use force and criminals have more protection.
If a person in Colion's position was disabled and "leaving" was not an option, hos much would the merits change?
@LuisB: As a disabled person myself, you pose a valid and thoughtful question. As someone also retired from working in criminal law (defense), my thoughts or response would be as follows:
- As a disabled person (specifically with mobility limitations as in your question), the person using, or demonstrating capability to use deadly force would still have his/her actions evaluated by the imminent, deadly threat standard and the “rational, reasonable person” response in viewing the defender’s actions. The disabled person must still demonstrate that at the time he/she employed lethal force it was legally justified by virtue of imminent threat of death or great bodily harm to the defender or a third party. And his/her actions in using deadly force must have been reasonable. (I.e.: bad guy is laying face down after 1-2 rounds, but defender mag. dumps the attacker. A DA or Grand Jury panel is likely to view shots 1 and 2 as reasonable (assuming deadly threat), but discharge of rounds 3-15 as UNreasonable, possibly leading to changes. The disabled status of the defender is part of the totality of circumstances review, which should be done. Obviously a mobility limited, disabled person cannot flee in the same manner as an able bodied individual, and this should be taken into account. It’s not a justification for an otherwise unreasonable use-of-force, but it’s also a factor limiting the disabled person’s/defender’s options, and may mitigate toward a finding that the use-of-force was justified. That’s all just my opinion, based upon the laws in my state and my experiences. Others may disagree and each use-of-force incident, whether LE or civilian should be investigated independently and without bias (in a perfect world anyway). Be well.

The prosecutor will not overlook the fact that Colion was wearing a USCCA shirt, a potential clue that Colion was eager to fight, shoot and then defend himself with a "Lawyer in a Box". Takeaway: Don't wear 2nd Amendment shirts, i.e."Protected by John Moses Browning", etc. When carrying concealed wear a Dad or Mom sweatshirt and no 2nd Amendment hats or bumper stickers, etc. Prosecutors get re-elected on percentage of won cases. They DO NOT honor your 1st Amendment right to wear a 2nd Amendment T-shirt, they will use it as evidence of propensity to kill.
Full Disclosure: I'm not a lawyer, I'm a USCCA card carrying Dad.
Just the fact that this video has to be made and law abiding gun owners need to get insurance like USCCA shows the system is unjust and a joke.
These role play scenarios are helpful to my mental training. Even though I am not going thru it myself, they help me consider different factors I may run in to so I can think how to respond before the situation arises. Don't know how I'll react until it happens, these help prepare as much as I can.
Good training. Anyone who has been in an encounter with lethal weapons or even a fist fight knows that memory is tricky. We are so focused on certain tactics or opponents that we lose track of other events occurring. Then add adrenalin.
USCCA, please make more live scenario videos like this one. It was cool to see Colion Noir's reaction in these scenarios. Maybe you should look into seeing if other popular CZcamsrs such as Hickok 45 or Massad Ayoob, ect. would want to be put through scenarios as well.
Use the police defense that has resulted in no charges: I feared for my life. Now, why can't it be that simple for common citizens?

I agree. I have a theory it’s because as a job cops deal with shootings all the time, and have been working with the judicial system for decades. They’ve had time to give themselves a buffer to be able to not overthink deadly situations and react.
Who knows tho. It sucks for us civilians.
It IS that simple for common citizens. That is the requirement for deadly force for citizens as well. Reasonable fear that your life was in grave and immediate danger.

I took a full day 8hr Simunition Scenario training taught by ret LE and it was by far the best training I've received. You never get second chances in real life. So valuable.

The question we have to ask our prosecutors is … when will criminals stop being protected class of citizens!!! First scenario was absolutely a deadly force encounter until the bad guy leaves… I think we as a society need to be much much harder on the prosecutes to stop abusing their roles to gain political points!

One thing needs to be pointed out for home self defense situations: I've seen people with signs like: "TRESPASSERS WILL BE SHOT -- SURVIVORS WILL BE SHOT AGAIN". If you ever need to shoot somebody in self defense, that sort of sign will never help your case... it can only hurt you.
Everyone in the coffee shop needs to decide if they are willing to rely on the bad guy's mercy to not kill them.
Once someone draws a weapon and is acting aggressively, that is the decision you need to make.
Smh this is why world we live in courts are more gravitated to theatrics and cater to the criminal smh

Really cool training. I have to say that these random scenarios really make you look at your areas and spaces you enter on daily basis and see them more differently. Personally I look for corners that's a little hidden but I still have a good view of the room. If I can't get where I want then I want to at least have a good view of the door. Not always able too but I try. I remember the story of how wild Bill Hickok was shot in the back.

This was great so much to learn from this. Would you guys mind doing another training scenario but this time have the good guy carry without one in the chamber. That way we can see the draw backs of that.
I'm watching this for the first time and it's been a year later! I actually conduct similar training as an armed officer in the state of Texas. It's really interesting that we as "law abiding citizens", have to justify our ability to defend ourselves and others, while witnessing a crime or felony. It's been a very real check to me and the other officers I work with on our approach, demeanor, and conduct even when the aggressive situation has been placed on us! Thanks for this video and I would love to see more!
This is worth saying since they already talked about how important to count your shots accurately but it's also important skill for a skilled gunfighter because not knowing when you're out of bullets will get you killed!!

I was thinking the same thing but this one specifically i think did a great job in presenting the trainee with a truly unexpected scenario that they had to react to in real time.
Although it may feel staged, the adrenaline and muscle memory are very real (which is what tends to get in the way in these incidents). Notice Colion reaching for a non existent mag reload at 1:46. His body thought it was real and that's the most important part I'd say. two cents.
Great scenarios. Yes, more please. Also, using Colion Noir was an added bonus for me. I watch all his videos and he is the voice of so many.

I keep my head on a swivel and constantly run scenarios in my head in different situations but running them in your head doesn’t compare to this type of training. I would love to do this training course! Training and preparedness is key to survival!!
The problem with running scenarios in your head is, you create a script.
Then when something happens that doesn't follow the script, it takes a second to adjust.

I really like these real life scenarios. It really makes you think. Plus the guy who was answering for what he did, did a wonderful job explaining what was going through his head and how hard it is to do the right thing.
I had to pull out recently in self defense. Of course the "bad couple" falsely testified & I was locked up. Costing me thousands; while they laughed as they drove away.

It used to be that most reasonable people (jurors) intrinsically knew right from wrong. Nowadays you’ve got to account for every breath you take in order to defeat the popular bias that the defender is the bad guy and the perp is the victims.
What a world of madness we live in. I say that 80% of our population is literally not sane, if you define sanity as the ability to think and process rationally.

I haven’t listened to your answer yet but my answer is when a person fears on immediate danger that would result in harm to themselves or their loved ones, or their abode. This could include a stranger if you are certain the person in danger is the good guy.
For me personally the point I would be in danger might be before someone else would be. I am female, in my 60s, overweight, with bad knees and a heart condition, so running very far at all is not a valid option for me.
As a long time gun owner, I believe to possess sufficient training and I am aware of my 'level of 'skill' with handling, [accuracy and safety].
I've had dreams of "what if" and "how I would react if" **imagine a situation where I chose to stop the threat of imminent danger to my partner...
I actually broke out into tears after hearing Colion's recount of his thoughts and emotions..... I cried really hard
I'm 63 yrs old and treasure, respect, and train to 'deserve' owning my hand guns. BUT truly in my heart hope I never have to experience play possum or save my partner's [or appropriately any other person] life. Thank you for a Frightening refresher of what my Dad instilled in me 50 yrs ago when I first fired a weapon. "Fire your weapon at someone and the danger might stop...but for you everything has just begun".

My main thought on the "shooting in the back" issue is that as a soldier, I recognize that tactical repositioning to better cover and/or concealment is a smart tactic. The "bad guy" was still mobile and still armed, and therefore not down or out of the fight. For all Colion knew, even if he had recognized the guy had turned his back, the baddie could be repositioning to cover and a more tactically advantageous position with intent to re-engage.
THat's where my tactical mind goes, so as long as he is still armed and mobile, he has NOT IN ANY WAY been neutralized as a threat.
If he had dropped his gun and run, 100% different story.
I think it's important to note that as the perp was retreating with his back turned, he still had the gun muzzle pointed towards the self defender.
Very well thought out and very well done. It was very interesting and informative. Yes a gun in hand is a very effective tool but the most powerful tool you have is your mind because the ability to process what is happening and be able to make a split second judgement call is what it boils down to. I got so many chills in the 2nd scenario when colion hopped up and defend his lady and closed the distance between himself and perp. It was so well done! When it comes to human reaction so much can happen especially with adrenaline going.

This was, hands down, the best educational video I've seen in the gun community!!!!!!! I watch a hand full of gun community CZcams channels, and found this to be even better than the cc video break downs. This would be a very helpful series with different guests from the gun community, like Donut Operator as a former officer, or Matt from demoRanch as a private citizen gun enthusiast , just to see the different mind set when caught is these scenarios. Colion was awesome as usual !! I wish there was a place that used scenarios like these for training. I can't express what a great idea this was Kevin

That second scenario proved his athletic shooting in the first 4 seasons of Noir was useful practice.
This is excellent to help you see and feel what can happen versus what should happen.
I was trained under the USMC manual that states one of the six justifiable uses of deadly force is to prevent or interrupt serious offenses against others. Regardless of the intent for taking the woman with them, it can be reasonably assumed to have been a serious threat to her person.
That demonstration was absolutely awesome and on-point!! Thanks to all three of you for that!
Please more videos like this, its nice to see all sides of the legal argument and what a defensive scenario could turn out to be down the line
I have also come to the realization that you can't just shut the brain down and react - you MUST keep thinking!
Love this i would love to actually do this type of training. But honestly it doesn't matter as much where you shoot someone it's why you shot someone. An the shot to the back in the first scenerio can actually be very well explained.
It doesn't work that way...the criminals are protected more than the citizens.
I would love to have some training like this. I have always had the mindset that I know exactly what I would do. Realistically, there are sooooo many things going on and its happening fast. These are life ending decisions, whether it's a death or life in prison. I loved this video and will be reaching out in my community to see if there are classes like this for the wife an I. Thanks for the video.

Our ROE in my time in combat was "Do not fire unless fired upon". We were highly traind in the use of deadly force. Why do civilians have a lower standard in the use of deadly force?
I really miss these they bring a lot of the training to real life scenarios . stops you and makes you think about it and how would i have done it. Thank you all for this.
I love this vedio . I wish I could take classes that have this sort of training. It's so much more realistic . I believe this sort of training would really make people get a better understanding of the reality of it.

I am a member of USCCA with great training and I am confident if I have to use my weapon in self-defense and have a legal team to back me up.
The world NEEDS more of this style training and awareness. And putting “needs” in all caps doesn’t do it justice.

In the second scenario, i see you’re anxiously engaging the scene expecting something to pop off.
I don’t want to go thru life constantly on guard waiting for a gun fight.
I agree with the attorneys assessment on the question of using deadly force shooting the guy in the back when there was no gun trained on him.
I love these types of training scenarios. They need to have more of these training workshops that are recorded and then after evaluated by a attorney giving a critique as a defense lawyer and prosecutor. And someone else to articulate scenarios.
Yes, want more of these, helps to pin the conversation with a fresh example. However, it is crazy when an aggressor poses a public risk involving the loss of life, ..... and a person has to defend their actions to neutralize a threat to life.
The mental gymnastics lawyers have to go threw, to defend someone who has 0 disregard for human life, arguing the shooter should be able to defend themselves while in the same breath saying the guy in the coffee shop should be charged for shooting some who brandished their firearm at multiple people.
The sad part is that criminals have more rights. We have to be more worried about the law that the criminal.
If somebody breaks into your house, I’m pretty sure they didn’t tell anyone where they were going to be that night so if they disappear it’s fine.
