I have a question for Tom and Kevin that I’ve been trying unsuccessfully to find an answer to, so perhaps they can help. My job has me spending all night making deliveries in “bad” areas that are prone to crime and shootings, while offering nothing but a panic button as protection. I’ve taken steps to make myself as safe as possible while working, including buying a personal body camera that I wear. If I were involved in a defensive situation would I be compelled to turn over body camera footage ? Or would a warrant be required since the camera and what it records is (I think) my personal property? Also, if a warrant is needed is it advisable to turn it over voluntarily or have them obtain a warrant?
My only complaint is not really with the defense attorneys in this situation but rather the prosecutor. Sometimes it seems they make this more of a game when people lives are on the line and I can't understand why any prosecutor would want to lock up an individual for self defense especially when the evidence is clear they did not go looking for trouble rather trouble came looking for them. We as the public hear about cases where prosecutors drop cases against career criminals but attempt to put people who simply defended themselves away for life. Our justice system at times seems to make no sense. Which is why I still refer to it as a legal system not a justice system. Yes, at times it finds justice thanks to the jury system but no thanks to the so called experts.
what’s frustrating is that prosecutors are going to fight a case for the intent of a win, the perspective of a notch in the win section, a career bias. That’s sad and troublesome.

After the Chauvin jurors admitted they lied to be "activist jurors" and the threats that were made against the other jurors, I'm starting to not trust the jury system.
In the past 2 years, we've had multiple cases of people trying to intimidate judges and jurors by doing them and going to their homes. I dont know how that's any different than a mafia guy showing up to a judge/juror's house or their kid's school. The message in either case is "we know where to find you if you don't do what we want."
@@atxjaphotos4217 On that note I completelly agree with you. I honestly was suprised Kyle Rittenhouse was found not guilty. I believe that was the right verdict but with all the people protesting outside the courthouse you know the jurors had to be thinking about it. While I understamd the right to protest it should be illegal to do so to affect a jury's decision as that comes down to nothing but mob justice which as we know is not justice.

What I'm learning is to do everything to avoid having to use guns in defense or just defense in general. The best thing you can do is avoid conflict.
Absolutely. Winning a gunfight is the second worst case scenario (the worst being losing obviously).
Now if only the bad guys wanted to avoid attacking too, you'd actually get to use that policy. But if they break into your home, what can you do?

Grandma was wrong. That's how people get rail roaded or killed by the police. Thousands upon thousands of videos prove this. Worst part is most cops get away with it due to the judicial doctrine of qualified immunity.
My grandma told me when I was very young there's two people in life you should always tell the truth to,
your lawyer and your doctor. Never lie to them.
Your grandma was wise. Not doing so can only hurt you, and seldom if ever help you. A lesson I learned the hard way.

As someone who works in the insurance industry, I can tell you with certainty that telling the truth to your doctor CAN hurt you. I've personally denied life insurance claims on the basis of medical health records. You go to the doctor and tell him that you have sharp chest pains, that gets documented whether or not you remember saying it.

I once got out of a ticket by being nice and answering his "Do you know why" question with "I wouldn't want to incriminate myself". He thought that was funny.
I have gotten off a most times. (Two tickets for speeding in my life). Drive a lot, multiple vehicle types, states, always @5 over.. “I was speeding” the two I got. (And deserved) I was @14 over. Knocked down to 6 over. Half the fine.
A little honesty, respect helps. I don’t say how fast. “I saw you, looked down, I was over”. If asked “looked like 5?” Honestly my pickup 55 fells like 85 feels in the car. I was at 70+ in 55 in car. Said “I have to set cruise control. This car is so smooth. In pickup 55 feels fast. Give me a ticket”. Verbal warning. (I do use cruise in car otherwise…)

Just wanted to take a moment to thank you for posting these videos on CZcams. This past year we moved out of California to a 2nd amendment supporting state. After a few months we purchased our first 9mm. First thing we did after learning how to handle and use it at our local indoor range was our USCCA insurance along with memberships to the NRA and Gun Owners of America. The information you guys provide publicly has always been interesting and now possibly life or life sentence saving. Looking forward to diving into the private member video library this week with my wife and a warm bowl of popcorn.

Really appreciate videos like this. As professionals in most services it's probably good for the client to listen carefully to their advice and then ask the right questions before making decisions. This is great advise. Thank you. And by the way, every police officer gets the wonderful opportunity to have a talk with Internal Affairs at least once during their career. And they learn that you should always have a defense rep present. Even if for the small things. And you want one who sits very close to you with his foot next to yours to let you know when to STFU!

It's very simple. If you're involved in a critical incident you do two things right away. Shut up, and Lawyer up. Your life is in your lawyer's hands so above all, you treat them with respect, and listen to what they tell you.
Treat your lawyer with respect, but do understand that a lot of them don't know anything about guns, or the nuances of self-defense beyond the legal aspects. There are many areas where they will lack critical knowledge and don't know how to argue on subjective things the prosecutor will try to smear you with. You need to make sure your lawyer is bringing in good expert witnesses, and self-defense consultants, who can fill in whatever gaps in their knowledge that they have, and refute whatever crazy nonsense the prosecutor will say to the jury. The lawyer will do the lawyering, but as a gun owner you need to think about what the average random person on the jury thinks about guns and self-defense encounters that is totally wrong, and make sure your case will be a strong one before such a stupid and brainwashed group of people. Prosecutors will use absolutely everything they can to try and put you away. They will say objectively untrue things, and they will probably bring in witnesses to outright lie and spread a bunch of anti-gun propaganda. Judges don't know any better, and won't do a thing to stop it. You need your lawyer to be fully prepared to discredit such witnesses, and refute such arguments, so that jurors aren't persuaded by it.
@fakecubed 100% correct. That's why it's so important to consider joining organizations like USCCA or even US Law Shield. Their program attorneys specialize in that field of law. I watched the Kyle Rittenhouse trial start to finish, and in my opinion there were a few times that he came very close to being convicted.
@@randyschweiss847 Yes, Kyle didn’t have great lawyers. There was some really obvious stuff they missed. He got lucky that the jury wasn’t buying what the prosecution was saying.

With the availability of cameras these days, I personally always wear a body cam. It's saves a lot of brain strain on trying to remember every step of a high stress situation.

@@arthurredfield5093 There's a photographer from a big city in the USA who always wears a camera. He does entertaining videos and in fact that is why he is always wearing a camera. But should he be robbed, or worse, that'd serve as great evidence.
I'm considering getting a dash cam for my car. Someone caused an accident for which I was not at fault, but the other party lied and made it seem like my fault. I had no proof that they were lying, but if I'd had a dash cam there would have been.
Share the bodycam model with us. I've been looking for one.
For now I use my apple watch or phone to record voice when I need it.
All those mistakes can be wrapped into one mistake...Wrong place, wrong time. That's why I personally never get out of bed. 😆

You never forget when they change their story on the stand. Had it happen with a power company target defendant insured. Resulted in a verdict in excess of the policy limits that had to be paid since the policy limit demand hadn't been met. The following day , my attorney had his first heart attack.

Why so much concern on when a client wants to meet with their attorney. I get some of your points, but at the end of the day, this is a very stressful situation for the client, and they are usually paying the attorney a LOT of money for that time.
IMO you are retaining an attorney not buying a slave. You don't own or control their time. Representation is a two way street. You are not their sole reason for existence.
If he's good attorney, he can pick and choose clients-why would he work with clients who meet at crazy times if he doesn't have to?
So what I've heard is that if you plea, you are liable to pay back all the attorney fees covered by USCCA. Is that true?
No insurance company will cover intentional illegal acts. A plea deal is, in the eyes of the insurance company, an admission to guilt, even though to a lesser charge. If you are innocent of committing the crime (you are accused of) you must take the case to trial. I was accused of 3 felonies for protecting myself from 2 convicted career felons high on meth. Took it to trial and won. Fortunately I had been a member for about 3½ years at the time. USCCA paid for everything. Got my gun back and my lifetime carry license back. It's cheap insurance but take it to trial if you're innocent of the crime. Also, I didn't spend one second in a jail cell.

@@jimm.5831 So if you are found guilty, do you have to pay back your attorney fees? I mean jury's sometimes find people guilty who's actions either are not worthy of a guilty plea or are in that grey area. Also, does USCCA cover the appeal? I know CCW Safe does cover the appeal as well.
@@heyboy33333 I really don't know. I would think they will not require you to return any money if you're found guilty. I don't know about the appeal but they did offer to pay for attorney if I needed help getting my carry license back. I ended up calling my state senator and he helped me get that back.
I feel like just like it is our responsibility to ‘digress’ a difficult situation, we should be able to implement the same practice to our own selves if or when we are approached by law enforcement!

I have a good job - $30/hr. I have to work all week to pay the lawyer 1 1/2 - 2 hours of his time. Can the damn courts hurry things up? I mean, WHY does a 9am court hearing start at 10:30am?

Man i agree with most everything unless it is local public defender's. I have set at a restaurant and personally heard prosecutor and public defender talking about a case in which i had knowledge of. That case was lost for the defendant b4 trial started i reported said arrangement and it was never investigated. So that being said always seek second opinion weather it a lawyer or a doctor not enough soace to explain the later
What's fun, we taught teachers all summer so far, they did the Marshall classes, all but 1 passed with ease, the 1 passed the class still, just a bit slower due to age. I enjoy helping them cause so many ppl are talented with a gun but need to by pass the stress they get shooting, after day 2, we stress test them, carsio and a little hand to hand, so many of them do better after day 2, day 3 we do more stress but they over come cause they realize the stress is rough but we are not the target to kill

I work on a farm part time, all 23 of us have to have a CCL, we carry a handgun and an AR15 also in the caliber we like. I carry a 40 cal concealed and 300 blackout. Miss Maye has a friend of mine as a lawyer for us all, she hasn't lost a case yet over gun rights in court and we don't pull our guns unless needed, none of us have had to yet.

As much as I generally like your video's this is one time I might just kinda disagree, or at least add a couple of drops of caution into the mix. Not all attorney's are created equal and not all of them are as competent as we would all like them to be. Unless you already know your "fixer" or unless you know of his/her reputation (and generally speaking the better known they are the more money it will take to get them on your side!), it can be a crap shoot as to whether you're getting a good one or one who is, let's be nice here and say is a bit, lackluster in your defense (this is especially true if you are forced to pick an attorney out of the phone book!). Unfortunately, I have some experience in this regard, and fortunately it wasn't a criminal case... if it were, I would be sending this from jail! I ended up with this clown when my regular attorney suddenly passed away from throat cancer. The pea brain that took over my case was as lackluster as all get out (perhaps because it wasn't a big, money making case? For him, maybe, but it meant a lot to me!). He hurt me financially in one case and flat out screwed me over in another, unrelated but concurrent case! So, use caution when your freedom might depend on how your attorney handles your case. Be involved, know what his/her plan is and how they plan on executing that plan (if they won't tell you it's because they either don't have one or they think you 'did it' and don't think you have a chance... now is the time to switch attorneys!) . Don't just blindly follow what they say... know the options and odds or you might find yourself in a world of pain!

When it comes to self-defense law, remember that most lawyers, even criminal lawyers, are not experts on self-defense. Most of the clients they defend are scumbag criminals who were out to do no good. Most lawyers don't carry guns, and they tend to live in nice low-crime neighborhoods and haven't spent much time thinking about self-defense. Most of them believe the same anti-gun propaganda that the prosecution will be telling the jury at your trial, and won't know how to counter, and even completely refute those arguments. You want a specialist. You want your lawyer working with self-defense consultants, and you want to make sure your lawyer is hiring self-defense experts to put on the stand at your trial.
Quick question doesn’t the uscca fine print say if your found guilty of a charge which I don’t think it fully defines if it’s by plea deal or not they will come after you for whatever money was put out for you and you will owe them?

The justice system today is not about justice, it's about deals. That's why when someone gets arrested for a single crime, they charge them with 15 or 20 counts. That way they can get you to deal and it's a win for them.

I hear you guys i hired an attorney for a charge and did have doubts if he was actually looking after my interests. I wanted a jurior trial in our state and county that is 6 jurors not 12 lol. The whole experience was an education. I did finally take my lawyers advice after prosecutor offered an exspongement if i took plea. It all worked out but the back door deals between lawyers and prosecutors i could hear it and that is when i said what is really going on here.
I got an out of state attorney licensed in my state. No one knew him so none of that "good 'ol boy" back room dealing could happen. I won with a 6 person jury. He hired a co-counsel and they made the prosecution team look like idiots.
You were involved in something which you had no prior experience with. So of course it was disconcerting and worrisome.That and you had to place your trust in individuals I assume you didn't know until then. I too have been there. What helped me was the fact it didn't kill me and thus only made me stronger.
As an attorney at law in four (4) states for the past 42 years, I agree with the above statements made in this video, for what my personal opinion is worth. I'm a Board Certified Civil Trial Attorney in the State of New Jersey and have been so since 1990. Does that make me an expert on gun law? No, it does not. Does it give me some authority over what can happen after you have been arrested in the State of N.J.? The answer is: "yes it does". In the other states which I'm admitted to the answer may be different.
The answer regarding the other States is this: "maybe yes or maybe no".
But I'll defer to our experts above to give you the latest and greatest legal information. All I can say is whether I agree or disagree with them regarding the statements made in the above video. In my opinion, I agree with the legal opinions of those stated in the above video.

The biggest advice is to avoid/defuse conflicts whether you think you’re right or wrong. Avoid locations of likely confrontation situations. The legal risks just are worth chancing a not guilty or innocent ruling.

Say you go out to the range and end up getting a call from a friend or family member or someone. Then they want to go out and get lunch and end up having drinks. Would it be breaking the law if you have a lock box in your car would you get in trouble if your firearm is unloaded and in the lock box?

When I worked for a credit card company in the Escalated Call unit in collections, I loved it when mommy would call and blame us for giving her little 18 year old Johnny a credit card and he decided not to pay what he charged back. Talk about helicopter parents.
@uscca can you advise what happens to your USCCA insurance if you accept the misdemeanors that he references instead of going to trial against felonies? Doesn’t that make it null and void and you have to pay for everything yourself? So your choice is potential bankruptcy or going for the jury/felony trial and take your chances? If that’s the case what’s the point of CCW insurance?

If someones yelling at me and threatening me acting crazy without a weapon but to scare them off if I draw my weapon just so I don't escalate the situation to a fight and to have the person walk away without anything happening but instead of the person walking away, if he runs towards me (without a weapon) even if mines drawn, can I get in trouble for shooting him?

Can you guys do a vid about common traps, pitfalls, oops? For example, schools are gun free zones. I keep guns in my car when I pick my kid up. Is this allowed or if the crossing guard got a bee in her bonnet would I be going to the pokey?
A little lengthy but still good information overall. My question: how do you defend a monster for a client? For example, a Darrell Walker who intentionally ran over more than 40 people, killing 6, at a Thanksgiving parade? Or a John Wayne Gacy? Personally, how do you sleep knowing that you are helping these creatures? Not a judgement, I am really curious.

One of OJ’s defense attorneys was Kardasian. After the verdict, not guilty of murder on two counts, Kardasian never spoke OJ again, not even when OJ visited him on his death bed.

The people that want you to come at ridiculous times or days, the people that come at you with nonsense they found onlinethe people that have a friend that said it should go in like this, the people that will tell you how to do it, ect. The last two are easy to handle though, just tell them "oh, you should get your friend to do it then" or "well, why am I here if you know how to do all of this?". However, I love the customers (usually stay at home women) that come at me with all kinds of ideas from pinterest and that other photo sharing thing they love. It makes the job a little more fun and makes me feel like I accomplished something. Oh damn, I started rambling again, lol.

I dont know about telling your attorney everything. I once told my attorney I has committed thus crime. He got one of two charges removed in a plea deal. And I plead guilty to a felony. I was a naive kid at 18. Years later I realized, there had been no evidence against me. All they had was the say so of a coconspirator that had been caught. He could have picked a name out of a phone book and that was the extent of their evidence. Lousy lawyer was anout to become a judge and wanted to get rid of my case as quickly as he could, and charged me three grand for it. Also, he told me I’d get 3 years of probation and after that I’d get a certificate of rehabilitation and it would be like it never happened. He didn’t mention I could never own a firearm for the rest of my life unless I got a pardon from the Governor of California, as if that was possible.
i have a serious question for anyone who could answer this. i live in an attic and its really hot up here. i don't have anywhere else to go either. im worried my guns are gonna get messed up and i don't have anywhere else to put them . are they gonna be ok and can i keep my shotgun loaded for home defense given the circumstances?
I wouldn't be worries. Look at the guys in the middle east, it's 100+ a lot of the year and their guns seem to still function.

The worst lawyers are those lawyers that take on too many clients and then don't have a clue about your case. Avoid those lawyers at all costs. If this guy's practice is taking on thousands of clients, they won't be able to give you the representation you need.
It seems like a major conflict of interest to me that defense attorneys and prosecutors and judges are all required to be members of the same private club called the Bar Association which has no government affiliation.

If you are innocent you want to avoid the justice system with all your being. Never call the police.
This is why I always advised running away from the scene after a defensive gun use. They can’t build a case against you if you’re never caught.
I have never understood folks who are paying a good attorney but don't do or say what the attorney instructs them to do or say. If you are gonna do your own thing don't hire an attorney.

I asked the legal assistant of the attorney my son hired to ask the attorney if he would suggest to my son that he change his style from homeless zz top to clean shaven whyte boy.
Knowing that the suggestion would carry more weight from the attorney than from Mom.
Attorney suggested & son complied. Charges greatly reduced to fines & time served.
Cops are not your friends and neither are lawyers. That should be the first thing a gun owner learns. They are public servants and not the fiduciaries they portray themselves as. If a cop says he wants to help you, be very suspicious. Better yet, shut up and ask to speak with YOUR lawyer.

Had to laugh when you said cops made some of the best clients. I was on a jury once and if I went with the cops testimony the man would have gotten off. Too bad for the accused he decided to testify on his own behalf and managed to talk himself into a conviction and jail time.

@@davesomeone4059 umm, he said he was laughing at the thought that a cop made a good defendant, then used a story where the cop was a witness. Those are 2 fairly different positions to judge one based off of the other, at least in my eyes.

I'm going say this again I'm not going any details of self defense incident I was in just because I don't like talking about it and I was fortunate and everything worked out smoothly but the night that incident happen I gave the basic information I needed to give them and then when I was asked go down and give a written statement I went down to the station but invoked my right to have counsel present which I have to say the detectives didn't get upset or nothing like that I was finger printed and released to go be with my family about 2 day later I gave a full stement with counsel present of the incident and followed advice of the attorney theough that process when attorney told officer were done with question we were done but the key is to seek legal counsel if u are involved in that situation qnd follow rule of thumb loose lips sinks ships
You remind them of the federal civil rights lawsuit under 18 US CODES 241 and 242. And you use 18 US CODE 248 in court to file a move for a motion of dismissal on the grounds that your civil rights has been violated when arrested on the spot like you are guilty first till proven innocent. That violates your civil rights. You are free and innocent by the highest laws of the land under Juris Prudence. Not under ADMIRALTY LEGALITY LAW. We have to force them to have us under the Juris Prudence of Common Law. All judges are bound by Juris Prudence Law.

You have THE RIGHT TO REMAIN SILENT. USE IT ... right after you CLEARLY and EXPLICITLY claim your RIGHTS under 5th Amendment.
If you are having an interaction with police he should be telling us to utilize your fifth amendment rights. Your words will be used against you in a court of law, so don't give them additional information to use against you. Provide as little information as possible because you don't know if that cop is on your side or not.
Obey the law. Avoid conflict. Politely invoke your rights. Obey the law. Give your attorney (and police) firm ground to defend you. Did I mention obey the law?

I learned years ago. Just because they have attorney in their title doesn't mean they can be trusted or will work in your best interest. Choose your Defense carefully. Some will make your case seem like not worth it and get you to settle or plea deal n run away on an exotic vacation with the $ they made off you. I'm not saying all attorneys are like this but choose wisely.
