After weeks of waiting Karen finally got served paperwork that she is being sued for Property Encroachment and Harassment. She has 30 days to respond. Apparently she called my lawyers office of which they did not engage with her. Simply told her that she needs to hire representation and they could not discuss the case with her.
Not going to lie that felt good after getting served 3 times for frivolous lawsuits. We can only speculate what went on in that house after she got her little present. However the end of the video highlights how we felt for sure.
Not sure what is going to happen next but we will give updates as they happen as always.
Legend has it, on a clear and quiet night, you can still hear Joanne screaming and cursing that white boy next door

The legal reality is that she has made your home unmarketable because of the encroachment onto your property. A property with an unresolved illegal encroachment is tied up in a land dispute. You can't transfer the title, because the buyer can't get Title Insurance. You must get the land back or she must buy the land on which she has encroached and you should sue for compensatory damages and devaluation of marketability. The liability coverage on her home owner's policy, usually $100,000.00, will have to defend the lawsuit against her, but will make a settlement, even if it's against her will, because the encroachment is illegal. She will lose the case because the insurance company won't spend money on a legal defense, the insurance contract allows the insurance company to choose settlement rather than defend, like in most auto accident claims where there is clearly an at fault driver. Also, her defamation (slander) of your reputation is compensatory under the liability coverage and usually a lawyer would take this case on contingency. I've seen cases settled when a home owner defames someone on Facebook. This is not legal advise, I am not licensed in your state, this is just my personal opinion, so it's worth what you're paying me.
You’re correct in that when her insurance company reviews all the filings, they may negotiate a settlement without her input. They may also drop her afterwards. There’s always the possibility that her insurance says (after reviewing all the documents), that her acts were malicious and planned, and thus illegal. That the insurance company doesn’t cover illegal acts and will not represent her in court. Which means she might have to hire a lawyer out of her own pocket.
The insurance company can settle the claim of her intentional tort and then use subrogation to sue her in her own name to recover the loss, placing a lien against her house. ie Jenny Jonhson in subrogation v. Jenny Johnson.

As entertained as I am by all of this, I'm so sorry you have to go through it.
This kinda thing happens all across the country where neighbors have disputes. Sometime people are not reasonable and we have to resort to the court.
I hope it all works out and maybe some day yall can get over it.

She can't build the fence where she wants due to a utility easement and somehow thought that entitled her to put it on her neighbor's property...uh, no. It's childish BS that will end up costing her thousands not to mention the bad blood. What a nasty unreasonable woman.
I love that your attorneys refused to engage with her. I can imagine her trying to talk over the receptionist and continuing running her mouth then hearing the click as the receptionist hangs up. To paraphrase he husband "Lawyer? We don't have one of those...". Well now they get to go find someone to take the case, hand over $5-10K retainer and watch the Benjamins fly out the window. Any good attorney will tell them to move the fence and STFU, it will be cheaper than litigating and having to do it anyway.
An attorney cannot deal with an unrepresented party; that is basic legal ethics. Of course they could advise the court they are representing themselves. LOL!
@patrickmckeegan On rare occasions when someone would call and be inherently rude, or abusive, etc, our receptionist (at a law office) would say "let me put you through to Mr. Click", and promptly hang up the phone.
actions have consequences. now it's not YOUR inconvenience, now it's HERS!!!

Apparently they have a legal history of frivolously suing people as well. She is 0-4 with just me. Going to show her what it's like to have proof and a good case.
@@redzot Yes. You need to sue for the max because the judge may try to reduce the amount or split the difference, leaving you paying part of the expense. Don't let that happen. Go all the way now and put an end to it, and end up getting enough settlement money to move away from them, if you want to.

Now, have no communication with them until everything is over and you have cashed the check from their insurance company. Only communicate with their lawyers, through your lawyers. Keep recording what they say or do, silently, but don't respond to them. They'll probably try to goad you into saying or doing something that they can use to portray themselves as victims. Don't fall for their tricks and traps.

What insurance... nothing will be covered by insurance.. it was a deliberate act.
@@TormentedPenguin I think they refer to the homeowner's insurer, where they may or may not represent her in court over a property dispute. Chances are, since Karen built on a disputed property line and later was found to have encroached, her insurer will settle out of court instead of representing her. Then they'll increase her rates or drop her as a client. She can't win this one, and may be on the hook for punitive damages due to her behavior.

Sweet relief! Finally getting the ball rolling. There was no talking things out or waiting for her to come to her senses. Not happening. Legally addressing the issue was going to be the only way. It’s too bad that it’s up to the person being harassed and having their property taken to have to spend money and time in order to get results through the court system.
....then she tore it up into tiny pieces, and repeated all the vulgarity she knew, plus, made up some new ones.
...she hasn't stopped screaming yet. 😄

I had a neighbor like this. Constantly encroaching. And we both had surveyor documents. His property was a complete sh*thole. Old vehicles, boats, empty chemical drums, building materials, campers, old mowers. Mental illness knows no limits. His wife has spent the last 18 months having people cart the garbage away after he died from covid around January or February 2022. Problem solved. She wasted no time apologizing for the inconveniences he caused.
Now the shoe's on the other foot. I hope it fits snugly.

This is so sad. I'm glad you handle it well, tell the truth, back it up when necessary and you still seem to genuinely care about them regardless of what has happened. I don't know what makes people turn on a dime sometimes. It's awesome you also are worried about the dispute for people who could buy your home in the future. Most of the time people check no disputes and leave the drama for the next purchaser.

Reminds me of a neighbor when I was little and their 'war' with their wacked out next door neighbor. I swear, you can't make this kind of stuff up if you tried.
Does this mean a court appointed surveyor will settle the actual property line? Or does this mean another survey will have to be performed out of your pocket? It would be nice if the sheriff would be standing around during the survey informing them to not speak to or interfer with the workers in any way or go to jail for distubing the peace.
We have both had surveys done. Hers came back the same way as mine. Her fence is in the wrong side.

Looks like there will be a resolution on this very soon. Good deal, life's too short for petty squabbles. I had a similar issue with a neighbor. When we moved in next door,he told us all kinds of stories about how the previous owner (builder) had encroached into the setbacks. My wife and I had the property surveyed, and we were all good, but his driveway was about three feet across the line. I gave him a copy of the survey, his response was asking me if the surveyor would give him a discount to survey his lot, since one side was already done. Our relations with them went downhill when I asked him not to build his dock on our property. We moved a year later.
Been away traveling for work the last two weeks and came back to this surprise. Yep! That simulation is spot on. Have no doubts. Sorry that it had to come to this, know it’s the last thing you want to have to do, but at this point it’s a moral imperative and what’s right. Not to mention very satisfying 😊.
