    I have come to realize that when a department does an "Internal Review" they are looking for policy violations which are not criminal. If they see criminal activity, they can use word smithing to say "we have completed the investigation and found no wrongdoing" even if there were criminal violations. Their investigation is for policy violations and not all illegal activity is covered by policy and it is their discretion to arrest or not arrest. Although it may not be applicable in this case, it is something to keep in mind.

    Philip Turner (AKA "The Battousai," after his CZcams channel) was standing on the sidewalk, across the street from the police station, recording. Several police officers came over, including at least one police car. Turner was questioned about what he was doing. The officers then demanded he provide identification, which he refused, citing Texas law which does not require a person to identify themselves unless arrested. According to the complaint, officers put Turner in the back seat of the cruiser, since he refused to give ID, saying "We're gonna make you sweat," and Turner demanded to speak to a supervisor. Lieutenant Driver showed up, also requesting Turner's identification which was also refused. After a short period of time, which was not more particularly described, Turner was released.
    Turner started his CZcams page on January 21, 2014.[6] At the time of his arrest on September 1, 2015, Turner was a part time student and a part time employee.[7] As of February 26, 2023, Turner's Battousai CZcams page had over 100 million views.[6] Turner v. Driver established the right to record police under reasonable circumstances in the Fifth Circuit

    It's amazing how officers frame everything in their favour, talking to the chief you explain that an officer was shining a flashlight directly into your face, this is immediately reframed as "shinning a light in your general direction" by the chef (who wasn't even there) - and when you explain that you were simply filming, he immediately goes to people _"holding flashlights on police, it gets dangerous, pointing a laser at police, we ain't going to be blinded while we're dealing with something else"_ . . . everything the police do is downplayed, excused and minimised, everything the public do is exaggerated, magnified, blown way out of proportion.

    While the Deputy Chief seemed to say all the right things…it is his patrol officer(s) who: kept a flashlight on Phil for a prolonged period of time (disrupting the video capture); refused to provide name & badge# upon request; & even gleefully admitted on their BWCs they were going to take steps to specifically avoid Phil after their stop and purposefully deny him the requested ID info. So, the deputy chief’s comments provide good cover for his Dept…but talk is cheap, & we have all seen on Phil’s 1st Belton video that his officers are NOT doing what he admits they should be doing. Thus a leadership failure…whether unintentional or by design.

    Internal Affairs investigate the person complaining. I used to work in the news biz, and I can't recall one complaint, even with audio, video, witnesses... that ever resulted in more than a form letter (usually misspelled) being sent stating no policy violations were found.

  • @grumpyoldman3597
    @grumpyoldman3597 Před rokem +2

    "so you do want to formalize the complaint"... THIS IS CRITICAL FOR PEOPLE TO UNDERSTAND, the deputy chief just tried to suggest this may be informal, meaning, they will "have a talk with the officer" but no punitive measures can now take place per the union contract because it was not a "formal complaint"... this is one of the biggest shams departments run to roadblock accountability, by treating things as informal or steering people to it, they protect the bad cops they are supposed to hold accountable...

      Plus so many of these guys are compromised. Its just part of the larger charade now...
      These gov employees existence and authority is the real problem!...

His first reaction was to defend that behavior as something entirely different than what occurred. He instead should have been concerned about possible bad behavior, as he had every clue from you that it was certainly that way.
