Hillsdale College is an independent institution of higher learning founded in 1844 by men and women “grateful to God for the inestimable blessings” resulting from civil and religious liberty and “believing that the diffusion of learning is essential to the perpetuity of these blessings.” It pursues the stated object of the founders: “to furnish all persons who wish, irrespective of nation, color, or sex, a literary, scientific, [and] theological education” outstanding among American colleges “and to combine with this such moral and social instruction as will best develop the minds and improve the hearts of its pupils.” As a nonsectarian Christian institution, Hillsdale College maintains “by precept and example” the immemorial teachings and practices of the Christian faith.
The College also considers itself a trustee of our Western philosophical and theological inheritance tracing to Athens and Jerusalem, a heritage finding its clearest expression in the American experiment of self-government under law.
By training the young in the liberal arts, Hillsdale College prepares students to become leaders worthy of that legacy. By encouraging the scholarship of its faculty, it contributes to the preservation of that legacy for future generations. By publicly defending that legacy, it enlists the aid of other friends of free civilization and thus secures the conditions of its own survival and independence.

@@jersmith1486 it's actually a very interesting story. It started in the soldiers overseas after they were inoculated with 8 to 10 vaccines and started Fallen ill and dying by the droves... so scared the populace who are being told it was a Spanish flu, that they also wanted the vaccines, and then the populace started dying in droves as well.... hard truth, but it is truth. And hidden for over a century by the, you guessed it, pharmaceutical companies that caused all this. They could never take the blame for the soldiers dying in droves after their vaccines, and so they made up of scary and mysterious Spanish flu , and then make more money as the populist started getting vaccinated.

Prof. Carrington cited Jacobson v Massachusetts (171 US 11 (1905)) to support his statement regarding a balance between governmental authority exercised for the ‘greater good’ in periods of emergency and individual liberty and right to private property, in the form of his/her person and related health choices. I would’ve appreciated his acknowledgement and discussion of SCOTUS (hereafter, “Court”) decisions handed down since that time that have shifted the proverbial pendulum favorable to individual/personal liberty over government intrusions.

Since 1905, the Court has recognized:
    - Any emergency infringement of personal liberty and property rights must pass the standard of ‘strict scrutiny’ in judicial review (United States v Carolene Products Co (304 US 144 (1938)), though history has shown horrible abuse can still occur (Korematsu v United States (232 US 214 (1944)).
    - States cannot justify restricting personal liberty solely on moral grounds (Lawrence v Texas (539 US 558, 578 (2003))). Many of the arguments supporting Covid 19 related infringements are framed upon ‘it’s the moral thing to do’.
    - “Involuntary confinement of an individual for any reason, is a deprivation of liberty which the State cannot accomplish without due process of law” (O’Conner v Donaldson (422 US 563, 580 (1975), also Foucha v Louisiana (504 US 71 (1992)).
    - Individuals have the right to make personal medical decisions, including refusal of treatment (Cruzan v Director, Missouri Dept of Health (497 US 261, 279 (1990)).
Insofar as many state laws, such as those in California, convey authority to public health officers (not governors) to take extraordinary measures, such as quarantine, to mitigate the spread of contagious disease, those statutes focus those efforts toward persons/animals/locations known or reasonably believed to be infected. Involuntary confinement for disinfection requires ‘clear and convincing evidence’ that the individual actually has, or has been exposed to, a contagious disease and is likely to transmit the disease to others if not confined.
Similar evidence of infectiousness regarding forced vaccination would have to be necessarily high, reliant upon validated observational data (not inflated model predictions). I expect PHOs would need to show a validated high rate of transmissibility, a probability of mortality across a significant preponderance, if not majority, of the population, and the intended vaccine had a demonstrated efficacy rate.
It would be interesting to hear a broader exploration of the legal aspects of police powers versus individual liberty from Constitutional scholars. For a moment, I thought Prof. Carrington was going to answer this issue in response to a question posed by Prof. Arnn… alas, he didn’t answer the question.

Simply put, no gov in America should ban gatherings just because people *might* get sick there or later from it.
    I say that because:
one's right to peaceably assemble may not be restricted (1st Amendment).
One's right to assemble may be restricted only when it is determined that an assembly would not be peaceable or that an assembly would otherwise somehow interfere with another's right.
The above fact and above principle implies
one's right to assemble may not be restricted only because it is believed that an assembly might be non-peaceable--for example, because an assembly might contribute to others not voluntarily in the assembly becoming ill.
The above fact, principle and deduction imply
one's right to assemble may be restricted because it is known that an assembly is non-peaceable because that assembly is causing illness to others not voluntarily in the assembly becoming.

We have mental midgets running our countries and corporations. In the novel 1984 nations were in a state of perpetual warfare as a means of control. The state has taken away your individual responsibility to make decision that impact your life, the very definition of tyranny. Government and corporations should serve the people, not the other way around. Absolute power corrupts absolutely.
I applaud the third speaker for his compelling analysis. I also posit that focusing on individual threats to society is counterproductive if other more dangerous and real threats are ignored.

Thank you, men, for this relevant discussion. It is, of course, theoretical, based on the event of a REAL pandemic that is as dangerous as the narrative claims. But it is irrelevant in light of the fact that, contrary to the constitution, there are those who claim to have an easy and safe answer in the forms of safe medication that would make the infection a non-issue that have been censored. That, to me, is the real constitutional problem.

If both parties united us, we’d all agree there’s no need to argue over who’s right or wrong, but rather what we can do to improve upon real problems, such as tyrannical politicians irresponsibly releasing prisoners while locking up healthy people! CA is too blue, sinking the economy into a deep dive @Pacific Ocean. We need the Red, White, and Blue (police). Justice, Peace, and Liberty 🗽....Please?

    • @Marine_0317
      @Marine_0317 Před 4 lety

Megan, that is wishful thinking and would only work in a perfect world scenario. Unfortunately we live in a diversified country where the definition of freedoms has different meaning. We have two political parties that refuse to work together in the best interest of the people. One side believes in big government control the other side believes in less government. My advice? Leave Socialist Democrat controlled States or you will sink with them. If everyone left the state, who will they have to govern? Alternative: Get active in your local and state government and rally for those candidates that have the best interest of the American people. Unfortunately, big companies with deep pockets control who governs. The people get the feeling that their votes don't matter nor do they count for anything. As we move forward in the new millennium and technology gets more complicated for us regular people election tampering will be prevalent and we are witnessing that today in this election. Just my thoughts

I would rather live free with risks of lose than that which is being shoved down our throats, "to be protected by the government" This is what is offered to prisoners, they'll seek to protect you while losing all you rights.

So now we understand more about whether the lockdown is constitutional. So if the people stand up for their rights and disobey the "orders" they've been given by these self-appointed "rulers," how do they defend themselves when their business licenses are revoked or when they are fined? How can the average Joe afford to legally defend himself? I believe fear is holding back the people even though we know our rights are being withheld. How do we take this knowledge and put it into action to stand up for and take back our rights?
