      @@BenjWarrant I get what you're saying but at least my understanding is that personal jurisdiction being waived is a civil law thing, with a criminal charge the crime has to be tried in the jurisdiction the actual crime occurred so the defendant's plea doesn't waive that requirement and it has to be proven at trial.

      @@Vaelosh466 There's no such thing as 'personal jurisdiction', perhaps you mean something else? A court has jurisdiction over persons, areas, and issues.
      You can't "waive" jurisdiction, you have to challenge it, and that would be on the basis that the court doesn't have jurisdiction over you, or over the locus, or over the issue being tried. If you don't challenge jurisdiction at the earliest opportunity, you will probably be taken to have acknowledged jurisdiction and thereafter it will be impossible. In the US, it can certainly be an issue in criminal justice - e.g. 'this is a Michigan court but this was a federal offence', or vice versa; also 'this is a Michigan court but I'm from Wisconsin', that sort of thing.

      This guy has probably been watching Marc Stevens' pseudo-law videos. One of his tenets is to constantly ask the judge stupid, irrelevant and ridiculous questions and ask them over and over and over. Fortunately, this judge ain't having it. And the 30 days in jail definitely cooled this SovCit's jets.

      Actually that was the contention of the Judge. He instructed the defendant that he could not represent himself AND retain his rights to an attorney too. So, in order to have any self-representation rights, the Judge had decided the defendant had to give up his rights to counsel of an attorney.
      Though most attorneys apparently would flat out refuse to provide advise or counsel before a court, if the defendant is claiming sovereign citizen status.

      You have the right to remain silent, and you also have the right to testify at trial. You can't do both at the same time. That's just a logical fact.
      Same as the logi sl fact that the judge stated here; you have a right to representation of counsel, and you have the right to represent yourself, but you can't do both at the same time.

      Nathalielawyerchick once did a video where a lawyer was defending herself. The video showcased one of the key reasons of why it was a bad idea - the lady got too passionate aboit her own case and ended up acting like a 5 yrs old child towards the end. Iirc she had messed up at some lawyer stuff and was put on probation, then she violated the probation. Then in court she argued that since the original case already destroyed her career, she had been punished enough. Implying it gave her a free pass at violating her probation. Judge didn't see it that way and gave her one year of jail. I can't recall whether it was actual jail or deferred with a minimal time to serve, but either way the lady was her own worst enemy for deciding to represent herself...

    I appreciate the shout-out, brother! You must've hopped on right away. Cheboygan is in Northern Michigan. Judge Gauther presides over both Presque Isle and Cheboygan County. I can't wait to see how he handles the next few docket calls. February 6th, at 9am will be epic. I really hope that the judge agreeing to the amendment of his bond stipulations gets to Trevor's head so we can bust out the popcorn and watch the circus show. It's funny how he thought he was a genius by avoiding using the word "understand" but that he "comprehends" the charges instead. Comprehend means the exact same thing as understand 🤣. Mind you this dude is almost 49 years old!!

    I swear to God, if I'm a judge and one of these idiots comes before me, when they start with the "I'm representing the entity, blah blah blah" garbage, I'm going to tell them flat out that, since you're representing another individual you're going to have to vacate this courtroom, because you CANNOT represent someone other than yourself, unless you're a licensed attorney. You can represent yourself, but, since you're claiming NOT to be that person, you're excused.
    If they start up the entire jurisdiction argument, I'm going to ask them "if you don't believe this court has jurisdiction over this matter, or over you, then why are you here?"
    I would NOT mess around with these aholes for a second and I'd let them know that. You want to continue down this road I'm putting you in jail and I won't wait long to do so.

    That judge is extremely polite, kind and most importantly helpful to the defendant and tried to warn him. Never try to represent yourself. It's just a bad idea. 🤷‍♂️

    This particular judge is one of the better ones, he doesn't allow a take over of his court by the defendant and runs through the procedures efficiently.

    By granting him leave to proceed pro se, Judge Gauthier put him in the position of having to make another choice: Keep chasing that sovereign line -- which is about as useful as trying to draw three cards to fill a straight flush when you're playing spades -- or deal in real law.
    I wonder when that's going to hit him.

    What treaty does he thinks that applies to his case? This is domestic. If he was boating in the Great Lakes, there’s no such thing as international waters, it’s either or our side or the Canadian side and nothing in between like the Atlantic and Pacific. So no treaty applies. As i understand, treaty law in domestic case involve cases involving the Indian tribes and the state of Texas.

    They never, ever win. Why do they keep trying? If I considered going the sovcit route, I'd research outcomes of similar cases first. Guess they never do this! This judge is quite good at handling sovcits. He remains respectful but does not yield.
