      God I wish we could. Two years ago I was working on a divorce where we were finishing the case by selling the house. We had gotten everything she wanted and just needed to sell the place. The day the realtor comes, we find out that our client had started breaking down walls in the place and spray painted the outside. Despite it being her idea, she now decided to start breaking the place just so her husband couldn’t have any money from the sale. She had refused an earlier option to keep the house, and now that she started destroying the place after agreeing to the sale, she owed him for any money lost on the sale due to the damage, which she also blamed us for. We had a perfect record for our clients that year until her

    As a lawyer, I have to say that zero of these are surprising.
    Relatedly: if you’re ever on a jury, try not to assume anything about the case based on whether the defendant testifies. Lots of lawyers will strongly recommend that their clients not testify, usually because they are probably going to say something dumb. Not even necessarily related to the case. People say all kinds of dumb things or have a hard time communicating well when they’re nervous.

    • @perrymeril
      @perrymeril Před 29 dny +4

      It should be COMMON SENSE that a defendant should never be on the stand unless they are capable of 100%not incriminating themselves. Sadly, just like a jury should have 0% doubt a defendant committed the crimes in question to convict, it is nearly impossible to have that 100% certainty with the defendant.

    I was involved in a car accident many decades ago. The insurance companies took the matter to court to see who was liable. The other driver claimed that he had a turn arrow and I had run a red light. I claimed that I had a green light. He also claimed that he was alone in the turning lane. I claimed that he was the third car in the turning lane and the first two cars had turned safely before I entered the intersection. He then proceeded to bring local traffic authority in as a witness, who then told the court that a turning arrow does not activate if there is only one car in the turning lane, and that car would have to wait for it to be safe from oncoming vehicles to turn. Completely shot himself in the foot. Couldn't have been the only car AND had a turning arrow.

I, of course, put it in the "not working" bin with a tag that said /that/ it was not working, and outlined (in writing) /how/ it wasn't working. Someone else took it out, took off the tag, and put it back with the "working" equipment. I had to repeat this several times over the course of months before people realized "wow, this thing literally does not turn on. I should leave it in the 'Not Working' bin." I can only imagine what would happen if it weren't a hand-held radio transponder, basically, and something that could actually do damage instead. aaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaaa.

    "parte" in ex parte is pronounced like "partay" like you're going to party in the 90s and trying (and failing) to be cool about it.
    It means "from a party" meaning you meet the judge with only one side, away from the other side. It is almost always illegal, but with some specific exceptions, including the one in the case here. The exceptions aren't that rare, but you need to meet one or both the lawyer and the judge can get in trouble.
    And FOIA is usually pronounced, not spelled. Like "foy-yah." It's Freedom Of Information Act. In New York, they call it Freedom of Information Law, or FOIL, which is a better acronym.

    Whoever does these scripts needs to slow down. In a court story with circumstantial evidence where you’ve named the characters “D1, D2, D3” and D1 and 3 are halves of a couple who planned and committed a murder, it’s very important you don’t slip up and say, “we returned a not guilty for D1.” When you’ve just explained why it’s D2 who couldn’t be guilty due to burden of proof. Either take a second and reread these things, or give them full names. You guys make these mistakes way too often, and you’re getting paid too much to make them. The content is made by someone else for you, you’re compiling, editing, and reading them. So maybe we ought to do a good job on the editing and reading parts.

    So not a lawyer but am the daughter of a key witness. When Dad was in college, he came home one day to see someone parked in his spot (apartment with assigned parking spaces). I can't remember if my dad had the vehicle moved or just reported it, but he pissed off the owner who started harassing my dad and his girlfriend, who was living with him at the time. My dad looks like a stereotypical German guy and kept in good shape, but he's also not someone who likes confrontations, and so reported the harassment to the cops. The DA came down to question both Dad and GF and the more he heard, the more ecstatic he was. Apparently the guy harassing him was causing a lot of trouble, but they couldn't pin him down because witnesses kept dropping out, likely due to harassment.
    Well, Dad and GF decided to go through with acting as witnesses. One issue though: the trial kept getting delayed. This went on for months, until it was time for finals. Both Dad and GF were in college, and thus would have been swamped with studying and all the stress that time of year brings to students, too much to have a trial on top of all that, right?
    Haha, nope.
    Dad and GF showed up to court with their school books. Judge looked at them and asked why they had all that crap, to which they explained that since it's finals week, they were going to study quietly until they were called up to testify. Judge then called the lawyers to his office where he proceeded to rip into defense and then throw the case out.
    Apparently, defense kept delaying the trial until finals because they knew both Dad and GF's testimony would get the client put away and wanted to have they drop like all the other witnesses. Sadly, while my dad isn't confrontational, he is stubborn and will stand his ground (the only people I've seen out-stubborn my dad were my mom and myself). Their client stood no chance.

    Story 46 reminds me how some people i used to know robbed a local dealer of all his money and weed and the dealer went to the police told them everything and the police arrested the dealer then came and arrested the guys that robbed him. Saw those guys getting cuffed and when i heard what they did our whole group of friends that knew them wouldnt let them live it down for years.

    9 years for attempting to escape? That's alot.
    Here in Germany the wish for freedom is seen as a natural human desire and thus trying to escape from prison can not be punished. When you're cought you will simply be returned to prison to sit off the rest of your sentence with no further consequences.

  • @allisonharranmua8193

    I'm not an attorney but I'm a paralegal. This wasn't our client, we were defending the property owner. The plaintiff was claiming a back injury due to slipping and falling on ice in the driveway of a private homeowner. The plaintiff was going door to door trying to convert people to his religion and did not have permission to even be on the private property at the time of the injury, there were no witnesses, no medical records and he had to open a closed gate to get on the property. The closed gate is important because it was a barrier to the danger that was crossed without permission. All of that was already in our favor, but the smoking gun was that this "severely injured" plaintiff posted a video of himself to his CZcams, Facebook and Instagram. In the video he was competing in a line dancing competition.... exactly 4 hours after the alleged injury. It was up on his page for months and I found it very easily during the discovery process. The good news is he won the competition, the not so good news is the judge wound up throwing out his case for filling a frivolous lawsuit.

    That story about the guy cheating on his married wife that is actually a lie. No lawyer who's fighting for you would say now we have to turn it over to Discovery. Now that lawyer would have told him what he did wrong and told him to hide her until everything's done

    This is from a buddy of mine. Names changed for yada yada yada reasons. Mark and three buddies were coming back from a DEA training simulatin when they saw a guy on the side of the road holding a gas can. So after deciding to do today's good dead, they pulled over. The Gas Can Guy said he didn't have any money, but would sell thema pound of weed to them. This was in the early 1990,s. Mr. Gas Can Guy got arrested for possesion, attempting to sell, and, cue the laugh track, felony stupid, since Mark's crew wer all wearing DEA equipment.

    ngl, even if someone is stupid enough to admit they did something they didn't do and the court knows they didn't do should never lead to them being imprisoned. like, in a just system, that should be such an easy bail, throwing out of case, or otherwise a dismissal. fuck a justice system that does this.

  • @Dreamspawn
    @Dreamspawn Před 25 dny

    As someone with ASPD, I have to say, I'm really tired of hearing people act like we get a choice in our ability to empathize or care about other people. If it was a choice, I can guarantee, most of us would choose to care. I agree that the drug-using dad who sabotaged his own case probably should have been more self-aware and just not had kids in the first place, but biology doesn't care about your mental health status. If you're physically capable of having kids, chances are, you will if you don't take the right precautions to prevent it. I even agree with the poster deciding to end the relationship with the guy. It isn't easy to maintain a good and healthy relationship when you have ASPD, and I don't blame anyone for not having it in them to stay with someone like me, even if the person is actively trying to get help for the issues. But in a world where people defend rather fucked up actions because of mental health issues, I find it rather hypocritical to blame a sociopath for the fact that they have a lack of empathy, something that is beyond their control.

      Actually it is something they can improve in therapy. The problem is many of them don’t recognize what they are doing is wrong so they wouldn’t but some have and have shown improvement.

    • @Dreamspawn
      @Dreamspawn Před 22 dny +1

      @@marissam3176 This is true, and a good point. For me, I guess, the point I was making is that I don't like the double standard I see constantly when it comes to this condition specifically. Nearly any other condition is treated with sympathy, compassion, and humanity. But for some reason ASPD is always treated differently. The black sheep. At least as far as I was told when I was going to therapy, most people with my condition turn out to be non-violent and virtually harmless, though we do have serious trouble making and maintaining genuine and lasting connections with people, including our own children. When I say that it isn't something we can control, I'm speaking from my own experience. I do try to at least be compassionate and considerate, but it doesn't mean I've figured out how to suddenly have a lot of emotional depth or that i can go beyond cognitive empathy. Affective empathy is still completely foreign to me, and I'm not sure that will ever change, but who knows?

      Idk what it's in reference to exactly, so I'm just guessing based on possible legal context that RTA = Road traffic accident. I think in the UK we've moved away from saying 'accident' in this context, because it implies no single person at fault, so use 'incident' or 'collision' or similar (or at least, that's what Simon Pegg said in Hot Fuzz & frankly I'd trust him over most UK coppers any day lmao)
