For anyone here- I don't think this person knows how nightguards are supposed to work or how the jaw works. NEVER open the mouth straight up. The jaw is a hinge system. The nightguard would be too bulky in the posterior and only 1-2 teeth would actually be touching the nightguard.
I had the same observation. He just willy nilly decided to raise the upper arch relative to the lower from maximum intercuspation. The mandible cannot move that way.

Its physically impossible to move the max up .5 mm. How can you justify that?

That is an incorrect statement……. The mandible only hinges for a couple mm’s and then it translates
