The order to assault a fellow marine violates the UCMJ making it unlawful. Marines have no obligation to follow unlawful orders and will be held responsible if they do.
That may be true however if you are a rookie and your commanding officer orders you to do a code red, what do you think would happen to them if they objected to the order given to them? So yes technically you are right. But practically, I’m not so sure about that. Throughout the movie one of the main themes of the movie is chain of command. They all pretty much stressed it throughout the film. Military court sure seems like a different kettle of fish. People don’t like Cruise. I get that but in pretty much everything I’ve seen of his he’s good. I make it a policy not to idolize any celebrity. People praised Harvey Weinstein and look at the monster he turned out to be. All my heroes are my family and friends. People I knew personally. Actors it’s strictly about how good they are at acting. That’s it.

Hearsay is only used in reference to evidence being entered into court, usually through a witness. The opening argument is just the place that the lawyers use to tell the story that they intend to prove. Any evidence referenced is evidence that they intend to introduce. Lawyers usually have quite a bit of latitude on both their opening and closing statements as they aren't allowed to introduce new evidence in either of them.

As you said "you gotta poke the bear a little." & Danny, though lazy about cases (especially one that had no chance in court & that Division & the Corp wanted to be made to disappear asap) was always a talented lawyer, & both Jo Galloway & Jack Ross knew this.
The irony here, about Dawson & Downey wanting their "day in court," was that they basically ended up getting exactly what they'd have gotten, had they let Danny take the deal that had been offered by Jack.
Fun fact, the Geneva convention, and the US military codes of conduct both clearly state and defend the rights of soliders/Marines to refuse to follow an order that they feel to be unlawful or unethical. Sadly, most soliders do not exercise thos right. Mostly because the double edged sword of military discipline forbids standing up to a superior officer.
the other big issue is often your superior is going to ask you to do things you don't understand because they have more of the big picture than you do so you really have to be able to just trust that they know better and have your teams best interests in mind so its a really slippery slope to start the questioning game.
obviously this situation is extreme but as a general rule, soldiers arent second guessing all their orders.
One very easy way to remember the conversion from 12hr clock to 24hr clock, is the number 12. Anything from 12noon to 11:59pm, you add 12. So if you wanted to know how to say 4:30pm, you add 12 to the hour and it becomes 16, or 1630hrs. It also works in reverse. If you have a time of 1815hrs, you subtract 12 from 18 and you end up with 6, or 6:15pm because its after 12 noon. (it only gets confusing when dealing with 12 midnight. There is no 0000hrs. If you work from 4pm to midnight, you would say 1600-2400. If you start at midnight and work until 8am, you would say 0001-0800). I served in the USMC during the 1980's. Being Dishonorably Discharged is the worst thing to happen to any service person. That stays with you the rest of your life and really limits career job opportunities. The best thing Dawson and Downey can hope for is an appeal to have their discharged changed to Other Than Honorable.

I was in the military. Code Reds happened all the time. The worst was a "blanket party". That's when you put a blanket over a guy and beat him until the blood bleeds through the the fibre. I only had to it once, and that was because a female soldier was assaulted.
at 32:55 when Cruise asked "Did u order the code Red"!!........i was perplexed when the Judge said to the Kernal " You don't have to answer that question". wtf??? the Kernal is under oath and has to answer that question that was the whole reason for him being there!

Great movie. You should see other legal dramas like Rainmaker 1997 or Civil Action . Also a great lawyer movie with Tom Cruz is The Firm. and Murder At First 1995 a movie based on true movie about injustice. Also Erin Brucvich is a great movie.
I can attest to "Rainmaker" - weird that that came up, as I just saw that again - after 20-odd years - last night, and it was surprisingly excellent, certainly better than I remembered.

I was still in the Navy, when this movie came out. The Navy was cracking down BIGTIME on s3xual harassment, thanks to the Tailhook Convention scandal. The remarks made by both Cruise's and Nicholson's characters to Moore's character, would have caused them enormous career trouble.

Judge Advocate General ... on every base, port and post. What attorneys really do outside the courtroom? Very well acted and edited. And the SP/MP ... Security Police and Military Police ... military personnel can be up to no good. Chain of authority and doing as you are told, is completely serious.

oh Maple, military time: 24 hr clock. anything past noon subtract 12 to get the 12 hour clock equivalent. the director wanted a romantic element between Demi and Tom's characters. to follow the hollywood formula. but the two power actors objected. saying it didn't fit the chemistry of their parts. so we get gret performances from all top grade actors without the hollywood cheese.

This is about the Boston Globe newspaper's team that discovered and publicised the Catholic Church's efforts to hide its problem of pedophile priests. It won Academy Awards for best picture and best screenplay
I switched my phone to the 24 hour clock (military time) back in high school just for kicks. At first you have to count it out, but after a while you just get used to it and it becomes second nature. Back in high school if I saw 1600 I would have to do the math in my head (16 - 12 = 4pm). Now I can glance at 16:00 and automatically register it it as 4:00pm.

As a Marine you follow orders it's that simple good or bad. We had a guy in our unit who wouldn't bath he go right to bed . We threw a bucket of soapy water on him in his bed . He bathe after that.

A great movie that is an adaptation of a Theater Play.
Hearsay is unsubstantiated information you receive from a 3rd party that you try to offer as valid evidence. (It's not). For instance, if someone says in court, I know person A is guilty of shooting person B because when I showed up where the murder took place person Z told me all about it.
The police would need to track down that person and have them identify the murderer in a line-up or photo array and only then could their statement be offered as evidence. They would also likely have to testify in court of what they witnessed.
The purpose of an opening statement is to offer an outline of what evidence will be provided over the course of the trial so that the jury may follow along with the case more easily and hopefully make a more educated decision.
If an opening statement was entirely hearsay, or contained hearsay, the attorney would probably be given a warning then have their opening statement be stricken or similar.
The opinion of an expert who actually examined the body is also not hearsay.

Military time. Just subtract 12 from anything above 12.. 2200 minus 1200 = 10 pm.. easy peasy
In reality, Danny’s discourteous and cavalier attitude towards his superior officers would not be tolerated in the Navy. I found Jessup’s “You have to ask me nicely” reaction to be surprisingly tame considering how snarky Danny was being that entire conversation.

One point that seems to be missed in all this is that Santiago's death was an accident. No one wanted him to die. The code red wasn't meant to kill him. A code red was issued by an officer. It is a practice while technically against Marine policy, it is considered common in the Marines, and it is accepted by both the soldiers and officers. (according to this movie. Im not a Marine, so I can't speak to the actual facts on this matter) So Jessup ordering the code red wasn't some big cruel infraction. This was an unfortunate incident for all involved. Mostly for Santiago. But Colonel Jessup, while obviously being an egotistical ass, was a very good commander. And him being reprimanded would likely weaken the military. But he should've just been honest about the whole thing from the beginning instead of committing this huge cover-up. Because as is often the case, the cover-up is more damaging than the crime they are trying to cover. Col Jessup would've gotten a slap on the hand if he just told the truth. The higher ups know his value and wouldn't throw the book at him.
Right but in the movie he is up for a promotion and is in line to get moved into a national security advisor role, that would have been messed up in the least, so the cover up, and even before doing the transfer they got the doctor to say poison. After that there was no walking it back.
@@mikes1487 Well that's kind of my point. The fake transfer, the doctor saying its poison, all part of the cover up. I believe he was in a high enough position with enough backing, that if he was honest about it from the start, he probably would've been fine. Technically he never said what was to be done to Santiago. Leaving it to his officers to do whatever was necessary to "train" Santiago. There's enough ambiguity there to escape any real consequences.
Subtract 12 to do military time
