Whenever people talk about “ugh, they only got probation” I don’t think they understand what probation is. It’s not a holiday, it’s not a get out of jail free card, it’s like being grounded as an adult. You can’t go anywhere you like, you can’t be around certain people, you have a curfew, you can’t drink, maybe you can’t drive, you have community service or program hours to complete, and you better report or be available for visits. That’s not just “getting out of jail” and defendants who peacock around like they beat the system will have a rude awakening. “Oh so like, that’s it? If I violate probation I just go to jail instead?” Yep. It’s that easy.
Yurp... SUPERVISED probation CAN BE no joke... until you pay your fines, then it's on to unsupervised where you're basically just free again but in double trouble if you get arrested during the probationary period.
I think I’d agree to an all cardboard diet before doing 10 years in prison. I get your point, but on the flip side of that I believe people who receive probation should consider themselves enormously lucky considering the alternative.
The problem is that judges are inconsistent. Too many people get probation when they don't deserve it and far too many get extra chances after ignoring their responsibilities.
Most judges are way to lenient, which is why kids think they can do probation if they feel like it. If our legal system got more strict, yes prisons would be more full for a while, but it would send a message that we are serious now, which would lead to a drop in these foolish crimes (including sov cit nonsense). Start dishing out maximum sentences on everything.
