    Thank you Sir for your excellent presentation.I remember one definition of culpable homicide by Sir James Fitz James Stephen which is as hereunder :
    "Culpable homicide is killing of a human being by another human being by an act or omission but for such an act or omission the person died would not have died at the time of his death."

      My humble submission, mere hurt (sec 319 IPC) cannot be injury, only voluntarily causing hurt is injury, because there is always mensrea (i.e.illegalitty is there as per Section 44 IPC) behind the injury but mensrea need not be there behind the hurt (i.e. it may be legal i.e. causing hurt by doctor by surgical operation), if illegality present behind hurt then only hurt becomes injury ( section 321 IPC onwards)

  • @krisk2417
    @krisk2417 Před rokem

    Great lecture, very detailed. Thank you very much, sir. One small question. Whether every offence under this chapter "offences against human body" requires prosecution to prove the injury? For example s353 - does the prosecution case fail if no medical report submitted by victim?

  • @babu.mmanickam2712
    @babu.mmanickam2712 Před 4 lety

    My humble submission is that, mere hurt (sec 319 IPC) cannot become an injury. Hurt becomes injury ony when there is illegality behind it as per Section 44 IPC, i.e. if mensrea present behind the the hurt it becomes injury (section 321 onwards i.e. voluntarily causing hurt/ grievous hurt are injury) otherwise hurt u/s 319 is a mere hurt, because mensrea need not be always there behind the hurt e g. Causing hurt by doctor by sugical operation is not injury.
    Hence mere hurt is not injury
    Voluntarily causing hurt becomes an injury
