- The jury is off today but we're back for the Commonwealth's requested voir dire of the defense accident reconstruction, human biomechanics, and pathologist experts. After the bad joke that was Trooper Paul's testimony over the past two days, it's hard to imagine that the Commonwealth is continuing to challenge the qualifications of the defense experts - who possess multiple PhDs and medical degrees between them - but since they've raised the question, we're going to get a preview into the experts' qualifications, the bases for their opinions, and likely the opinions themselves before Judge Bev decides if she's going to allow them to testify. After nearly 8 weeks of the Commonwealth's Lallybye, I think we're all ready for a little preview what the defense case will bring to the table.
For Bev to say Dr Russell struggled with her testimony is hilarious after watching Paul 🤦♀️
Right? Her "struggle" was some brief hesitation and stammering while she carefully chose her words. That's Paul's baseline.
I think Bev was acting as an agist. Seriously, she took issue w this woman’s retirement. Wounds don’t change. Treatments do! As someone who did trauma care for decades I’m outraged w the treatment of this woman w credentials, published articles that were peer reviewed. Ugh! I need a walk! To walk my 70lb canine!

Dr. Russel didn't struggle. she is so beyond struggleling, you feel intimidated Auntie Bev. We all felt it, you know, to a degree. But some of us have integrity and think beyond that and be proud of what other people can accomplish.

Upon reviewing photos during voir dire… what people need to remember is that there was Jersey material that would gather at elbow, when pulled downward from dog hanging, this would bring concentration of material to lower portion of arm so we see stronger insertion marks of claws & or teeth w bent arm, closer to inner aspect of arm. Bite would be able to make deeper impact. Wrists are below elbow’s hinge joint which can allow victim to lift arm w hanging dog using teeth & claws; dog jumping to grasp again & again. The wrist injuries show more of an angle bc of that hinge pull of elbow. JOK most likely employed pulling motion to protect himself. Add thicker cuff material present from Jersey hoodie (think of thicker cuff elastic) which adds a layer of protection as compared to Jersey material that was punctured. Bev took issue w Dr’s use of word bite w material versus use of word hole. Right then it is apparent that Bev has already made up her mind to exclude this expert witness. She will opine on inability to get over Rule 14. She’s quibbling over whether it was day 3 or 4. Then quibbled w Yanetti re which day she told both sides to have all materials in. Yanetti says “the day before,” referring to when jury began to be chosen. These photos are from a canine… not anything from an SUV outer body or under carriage. I spent 60 plus hours a week at my hospital & worked as rental RN at other Detroit area hospitals so worked a normal 70-80 hour week. I’m telling you w all I’ve seen & taken care of… being director of tissue integrity task force at my hospital, that these wounds are from canine & not a 25lb canine! I wish I could show the jurors why these angles, 3 puncture holes I see w magnifying glass, shape of abrasions, depth of somewhat parallel wounds…as it relates to outer garment, I wish I could show them & explain why each looks as it does. More importantly what we’d see if these had been from anything other canine.
Andy!! Could you get your findings/opinions to Jackson or Yanetti's office?? That's how they found Dr Russell, of course!! Regardless of how the court wants to characterize the Dr's interest in participating in this case. Dr Russell said clearly that she offered her help if it would prove useful to the pursuit of the TRUHT.

And I concur 1000% with all your analysis. They Canton Brain Worms Crowd makes this all seem hard and complicated but the TRUTH HERE is actually fairly simple as proven by these real works witnesses today. Light, breezy testimony...Easy Peasy. I am no dog bite expert but just based on my experience of life with family digs- Golden Retrievers, Rottweilers, Yorkies etc, the bites and scratches from playing with puppies and dogs..and one time being actually bitten on my posterior calf, as soon as I saw pictures of the alleged Chloe marks, it was clear as a bell to me that they were dog bites...no question. I could send a pic of the arch of the upper fronts and the 2 punctures from the lower canines on my leg. The pattern is still, 30 years later, clear as a bell...these people are LIARS!!!!
This trial reminds me a lot of Depp v Heard. Most people assumed the stories about Depp were true and gave Heard the benefit of the doubt. Anyone who said her bruises were fake would have been seen as conspiracy theorists.
But after watching the trial many (including myself) began to see that the initial picture presented-and held up by legacy media-was false. No matter what public opinion said there were articles supporting Heard and misrepresenting what had happened in trial. I had the same feeling then, I guess gasslighted usthe best word I can think of. We’re being told not to believe our eyes and it’s so frustrating.
at least in that trial the judge was fair. although Lally what if anything he got from Ambers lawyer. ugh.
Lally implied Dr Russel wasn’t being truthful that she hadn’t heard about this highly publicized case. Wait, don’t you have a jury that has sworn they weren’t knowledgeable about the case, or only had vague awareness? Which is it, Mr Lally, sword or shield?

This trial should be the last for both this Judge and Lally. The Commonwealth has changed their theory multiple times during this trial. Also, they submitted the hair analysis late. A day or two before the trial, they had 2 years to complete testing but expected the Defense to be able to get it tested within a month, during the trial (Lally stated that)! That’s just one appellate issue. They mislead the Defense knowing that Chloe has been in Vermont, and did not allow the Defense to have access to the dog to perform testing. If this was the Commonwealths motion this Judge would’ve ruled on the bench. But nope she has to inconvenience these experts. It’s very clear she is biased. This is the same Judge that took 5 mins to review the inverted, Sallyport video and allowed the jurors to be mislead. The Commonwealth has tried their theory for an entire month, let the Defense put out the facts, supported by qualified experts!

I am furious at this judge! This is absolutely NOT okay. She is down there next to the judge in the young thug trial in terms of the respect i have for her at this point (which fyi is less than zero).

So because the first witness didn’t use “to a reasonable degree of medical certainty “ fast enough for the judge she may not allow her to testify. That isn’t a medical term, that’s a legal term I believe.
I feel like the judge was implying that she was looking for her 15 minutes of fame. Please, Dr Russell was qualified and honest. Unlike some of the prosecution witnesses.
Dr. Russell actually said "a HIGH degree of medical certainty." Auntie Bev used the courtroom's poor acoustics and the witness's age against her to put words in her mouth and on the record.

The doctor did not struggle with her opinion at all, she was clearly just nervous and the judge was talking over her as she tried to answer. This judge has a really concerning habit of misstating what was actually said and done. I am also just disgusted by how her and Lally seem to be a team and how she is so worried about his time when he’s wasted so much of the court and jury’s time.

Bev really showed her bias today. I just hope she doesn’t show it ultimately in her rulings. If these witnesses aren’t allowed or are only alllowed very limited testimony, Bev is directly participating in Karen’s frame-job.

Things I don't like about the judge:
1) Overt bias. She favors Prosecution in terms of objections sustained & overlooking breaches of protocol & patience with time & repetition expended in examination & in her tone when addressing the lawyers- - as if her idea of the equal scales of justice is to offset an unfair advantage of 'innocent unless proven guilty.' Perhaps she sees 3 advocates for Defense & 1 advocate for Prosecution & feels the need to make up the numbers.
What goes on in her head?
2) Time management. Yesterday the judge regretted not knowing the voir dire would only last half a day because jurors could otherwise have been convened for an afternoon session & make up some of the court time lost, & it's the 2nd time she's made this observation. She said this as if the fault lay with the lawyers. That she did not foresee this possibility & make provision for it is down to her lack of foresight, but owning an error seems beyond her.
The judge has shortened several sessions & dismissed jurors early as if court had lots of time to spare; then impatiently reminding lawyers that time management remains her concern. As more time is wasted, this makes the calendar target of handing the decision to the jury more of a pressured deadline which will pressure the Defense case, after the judge has allowed Lally to linger on every point like there all the time in the world.
Having allowed Lally unlimited license to drag the hours by like dead animals, there have been signs of her pressuring Defense to move it along already.
Chat now fears the judge will impede the Defense case which is already a meager time allotment by further hastening the speed of direct examination - - while allowing prosecution Cross to dawdle over minutia.
3) This judge patronises the jury as if jurors were on a bouncy castle in Bev's back garden. She patronises Defense lawyers like hearing their argument is a tiresome privilege she can revoke any second. She has now patronised expert witnesses as if they too were on her bouncy castle unequal to her own intelligence, when in fact the judge is unaware she herself is coming across as ignorant.

What if Bev says she will not let these witnesses in and denied the defense a response to the CWs witnesses testimony? The jury needs to hear from a qualified medical witness and accident reconstitutionist (especially after the dismissal testimony from Trooper Paul with his 120 hours of training not the 1000 needed to be an expert.)
Then it becomes an extremely strong issue on appeal should the jury convict. It would seemingly be a patent abberation of judgement based on the existing case laws regarding this exact topic.
After trying to piss away Proctor's issues with the royal "wee" on the investigation end I find Lally taking issues with the use of "we" in a collaborative, co-authored report by actual professionals to be patently absurd. Also, Mr. Lally, inconclusiveness is a valid conclusion if there isn't enough evidence. Not everything can be made "cut and dry" no matter how badly you want it to be.

Where elastic cuff would rest on his wrist, I guarantee there isn’t a tooth hole in that elastic. The canine’s teeth punctured Jersey but was unable to successfully grip through the elastic wrist of his hoodie. It jumped up on him at least 5 times during this attack. It happened fast then either he fell back or was knocked back w only 2-3 witnesses in basement when this occurred. He was rendered unconscious after vomiting while upright from bottom or still standing before collapse. The Alberts are awful. I’m sorry. Bring Chloe forward if there’s any humanity left in any of these people!
100 I have rescued GSD for 20 years I have bred working line German shepherds and done protection training. Those are dog bites from dog attack lacerations. 100%. Although I will say I think the men were also attacking him because John had bruised knuckles and sustained two black eyes and A cut above his nose, so I don't think the dog is what killed him. I think the men punched him so hard he fell back or while they were punching him the dog was also attacking and he lost his balance and hit his head on the basement floor.

Maybe John kicked at dog which ticked someone off in that basement then fight began. 7 mm laceration above right brow and 2 cm laceration near bridge of nose; 2.5” laceration to occipital region which if fractured the basilar skull bones, this would crunch in that outer duramater of brain that has thing network of venous supply. Deeper bleed from major fracture to skull, would eventually, key word eventually, bring about swelling in bilateral orbits of kids. Soft tissue becomes place for leaky cell fluids to spill fluid. Kerry Roberts’ testimony that the “right eye was more swollen than left” (where he had two lacerations-above brow 7cm and by bridge of nose), shows me a punch most likely did this. Left eye swelling causing raccoon eyes develops within an hour of massive IV infusions & compressions done manually bc his brain stem was herniated by then. The spinal cord comes up into skull through a hole. If swelling in that region occurs then path of least resistance is that same hole the spinal cord comes up through. When this occurs, the person goes into bradycardia, then eventually asystole (flat line). Any breath sounds documented was just showing in notes that the endotube was placed in trachea and when forced air was sent into John’s lungs, sounds can be heard bilaterally. Doesn’t mean he was breathing on own or could. Have seen dog attack victims during fist fights. Dog jumps into help the one they know or get food from. In this case I can imagine BA thinking OMG, what do we do then 3-4 people went into damage control. Hard to get rid of body without witnesses. Also glass on bumper like any crime scene that looks staged, was. Not someone most likely who was present but someone willing to say enough of this attack or thought that Alberts involved & so sprinkling of bar glass here and there that didn’t match the piece of cup shown at trial by glass maker. The med weren’t thinking. Drunk and panicked. If they tried dragging him elsewhere by car too many others would be asking questions. No tail light that I’ve seen involved in skin tears hasn’t left a tiny fragment or at least had some 4x4 sm pieces embedded in clothing. Outline of bumper, nails, plate, framing of back of vehicle, even a flat one would have left outline on him despite his loss of 3 liters of blood. He didn’t have time to bruise around bite marks. So much from my two decades of trauma first hand inspections w forensics being something I took upon second to study outside of hospital. Went to conferences and paid big money to hear from MEs so we didn’t ruin evidence. Learned so much but no expert. Just experience & not dumb. Lol. Had 4.00 all through college/ university/ and gave grad speech. I wouldn’t be this long winded if I didn’t see way too many holes in this story. Not mention holes from canine shaped teeth on inside part of arm closest to his non hairy part where the canine grabs w maxilla, uses mandible to hold. Enough from me. Reasonable doubt in my experienced opinion.

It's as if Lally can't fathom that a professional would have actually reviewed 14 documents provided tom them in the scope of doing their analysis. Maybe he did think Trooper Paul was a scientific expert. Judge is unbelievable Is there some purpose in her need to review the witnesses prior testimony in MA? What was that all about? Is she hoping to find something, is she just studying up, so she'll know how best to help her monotone favorite? If a man hadn't died, and a woman's liberty wasn't in jeopardy, it would be funny. and here comes a sad truth, John’s, family, and friends will not know what really happened. It will be swept under the road. Karin will take years to reestablish herself because of the damage that the commonwealth has done to her. Two families lost the truth because in my opinion, this time is much as I love the blue, they did wrong. They did not do their job. They were too busy trying to cover up then to do the real job and let the chips fall where the truth brings it

From day 1 I felt the judge is biased against the defense, but is trying to play it cool because its being live streamed. Shes walking a fine line, imho, but not fine enough. Its evident to anyone watching.

I wonder what these jurors will think once they've reached a verdict and are free to look at what they find about the case online??? Can you imagine having to decide if Karen Read is guilty or not solely on what the Judge and the Common Wealth had the opportunity to show you or what witnesses or testimony were excluded? I suspect it would leave a bitter taste in anyone's mind this could have gone down as real injustice and after seeing this judge in action. They all should be able to raisse the point, this judge helped the procecution and shut down the defence who had the right to defend their client. It's so unfair I want to pull my hair out seeing this happen.

I rehabbed a bite history adolescent GS mix from a shelter and he laid a few of this type of marks on me back in the day. There is a frenzied bite pattern that happens from a dog not trained in bite sports that is a mix of shallow and deep bites alongside tearing injuries and bruising appears after a few hours.
100 correct. I've rescued German shepherds for 20 years and have bred working line German shepherds and done protection training. The regripping over and over shows that the dog was not trained in bite work and is very typical of a full-on attack with multiple patterns of lacerations from different angles and I noticed the maxill teeth connected tearing out his flesh.

Hi Andrea! All three of these experts are heavy hitters for the Defense especially the accident experts!!! Their company and expertise is like the NTSB!! I worked for the company that designed and manufactured the Energy Absorbing MWAP seats. The testing is intense and extremely extensive in order to keep our Troops safe as they serve our country. Mr. Lawly does not want to allow these experts because he knows his case will be OVER with their evidence findings.

It makes me feel ill that the judge is implying this expert is basically looking for 15 minutes of fame!!! That was totally uncalled for. Judge Bev should be ashamed of herself!!
I think Bev knows that there are huge repercussions to follow once KR is acquitted. The Local LEO's didn't just start acting dirty all of s sudden. Hundreds if not thousands of cases will be retried. Nightmare...
I believe her refusal to make a decision while on the bench is to give her time to confer with Morrissey and search for any legal way to hamstring the defense.Hopefully I'm wrong and she does have integrity we'll find out on Thursday.
Judge C is the platonic ideal of a terrible boss: controlling, unpredictable, condescending, and uninformed.
Her contempt for the defense is palpable and I have a theory as to why:
Bev probably sees AJ as a hot shot lawyer who defends despicable people like Weinstein and Spacey so he’s not the lawyer you call when you’re innocent. Yannetti likely has a similar reputation considering Proctor already hated him before this case really began. I’m sure you’re very familiar with that attitude Andrea.
I also think that the defense’s motion for her to recuse herself is something she took very personally. Even if they have a rational basis for doing so; rumor has it that Bev’s brother was the defense attorney for one of the Alberts in the 80s. The Albert blustering about knowing her likely was overstating their relationship so the motion entrenched her bias against the defense even further.
My perception is that Bev sees herself as another victim of the harassment so she allows the witnesses to testify about it despite both parties agreeing to exclude the topic pre-trial. I’m also sure it has been genuinely hard for her and her family! Some people online see the people on the screen as characters and not real people that they can emotionally impact so they can say whatever they want.
I don’t think she’s in on a grand conspiracy with the Alberts. She’s a neurotic and kind of incompetent person who’s neck deep in confirmation bias so she’ll give the scale of justice a tiny little nudge to convict someone she’s already decided is guilty.
I don’t envy Karen. If I were her I would be very scared that being convicted of the lesser charges would result in the maximum sentence from this judge. I wouldn’t be surprised if she cited the harassment towards her and other witnesses during sentencing even if it’s improper.
So, basically, just another Canton, MA see ewe next Tuesday. 🎯

IMO. The reason the judge is rooting so hard for the prosecutors is bc she blames Karen Read for all this negative media plus having people looking into her, police, and the DA office just to name 3.
As a side note, I think they all thought Karen Read would be so scared and take their plea deal so they could bury all this information.

Why is it relevant as to which State the Doctor has given evidence ?
A highly qualified engineer testifying in Massachusetts versus another state matters not. The fact that the judge even made him go through his record of testifying is absurd. She is a disgrace to the bench
Hometown feels outclassed, also, the judge probably understands her ability to control this case has been taken from her by the fbi-for a good reason. Something bad happened in that house and she should have declared war on those cops
