Young Thug Judge Green Lights Rap Lyrics as Evidence in Heated YSL RICO Trial

- In court on Thursday, Judge Ural Glanville ruled that song lyrics may be used as evidence throughout the heated trial involving Young Thug and members of YSL. The rapper and many of his co-defendants are being charged with violating Georgia’s RICO Act, among other crimes, such as being a part of a criminal street gang.

First of all, it is never used as sole evidence. Secondly, as explained by the judge, its admissible because it proves mens rea. For this purpose, lyrics are as admissible as any journal, blog, or diary.

The lyrics tells stories however they have link specific things and people which creates a gang and activities like predicated crimes as a single unit or gang and no such thing is present circumstantial at best but not to convict one and more for gang related offenses or Rico crimes

Yes, this is not the first time lyrics/video has been ruled admissible. The defense still has the ability to object during trial prior to admission of each individual exhibit.

Judges tend to have a handle on evidentiary issues like this though each case is different. The general issue of admitting rap lyrics has been around for a while now. And there’s briefing usually so what you see on the bench is a mix of experience and some prior preparation.

@@kennethsimon6930exactly! Well said…these are standard procedure, routine, pretrial motion hearings. Seems some don’t understand a judge is basically a referee of sorts in these proceedings. It’s not as if all the the snippets are automatically admissible. Prosecution must lay proper foundation for each exhibit, and defense has the ability to argue over each exhibit at trial.

I'm really torn on this part of the trial. OBVIOUSLY his lyrics speak of real life things him and YSL have done. IMHO it's art. It's not them making affirmations.
Sort of like(but not quite) if someone painted a crime scene vs having a photograph of it.
One is just a painting. It /COULD/ all be in their head. The other is proof they were there to take the photograph, or know someone that was.
Only exception there, is if in the painting, they include a detail that was hidden from the public. That might indicate they were there too.
With rap lyrics, unless they mention something in the lyrics that was held from the public, implicating them in some way, simply saying "I shot him dead" in a song is just that, they're simply saying it.
Admissibility of evidence is one question. The next question is how the fact finder will interpret such evidence.
