    The MAIN reason that a cop insists on having your license in his(or her) hand is so that they can hold it (and you) HOSTAGE while they sniff around for a way to generate revenue off of you knowing full well that if you do drive off claiming that your license was "stolen" from you or that you are being detained unlawfully....cops will then pull the "driving without a license" nonsense on you.

      Cobra I don't understand why valid information presented, readily avalabile and easily checked is not sufficient. Florida doesn't staple your driver's license for DUI's and there is no magical value conveyed by a plastic card. The cop will have to manually enter the information or verbally read it off anyway. Not rolling down your window or handing over a physical license doesn't allow drunk people to get away with breaking the law. If you are driving erratically that should be proof enough. The reason why people do this is because law enforcement gets cucked by their own actions (i.e. violating people's rights or killing them and getting away with it). I understand the need for DUI checkpoints, but sadly citizens need protection from their own protectors

    There is a very deep seeded psychological explanation for law enforcement doing what they do. I find it ironic that military and police are praised by the general public even though those professions attract the highest percentage of psychopaths.

    Nice video. I wonder what would happen that each time a DUI checkpoint is set up, that about 100 people went through with the DUI Flyer. And, then continue rotating through it. It would bog down the checkpoint, and they may reconsider doing them.

    To note: the titles of sections hold ZERO weight in court. They can call the section "Failure to pick your nose" but the text of the law says you must exhibit your license and it will be held up in court... and if you try to argue about the title you will be shot down quick because they carry no weight in court, they are not the text of the law itself.

    Nothing in the leymans definition of "Produce" even implies that you must hand over the item in question, let alone say so outright. In point of fact, Webster prvides this definition, with this example sentence:
    (7)to bring forward; present to view or notice; exhibit:
    'to produce one's credentials.'
    Which fits our premise that the law only says you must bring it out to show, not hand it over.

    Florida law states that the ops order needs to be on-site. Also all DUI check points must have a signed letter from governor office stating all aspects of the check point. If this letter is not at the check point, then the check point is unlawful and invalid. I was taught this by my ADAs that taught our legal section in my academy class.

    How can they force you to speak with them when some people don't even speak English? Unless they make a law requiring everyone to speak English, it doesn't seem right to force English speakers to have a conversation, while allowing foreign language speakers to drive off!

      I believe its nationwide ( id check first) that like in these open carry videos cops roll up l, guns drawn, even seen some threaten to blow the guys head off. You can legally resist with equal force. That means if a cop rolls up and threatens you with deadly f9rce, ummm thats why your carrying right? Ya youd better have some friends with you and more than one camera, be ready for gang back up and an all out street gunfight but thats what they are bringing this to. They are acting like state sponsered gang bangers and that isnt legal or right. Sounds crazy i know but its standing up to criminals that gets our freedom to not get arrested for following the law back. What sound more stupid ?

    Sobriety checkpoints are not authorized in Michigan, which is odd considering that it was a Michigan legal case (Michigan Dept. of State Police v. Sitz) that prompted the U.S. Supreme Court to carve out an exception for checkpoints. Their behavior is altered from their normal unlawful behavior by recording what they do as was so clearly showed. When not being filmed checkpoints do what they are intended to do.     Don't play their game of upholding the law....his supervisor needs to be informed. That's a serious offense. Doing dumb shit under color of law seems to be their game. What kind of oath are they giving nowadays. Ask the State attorney what she thinks he mean't by saying "don't play their game".

    You'll notice the language is ambiguous because saying relinquish, surrender or hand over your license is a 4th amendment violation. Putting that in writing on a statue would be an admission of a rights violation base on penalty of law contradictory to the constitution. To be secure in your person, property , effects and papers from unreasonable searches and seizures. So you understand the states attorneys reluctance to make a statement or comment on the subjects brought up about the statute.

    Seems to me in Georgia when you sign the paper, used to photocopy to the license...there is small print that reads something like.....signature is agreement to surrender upon request by law enforcement...or something contractual like that.

    The Fifth Amendment (Amendment V) to the United States Constitution is part of the Bill of Rights and protects a person from being compelled to be a witness against himself in a criminal case. "Pleading the Fifth" is a colloquial term for invoking the privilege that allows a witness to decline to answer questions where the answers might incriminate him, and generally without having to suffer a penalty for asserting the privilege. A defendant cannot be compelled to become a witness at his own trial.
    You either believe in your "Rights"or you don't. Its very simple.

    Nowhere does it say "TO HAND OVER"! By showing or exhibiting you are producing said documents. Hope this helps.

    The shifting sands of law enforcement. While protecting the public at large, It seems to be okay to violate a few rights here and there! The assistant D.A. was out there to what? Make sure no rights were violated. I think not. She was there to make sure rights were violated properly! In accordance with the law as written!

    To the attorney at that end. Subsection 4 states non criminal got that. What is to keep them from arresting on obstruction? Granted it most likely will be dropped, squashed, or found not guilty, yet they could and do arrest for obstruction in these situations. Note in this instance the word they doesn't mean the agency on the video.

    The language of the statute, 322.15, was amended from "display" to "present or submit" in 2014 which clears up if a driver must hand their DL to an officer when requested.
    Warren avoids the word "SUBMIT" which by definition means, "to yield or surrender"

    Also keep in mind that all the language that you read in the statue are TERMS not words and you will ONLY ONLY get clarity when you check the definition of the terms in a Law Dictionary.

    The Assistant State Attorney say's she's there because she's interested in the 4th amendment(right to be secure in your papers and effects) yet she has No Problem with the cops Demanding ID(Papers). Perhaps she was only there to see how many sheep would allow them to trample their rights and hand over ID even though it's meant to be an Drink Driving check point. It's not a traffic stop so no ID is required! If it was Me I'd hold a sign that also read, "do you have reasonable articulable suspicion that I have been drinking?" "If Not, why the hell have you made me pull over?"(Rhetorical, Officer) "Am I detained or Free to Go?". Lastly when a cop say's to another cop, we let them go because they were recording us. You would think the cop would ask, "Why, are we doing something shady?"

    its says submit upon the demand of a law enforcement officer. so if a cop demands it, you must 'submit' it which means hand it to them.

    This is how it works in Arizona, ARS 28-3169 says that "a licensee shall display the license". I would think the display requirement would be met when the license is put in the window.
    ARS 28-1595 says the driver has to "exhibit" the license. What's even more interesting is that if you fail to exhibit your license, that's somewhat ok as long as you provide your name, date of birth, address, sex, weight, height, eye color, and signature. I would suppose that a person could just write all of that on a piece of paper and display that as an alternative on the outside of the vehicle. You would have to be willing to go to court and show your actual license later if the police wrote you a ticket.
    28-1595. Failure to stop or provide driver license or evidence of identity; violation; classification
    A. The operator of a motor vehicle who knowingly fails or refuses to bring the operator's motor vehicle to a stop after being given a visual or audible signal or instruction by a peace officer or duly authorized agent of a traffic enforcement agency is guilty of a class 2 misdemeanor.
    B. After stopping as required by subsection A of this section, the operator of a motor vehicle who fails or refuses to exhibit the operator's driver license as required by section 28-3169 or a driver who is not licensed and who fails or refuses to provide evidence of the driver's identity on request is guilty of a class 2 misdemeanor. The evidence of identity that is presented shall contain all of the following information:
    1. The driver's full name.
    2. The driver's date of birth.
    3. The driver's residence address.
    4. A brief physical description of the driver, including the driver's sex, weight, height and eye and hair color.
    5. The driver's signature.
    C. A person other than the driver of a motor vehicle who fails or refuses to provide evidence of the person's identity to a peace officer or a duly authorized agent of a traffic enforcement agency on request, when such officer or agent has reasonable cause to believe the person has committed a violation of this title, is guilty of a class 2 misdemeanor.
    D. A peace officer or duly authorized agent of a traffic enforcement agency may give the signal or instruction required by subsection A of this section by hand, emergency light, voice, whistle or siren.
    E. A person shall not be convicted of a violation of subsection B of this section if the person provided evidence of identity required by subsection B, paragraphs 1 through 5 of this section and produces to the court a legible driver license or an authorized duplicate of the license that is issued to the person and that was valid at the time the violation of subsection B of this section occurred.

    If you pay attention at around 5:00- 5:46 they explain how the police skewer words in their favor specifically the word produce in reference to a drivers license, and how it must be presented. The point the film people are trying to make, and this is something I have commented about many times on similar videos about police procedure, and knowing your rights, pay attention POLICE CAN, AND DO LIE TO YOU. Cops will tell you that you have to follow the rules as they explain them, and often they are not being honest, they will attempt to trick you into admitting guilt when you are innocent, and other tactics to get you to comply with what they want.

    I have never gone through a DUI checkpoint as a driver or a passenger. I have not driven a car since 1998. it is incredibly easy renewing my license. online by phone I'm good until 2022.

      oh yeah the old barley walk. Beer will do that to ya. If those guys had appeared the slightest bit drunk they would not have drove off from the checkpoint, so don't get any stupid ideas.
