  • The plaintiff rented a house from the defendant and claims he kicked her out with no warning and she still doesn’t know why. A year later, she’s suing him for her unreturned security deposit. The defendant claims the plaintiff terminated the lease on her own and left behind a messy apartment with hot pink walls. He’s refusing to refund her deposit.

      ONLY because the defendant didn’t send the letter saying why he was keeping her deposit. If he did that then she would have lost. Since she owed back rent, all he had to do was say that was why he was keeping her deposit in writing

      Surprisingly, this is the way many people live their lives. I have a small biz, and I've had accountants thank me at year end when I bring all my receipts for taxes. There are apparently quite a few who make "guesstimates" on what they spent.
      Many people live their lives through gossip and hearsay. Look at all the Internet doctors on Facebook, posting stupid and dangerous crap about the virus! You ask where the hell they found it, and they really can't answer. A lot of people don't know the difference between gossip and a medical journal, or Wiki and scholarly evidence. There are people who think Wiki and Snopes are definitive sources, or their postal worker/neighour/mechanic said it, so it must be true.

      That's what I thought. Neither one of them had proof of anything. Plaintiff didn't even have proof that she paid a deposit in the first place, or proof that she paid any rent at all.
      Whole thing should have been dismissed.

    I've been renting this apartment for about 3 years. I've always done cash. I always get a receipt. Theres been a month or 2 in 3 years they forgotten. To give me a receipt. When I remember I leave a note and always get the receipt. Always keep receipts.

      You could still have trouble, depending upon the receipt info (Is there a stamp-not writing-from the company?). They could say that you made up the receipt yourself. Why not pay by money order for your own safety? Simple.

Hell in my place where i rent, they accept money orders, personal checks or you can pay at the office with your debit or credit card, Or we can pay the rent online. The only thing my manager never accepts is cash. Plus when you use all those methods besides cash, it will be on your bank statment to show in the description where the withdrawal went to.

      I didn't rent long but the place I did rent everything was in writing. If I did repairs in the apartment, I got money off my rent my landlord gave me something in writing, I pay rent I got a receipt. Anything concerning the tennent/landlord relationship, all of it was documented in writing. It makes things a whole lot easier if there's any disagreement. If he didn't have time to do it right away, with in a day or 2 he'd stick it in my mailbox but never was it more than 3 days later I had something in writing. It was agreed on from day one and he's the one who brought it up first.

    I don’t believe for a second she doesn’t know why they asked her to leave!
    She’s a liar.
    Because let’s say that’s true, that would’ve been a major case for harassment; they can’t just harass someone to leave arbitrarily, for no reason, because that’s a major lawsuit. And knowing her, if that was true, I’m sure she would’ve pursued it.

      Just because something that can be deemed as a major lawsuit does not mean that someone will follow through with it. There can be many reasons for a person not taking someone to court: lack of information or resources, other obligations, fear.

      It’s actually weird the property accepts cash, maybe it’s a Florida thing, but I haven’t lived where a landloard accepts cash, either check, money order or card, which automatically guarantees a receipt.

      Agreed. I used to read tarot cards for pocket money, but I went through the process of having a legit business in my state, and I used one of those receipt books to keep track of what I made. Made it so easy when it was tax time.

      I don't think it would even make it to the court. I'm sure you have to submit some type of supporting documentation to even be approved to be seen before a judge.

    Landlords always want to keep the deposit....just know that going in so take a video of the conditions of the property both before and after moving out. They must send you a detailed itemization for any monies they keep within two weeks of moving out or they have to return it all.

    I never understand how people pay major transactions in cash in this day and age. Paying rent, car repairs, buying major appliances, etc. People lose receipts but those bank statements are such good records especially since banks retain them for several years.

    I think that the plaintiff and defendant work on only verbal contracts. It seems that both parties were doing shady deals with one another. Lesson learned to always have, ask, and get receipts when doing business.

    Tenant is a total fruitcake, but she's slick as ice. The landlord, however, should KNOW better since he's suppose to be conducting a business in renting out apartments. What kind of landlord keeps ZERO records of all transactions? If this was happening in NJ, and the property manager was showing up at her door at all hours, that manager would have been arrested. NJ is a TENANT state, all the rights are for the tenant. This landlord would have been PAYING triple the amount of her original security back to the tenant, and it would have served the landlord right for taking no responsibility throughout.

The People’s Court was filmed in CT right next to The Jerry Springer show & I live in CT & it was about a 25 minute drive to TPC & JPS & I went to The People’s Court about 25 times & it was a lot of fun because after all the cases were over Judge Marilyn Milian would come out and talk with the audience and you could ask her legal questions, personal questions, things like that she was so incredibly nice in person. A few times, I asked her questions and she was just so pleasant with answering all the questions. My first time going the woman checking me in. I told her what a huge fan I was in so before anybody entered the court room she took me in by myself so I could see it. I went right up to the bench had my picture taken where on the bench where the people court symbol is on the front of her bench And I miss going also I did go to the Jerry Springer show once it was his 25th anniversary year & trust me seeing him once was more than enough lol 😜 😂 oh & also I got my picture taken with her Bailiff Douglas & He was super super sweet

    the judge mentioned two things landlords must do that he doesn’t do.
    detailed letter within thirty days describing the deductions from the security deposit, and proof to support those deductions.
    the security deposit goes into a specific escrow account with the social security number of the tenant (one tenant) and the landlords name as the escrow agent.
    if you have only one rental, you do this for that one rental.
    if you have one hundred apartments, you do this for each and every apartment.
    if you’re a landlord and you don’t
    follow this, you’re asking for trouble.

    When I rented I always had until the 5th of every month to pay the rent. Anything after the 5th would have late payments attached. I always paid in cash but always got a receipt.

    First thing first this old man is a fool! And the lady, at first I thought she was ok and a good person.but no proof she every paid rent or when and always paid cash!! No way.. I believe she was behind,she was sure he had no proof she didn't and no video or picture moving in or out.. They deserve each other and the real estate agent is also a fool and Al crook just like 99% of them!!

      yes but the property manager did not state in text that she owed rent, it sort of inferred she didn't. I think the Property Manager kept it, hence no receipts and told the landlord she didn't pay. But landlord should have brought property manager.

    It’s not dumb to pay cash… it’s actually a common thing to do because there is a lot of scammers that take your card information now and days… but her mistake is not keeping receipts 😂😂😂😂

    Exactly what is he paying that property manager for. Even if it's been a year they should have something on file, or at least one would think so. He literally showed up to court with nothing. And then miss lady who pays everybody in cash and shows up with NADA too

      Who's this fool and what does he bring? That guy gives me the creeps. I would say he's there for the entertainment value but it's usually in very poor taste. I would still like to see a compilation of his innapropriate statement anyway. This show doesn't seem old enough to have this type of person on screen.

      He is the one who started and was the original host and arbitrator of “The People’s Court” he is loved by many and done much for the world and community including charitable donations. School supplies for low income communities and building churches all across the US. Younger Generations are so quick to judge someone without even taking the time to note if the person is rightfully where they should be. You wouldn’t be watching this now if it wasn’t for him. But all because you don’t like what he has to say... “He’s a fool... needs to retire... and is condescending”... don’t even take the time to research a person. Just whatever doesn’t satisfy or hurts someone’s feelings they deserve to be ridiculed. All because you didn’t like someone simple for who they were.

      Leah some people don’t realize that especially the younger generations like myself. They hear something they don’t like and immediately damn someone’s character. It’s ridiculous.     Too funny! Let me start by saying Doug Llewellyn, the court reporter / commentator for the People's Court, has been on the show for years. I love his commentary, but it seems like as he's getting older, and the longer he's been on the show, he's getting shadier and shadier. Almost snarky. Has anyone else noticed that? I mean the last comment, he called the plaintiff dumb, and said on your way? Aww man...the shade! 🤣
