    I do have a question you didn't touch on. Can you be trespassed from a publicly funded building such as a town hall or police department if it's within operating hours, in a publicly accessible areas, have not physically obstructed business and have not committed any crime while on the property?

    I was charged criminal tresspass 1st for silently recording outside of a post office. Lady came out screaming, you can't record this is federal, etc. Police came, took her statement didn't even ask me what happened and arrested me. Only no tresspassing signs were posted above an entrance to the loading dock. I stayed entirely in the back parking area checking out a large truck that pulled in. They then decided to seize my phone. I go to court tomorrow

      @@TheLanceLawyers in Connecticut. I was just hoping for some clarity. 1st, DHS memo 2010 and again in 2018 allows us to record exterior and interior from public forum, wouldn't that include parking areas? Also, aren't we allowed to record our government/public officials in the course of there duty? How can I be told to leave the property without committing any crime and just silently recording? My intention, which I was doing all day, was to talk to workers during the new mask mandates we have and although closed, the postal workers were still loading trucks and delivering mail. Lastly, the officer increased my charge from simple trespass to criminal 1st, breach of peace and interfering, all because I didn't want to identify but he kept pushing that I had to. I finally said OK I just don't have ID on me but I will provide information, and he arrested me anyway. They seized my phone and have had it for 10 days. I spoke with a sergeant who said they have no intention of a search warrant and could care less if it is returned or not. I had court today and had to get a public defender but nothing was done and I didn't even talk about my case, I just got a continuance all the way out to 11/29. I have a new small business and rely on my phone, as well as accessing my email as Gmail now makes you get a verification code sent to your original device in order to access on a new one. I just do not understand the exigent circumstances to seize my phone when it is MY defense, or how they can just hold the phone for no reason whatsoever. I understand they say it contains evidence, but the Sgt openly just said they have no plans of even trying to get a search warrant so what on Earth is going on here? I feel completely violated, my first and fourth ammendment rights completely.

    someone responded to my Craigslist add where I was looking for private property where I could park my trailer and live in it. the man that responded took me to an unkempt property with grass overgrown there was no "no trespassing" sign anywhere on the property. just a boarded up house in the middle of a tall grassy field. the man told my friend and I it was his property and we negotiated that for $80 he'd let us park and live on the property for the rest of the month. long story short he wasn't the real owner because the real owners came with the cops and charged us with criminal trespassing. we got totally scammed and now that we've lost the last of our money and have nowhere to park our trailer we're back on the streets. what do I do?

      @Chenzni So sorry to hear about that. That is totally unfair. Make sure to tell your attorney what happened so he or she can use the defense of no mens rea which means no criminal intent.

    I recently entered a hair salon to speak to the owner about giving a false complaint to police about a employee of mine .while I was at the justice center a cop walks up and asks for my ID and states I am criminally trespassing you from that business. Is that legal or was that officer misquoting the law ?

    Explain the Public Premises Defense. (RCW 9a.52.090(2))
    In Washington State, do we not have specific liberty interests to the full enjoyment of a place of public resort, accommodation, assemblage, or amusement? (See Segaline v. Dep’t of Labor and Industries,(2017); State v. R.H.(1997); State v. Mitchell, (2018); Cox v. Louisiana,…S.Ct. …(1965)). If a place is open to the public, do they not need to have a legitimate and lawful reason to issue a trespass notice to a member of the public? e.g. non compliance with lawful condition(s) imposed on access, violation of law, or disruptive behavior. Do local LEOs need to facilitate procedural due process? (e.g. State v. Joseph Tree, Inc.(2018?)) Is it not true to say that we have specific liberty interests to the full enjoyment of a place of public accommodation that cannot be arbitrarily taken from us? Is it not true that if a member of the public is in compliance with all lawful conditions imposed on access to said premieres, and not violating any laws, that we cannot be lawfully trespassed from such a place of public accommodation or assemblage? (e.g. State v. Green. (2010); State v. R.H.(1997), etc.?) When is trespass notice unlawful?
    The law does not appear to condone an arrest for criminally trespassed that is based on an unlawfully issued trespass notice.(State v. R.H.; Cox v. Louisiana).
    Private businesses that are open to members of the public do NOT reserve the right to refuse service to anyone for any reason at all, or for no reason at all.
    Real RESIDENTIAL Property is another matter altogether.

    I went into a construction site and made a video and put it on my CZcams channel. Actually I made several videos and put them on my CZcams channel. The contractor of the house that I videotaped called me and told me that I was trespassing and he could call the police if I didn’t take the video down and charge me with trust passing was I trespassing? All I did was walk in take a video put it on my CZcams channel that’s it is that trust passing. There are not any no trespassing signs on the property no fences nothing that would stop me from going in there were no doors or windows on the house. Can I get charged with trespassing. I love your videos I’ve been watching them for a couple days

      @Drew's Roofing: Good question. It could be trespassing if it appeared you were in a place that would make sense that the public was not allowed to go. No signs weighs in your favor, but may not be an absolute defense. As with so much "law", it is fact dependent, and in the eyes of the beholder.     More so like I'm trying to find my rights as a women being stalked by my child's father and he keeps jumping my neighbors fences to get into my backyard, hiding in sheds,under benches, behind a tree on my roof, harassing me, but while hiding or running away, I find his things all over the place,his shoes were on my rooftop last week, a ring of his in my bushes in front of my window, he's stolen multiple security cameras, my motion sensor lights...a pack of cigarettes just messing with me, and oh ya, I've told him point blank he's not to be on my property unless I've invited him and say it's OK. He uses our child as his way to invade my privacy, following me, he keeps trying to tell me I'm with someone, when I'm alone and it's just weird and idk why I feel so obligated to defend my honesty, it wouldn't matter even if I was with someone, idk, he's obsessed, it's gotten scary...we have a child together though, and this is just too dang uncomfortable for me to try ignoring. I think he's on drugs, and that alone is what's gotten me looking into legal options...he's a good dad, but not when he's being like this with me, He puts any of his crazy actions before anyone's well being
