On Tuesday May 22 2018 Georgia Voters nominated Stacy Abrams to be the Democrat candidate for Governor. This marks the first time in history that an African American woman has become the states nominee for Governor from either major party.
To cover this historic event PINAC dispatched Civil Rights Investigators Mike Hoffman and Jeff Gray to a voting precinct in St. Mary’s Georgia. On a day that would be a positive and historic milestone for civil liberties, would our civil right to document the voting process be upheld?

SO SO true.... I find this fascinating as it applies to so many other aspects of society and our very psychology of needing to be "right". I think many of us find that to be wrong about something is just downright unacceptable so we will fake it until the very end until we are literally proven to be wrong. Ive certainly seen this in myself and worked hard to rectify it. It starts with upbringing.
This way of auditing should be a standard. No cussing, not confronting...just politely reminding what the law says. Excellent
Jeff, I can't remember any police encounters you have posted that were anywhere NEAR this cordial and professional. I give this Sergeant an A+. And even though his subordinates were a little uninformed, they were polite and were not at all domineering. St. Mary's PD has some shining examples of public servants, provided this is par for the course for them.
This is how every police encounter should be with the public. As long as there’s no criminal activity, and or crimes being committed. Kudos to Sgt. Isenhager at the St.Mary’s, GA PD. And the wonderful guys at this channel for showing the viewers how it’s done.

they were still evicted from the place that they were legally allowed to film. they cannot go into the polling station but the 150ft does not apply to photography so they are still bad cops they gave unlawful orders and since he doesnt want to be arrested he complied with their dumbasses

I know this lady and have been looking for her since 1981. I was at Disney World on May 18th 1981 and was standing in front of Cinderella Castle and she took my picture. When I asked her why she said " I wasn't taking your picture, I was taking a picture of the Castle ". I immediately started searching for a Security or Law Enforcement officer to investigate but my eyes were filling with tears and no one would stop her from leaving the area. When Security came they told me " there's nothing we can do " so they must have been involved in this Machiavellian endeavor. I'm still shaken when I imagine them all happily sitting around and looking at my picture that captures the last moment of my personal security and safety. Oh, the humanity......
A sgt. that knew the law after he called the local DA. He misinformed his patrolmen and then got smart and got informed. VERY SURPRISING!!

President Jimmy Carter signed the metric system law around 1979. However, the public refused to switch to the metric system. No one enforced the metric system, so everybody went on using the English system. Remnants can be seen at ball fields, where signs of the outfield walls will show distances of 360 feet and 118.6 meters. If they make a law and no ones cares, is it still a law?

Photography is not campaigning and photography is not a crime and from now on the polling places will have to be more than 150 ft. from a sidewalk and not in a government funded building that operates as a religious organization. They have another problem with the fact the car wash next door is only 20 ft. away. Going to have to shut that illegal poling place down.

I worked in a country where for a time elections were a very contentious issue, but on election days we always got a full briefing on the do's and don't of the laws regarding elections. Officer Rose was very polite but sadly mistaken, but that is also the fault of his superiors. Luckily anything wrong was done with the best of intentions and done politely.
Photography isn't campaigning. Why would a law written to provide a campaigning free zone around a polling place also be applied to photography? I know I've seen news crews follow a candidate into a polling place to show them casting a vote, in all probability for themselves.

She may be crazy, but "Paula Pinac" was pretty funny. I do not mind when cops make an innocent mistake like this as long as they correct it - which I think that they did. St. Mary's police dept earned back a little respect.

a well informed and PROFESSIONAL Sgt. a credit to the few that actually KNOW how to uphold the law and not their custom version of it.
So the chief admits that the law bans "campaigning" inside the 150 foot boundary but instructs his officer to move you out of there even though you aren't campaigning! So he's basically making up his own laws. And some people don't understand why others don't like/trust the police.
Oh and PS, what US laws measures distances in meters?
I would have laughed my ass off if you had told the officer that 300 meters is about 75 feet, he probably would have believed you…
At least the supervisor understood the law. 150 feet is not 100 or 150 meters. This was a very good investigation.
So the confused cop, didn't know the law, and immediately sided with the people that called in rather than defend the constitutional rights of the photographers.

Where is that cop from? Canada? Europe? Australia? We don't (normally) use meters as a distance measure here in the U.S.
That's because Americans can't handle the metric system
P Mc ● Actually, P Mc, it's not because we can't "handle" it. It's because (most) Americans aren't taught it. If you aren't taught something, you don't learn it. Such as, me telling you " et här är vad jag pratar om". The metric system is, in reality, easier than the Imperial system, mainly because metrics is based on the number 10. It doesn't get much simpler than that.

That was good. The sergeant was polite and took time to clearly explain the law. Freely admitted the officer was new and made a mistake, which is so rare for a department to do. You guys were calm and polite. You went the mile to ask for clarification on the law and held no grudge for what might have been a true misunderstanding on the officer's part. Learned alot and I like that from videos like this.
Good to see you and Hoffman out there together. Always remembering EOG in my thoughts.

I could not find a law regarding recording or pictures outside but found this regarding exit interviews.

You cannot conduct an exit poll within 150 feet of the outer edge of the building of the polling place or within 25 feet of any voter standing in line to vote. Nor can you conduct an exit poll within a room where absentee ballots are being cast or within 150 feet of a voter waiting to cast absentee ballots (unless in a private office out of earshot of voters). See 21-2-414 of Georgia’s Code, “(a) No person shall solicit votes in any manner or by any means or method, nor shall any person distribute any campaign literature, newspaper, booklet, pamphlet, card, sign, or any other written or printed matter of any kind, nor shall any person conduct any exit poll or public opinion poll with voters on any primary or election day: (1) Within 150 feet of the outer edge of any building within which a polling place is established; (2) Within any polling place; or (3) Within 25 feet of any voter standing in line to vote at any polling place.”, “(c) No person shall solicit votes in any manner or by any means or method, nor shall any person distribute any campaign literature, newspaper, booklet, pamphlet, card, sign, or any other written or printed matter of any kind, nor shall any person conduct any exit poll or public opinion poll with voters within a room under the control or supervision of the registrars or absentee ballot clerk in which absentee ballots are being cast on any day or within 150 feet of any elector waiting to cast an absentee ballot pursuant to subsection (b) of Code Section 21-2-380. As you were clearly not campaigning, I don't believe the limits applied to you as journalists. I have not read the statute, but even the Sgt stated that it applied to campaigning.

2. So now the cops are the “uneasy police”. 🤷🏻♂️. He doesn’t know the distance but orders citizens to do it.
3. So the cop was wrong & that’s ok but if citizens are wrong they’re arrested.
This is just fantastic. Jeff and Mike were completely professional and cordial, as were the officer and sergeant. Rules were clarified and everyone went away happy. I love seeing these types of interactions with LEOs. We need more like this. Keep it up gentlemen!

100 meters? I'm not aware of any state that has officially adopted the metric system.... maybe I"m wrong.... I mean I would like to be wrong, metric system makes more sense in a lot of ways... but just there is no real drive to change.

The dispatch center was in his words " ALL LIT UP " so the sarg decides to issue a directive to tell you to stay away 100 plus meters without actually knowing where you were standing.He doesn't seem to actually know the statue. So his dispatch will continue to get flooded with concerned citizens and business as usual.
In Ohio, I asked for, and was given permission to take a picture, INSIDE of the polling place of the polling booths and the people in line. She said there is a curtain, so no big deal.

I really liked the professionalism on both your part and also on the part of the Police. It's still unfortunate that the police still are so willing to violate your rights instead of insuring that they are enforcing within the Law. This should always be LEO's main focus, to serve and protect the rights and property of us (the Citizen).

O.C.G.A. 16-11-36. Loitering or prowling. GA uses this law to stop and ID. A civil constitutional right cannot be turned into a criminal offense.
The 150 feet does not apply to someone videoing outside of the polling enclosure space
Polling place laws vary from state to state. In Georgia, state law prohibits selfies and other photos being taken in polling places(in means inside of). But while time in the voting booth is meant to be private, polling places are quite public.
“There’s no prohibition from citizens, or visitors, or curious people, or whoever going and hanging around at polling places, watching what’s going on, observing people coming in and out,” said Chris Harvey, elections director in the Georgia Secretary of State’s Office.
One caveat, politicians are only allowed to enter polling places to vote.
Campaigning, campaign signs, or even campaign clothing are prohibited within 150 feet of a polling place. But, campaigns and political parties are allowed a few of their own poll observers. You might see them inside, but if they see a problem they have to leave to make any phone calls.
If a camera was there with a giant "CBS NEWS" logo, they'd be waving at it an mouthing "Hi, Mom!"
a couple interesting things in this video, great job asking the lady to stay back while you step back to show she is the aggressor, then note how the officer has no idea what the distance is, and can't tell you, so how does he know you are violating that distance if he doesn't know... P.S. and then notice how the supervisor keeps making up excuses for every point you counter and demonstrate lack of knowledge even after he supposedly told the officer where to clear them across the street yet that still wasn't enough, so which story is the truth, does the supervisor have radio traffic showing he said across the street was okay, was it not okay, was he the one who gave him the wrong information and now is making the junior officer the fall guy?
