  • So imagine this, you call in sick at work, but then a picture emerges of you at the airport, or better yet you post it on your WhatsApp status.
This reportedly happened to a lecturer at an institution of higher learning.
On the picture that was seen to be circulating her caption indicated she wasn't feeling well also indicating that she's about to leave the country.
She's now challenging her dismissal saying she was never at the airport and that in fact this was an old picture.
This isn't the only case, at some point here on the show we spoke to a Union about a State Attorney's office employee who had been on sick leave for seven years and some of her colleagues claiming she was seen in pictures while on holiday.
    Let's explore this now.
Senior Labour Law Consultant, Saber Ahmed Jazbhay.

Hi Saber and Bongiswa, The word "Sick leave" is an agreement between Employer and Employee, it requires honestly, trustworthy. I retired from one of The State Own Enterprises, and i have never hear this story. I use to to take sick leaves, not posting my whereabouts or going town until i report back to duty, but, i think if people became body guards, taking photos and posted to the Employee,: the argument is that there is no proof that the picture belongs to that person.

Only in SA where a common sense issue needs a whole discussion on TV. The IQ continues to drop 😢

Common sense isn't common, that's why we have policy and rules to avoid confusion and ambiguity.
