Recently, the EPA issued a fine against PFI Speed, a small speed shop in Colorado, for selling just 37 Hondata S300s over a two-year span. The fine was issued after company owner Brent Leivestad complied with an EPA inquiry for details about the company’s sales. Without any other contact from the EPA, Leivestad was shocked to receive a letter accusing the shop of selling illegal products. The letter included an $18,000 fine that, if not paid within 30 days, could increase to as much as $180,000.
“I was dumbfounded. I couldn’t even believe it,” said Leivestad. “I am a speed shop and sell race parts-I didn’t know that was wrong. I didn’t understand the basis of the EPA’s claim, I didn’t go in front of any trial or talk to anybody from the EPA, and the threat of ‘settle and pay within 30 days or else’ felt like a real shakedown intended to deny my rights.”

“There are thousands of legitimate motorsports businesses that are at risk of EPA overreach,” said Dr. Jamie Meyer, Performance Racing Industry (PRI) President. “The EPA is putting these businesses-which are typically small, home grown, less sophisticated shops-in situations where they have to take on the full might of the federal government. The EPA is doing nothing to validate its enforcement efforts, and these small businesses are left with little choice but to comply.”
“The RPM Act must be passed into law to provide the racing community with certainty and confidence in the face of EPA threats,” said Meyer. “Without the RPM Act, businesses will shut down and the entire motorsports community will be severely impacted. It’s time for the motorsports community to push back and protect our racing rights.”
Leivestad agrees: “I’ve been doing this for 20 plus years, and it sounds like the EPA is trying to put us out of business. We need to get behind the RPM Act and get it pushed through now, more than ever.”

These agencies themselves are unconstitutional, let alone the rules they lay down. Folks need to start realizing the the EPA, FDA, NSA, DHS, FBI, CIA, all of them, claim authorities which were never delegated by the member states of the union. Remind your county sheriffs that, as the only elected law enforcement officers in the land, directly answerable to the People of the county, they are the authorities within their counties and they can defend People against all the federal agencies, tell them to leave their counties, and arrest them if they return or for otherwise violating the rights of the People.

I have met so many guys in my life who would have some sort of some substance abuse (or used to) issue if it wasn't for cars and racing. This is a way that grown men who work 8,10, and 12-hour days unwind on the weekends. It's a way that they pass down how to service your car to their children. It's a way that they can pass down a healthy distressing outlet.

What's fuched is that I can roll my 69 Big Block 461 600hp 442 tearing up 6-7mpg premium fuel and the cars running these systems still burn fuel 5 times cleaner than my car, make more hp and because of the age of my car I'm good......🤦♂️

This is about having the freedom to do what you want to YOUR vehicle and YOUR responsibility if it is used on public roadways. There are many people who follow the law and those that don't. We should never make policies or legislation that infringe on other's freedoms regardless of "the goodness" behind the legislation. Goodness should be compelled individually through accountability and instead of making ridiculous laws that hurt others who follow the law. Instead, hold those accountable actually breaking the law.
It is not the responsibility of a shop to determine if a vehicle is a track only vehicle. That is on the end user and should be enforced as such. I shouldn't be punished because 19 year old Johnny wants me to put straight pipes on his car. What Johnny decides to use it for is his responsibility, not mine. The same argument applies to guns. It is not the fault of the shop who sold the weapon if it was to be used in a crime. The crime falls on the shoulders of the individual. Now can they make a thing where you have to fill out a something similar like a background check to purchase off road parts... sure they could. But its going to create more problems than it is actually going to solve.
Though, this is apparently too much work for our police though because they are too busy harassing Shantae driving while black. You see what I'm saying??
Lastly look at who benefits from this kind of crackdown. Big businesses that are pushing this legislation to increase revenues. This isn't about "clean" energy. This is really about big businesses lobbying for their own selfish desires. We are slowly legislating individual freedoms away and you are falling for it because you rationalize it through some type of perceived "for the greater good" mentality. When in reality that is just you who simply wants to be recognized and feel good about how others perceive you because it is an innate part of our ego.
Here in Europe they test emmissions yearly to get a sticker to be road legal. It doesn't matter if you have a custom ecu and put a v8 in a mini cooper. as long as it emits emissions lower than the law then it passes... America is fast loosing its "land of the free" motto :( ... Good luck PFI!

Well I live in Europe. Your are not allowed to put a v8 in a mini Cooper just as long emissions are lower. You you need also upgrade whole driveline and brakes and more to pass. It sounded a bit to easy, but it's possible.:)

I love how genuine and sincere Brent is. When he talks about his family and his passion he chokes up. I have never owned a Honda but a car guy is a car guy (gals are “car guys” too!). We have to unite and push back before our hobbies are gone.
Not just hobbies, but the ability to just fix your car and drive it on the road if you want. I have a 1994 truck that the ecu circuit board just burnt out on. With EPA trying to ban aftermarket ecu's the only choice you have is finding a used ECU that could potentially fail due to age again. The manufacturers and EPA don't care about old vehicles, they'd rather you throw em out and buy a new one. They also don't care if all the ridiculous new emissions equipment on new vehicles fail within a few years and end up in a landfill.

@@nilloc28 Yup the earth is constantly emitting all these gases into the environment naturally. Almost everything we buy comes from China that has basically no emissions regulations on their factories, far surpassing any vehicles we could own. But this isn't about emissions, it's about control.
Here's my issue... I'm all for the RPM act, race cars have been around since the start of the automobile but it all started with some random person modifying their STREET CAR in their garage. Who is fighting for us? I don't have the money to build a track only car! Nor do I have a race track close to me so I would need to have a truck and a trailer along with that track car. So now I'd also need space to store a race car, a trailer and a truck plus daily driven vehicles for my wife and I. Not everyone that wants to race has that opportunity, most of us simply modify our daily drivers to make them funner, faster, look better or lower/higher. We are Hot Rodding! We want our cars to be as clean running as possible, we want as much power as possible, we want clean air to breathe too! Why is it if I put a new engine and emissions equipment that get 30mpg in a vehicle that is 30years old and only got 10mpg with little to no emissions equipment that vehicle would no longer be "technically" legal because it no longer complies with 30 year old emissions standards, or because that out of date equipment was removed or tampered with?

@@crazeguy26 I've been working on increasing mileage and power running ethanol, and I have been coming up with ways to make ethanol to fuel my vehicles. Its actually quite easy to do, won't work with gasoline at all, and it burns clean only emitting CO2 and H2O. The EPA doesn't give a damn, if I was working with something newer than I am (Its almost all pre 1974) they'd probably come after me too. Its not about the environment, its about controlling us and our movement.

I've watched Bret and PFI speed for years on CZcams and have never seen him once race anything on the streets. All his cars are purpose built for the racetrack only and all the cars these parts went to are for track use only. If you ask me he should be refunded his fine and be allowed to continue business without any issues.

Brent is such an amazing person and PFI is a great American company. Makes no sense they would go after the small business and not the manufacturer. Shows the EPA isn't really out to protect the environment.

This is a problem that can be solved if we can get the right people to talk and work together.
True race cars that only ever see track time make up such a small number of vehicles, the emissions have a negligible effect on overall air quality. Race cars don't need to be emissions exempt either. We can make them reduced emissions. A limit needs to be found and set.
Amatuer car racing was born from the availabilty of production cars. Modifying your car is about as American as it gets. The EPA and even State Government is going to prevent us from touching the engine in even the simplest ways.
Here in Colorado, our new emissions laws require checking the ECU programming against a database. If the programming doesn't match, you fail emissions. This is regardless of what the programming changes are for. Want to change the temperature that your electric cooling fan turns on at because you tow? Now you fail emissions.
In the aftermarket world, we have the ability to make a 2000+ Horsepower engine pass the current emissions standards. But this doesn't matter if they won't even test the vehicle because of a programming mismatch.
We don't need emissions exemption. We need a pathway to pass emissions with modified vehicles.
There has to be an understanding that finding a way to pass emissions will lead to overall better air quality as it will prevent the current disaster of a situation were cars are returned to stock to pass, then immediately re-modified with no emissions equipment at all.

Well said, 5250 Performance. I am personally disappointed with the growing perception that modified cars are in conflict with clean air and clean emissions.
Modern ECU's and catalytic converters allow a predictable pathway to clean modified vehicles. I personally modified my daily driver to use E-85 because I believe it is a superior, cleaner, fuel in a turbo-charged vehicle (my vehicle is delivered stock with a turbo-charger). However converting to flex-fuel to use a cleaner fuel means that I must update the ECU. My vehicle will now "fail" emissions testing in Colorado because of the recent legislation to which 5250 Performance refers. I am profoundly frustrated by this outcome since one objective of the converting to flex-fuel was a cleaner daily driver. I achieved that objective and my car is now cleaner than it was than when it was born, and yet it "fails" emissions testing in Colorado simply because the ECU has been updated to correctly and cleanly burn the cleaner fuel. There is no option currently in Colorado to actually test the emissions of the vehicle under current law, only the contents of the ECU are inspected.
I am happy to pay an additional fee to have the same format of actual emissions test that was available in 2020 and for which all required infrastructure is available in Colorado. Why is that not possible?
Those of you reading this reply can infer that I lived in Colorado and have a vehicle that will not pass the current emissions testing requirements in the State of Colorado. You might be wondering how I solved my problem? I left Colorado. One of the reasons I left Colorado is the sharp disappointment you read here with respect to my car and the emissions requirements that do not make sense. I have to believe that driving residents out of the State of Colorado was not an intended outcome of the recent emissions requirements.

The current Administration is entirely hostile to fossil fuels and internal combustion engines. Your Hot Rod will have to be powered by an electric motor.... assuming they allow you to modify it in any way.

1. Who runs the EPA?
2. Who regulates them?
3. Who decides if someone actually broke a law?
4. Who can fine the EPA for being corrupt? Are they ever wrong?
5. How many people have "tuned" their vehicles and now it runs cleaner and burns less fuel?
6. If we buy a vehicle do we really own it? Or is the EPA sorta like the government and land taxes? Stop paying taxes and loose your land?
7. Who in the EPA sets the actual fine amounts? Some desk jockey who still frequents "Plenty Of Fish"?
8. Who in the EPA knows enough about OUR industry to honestly understand what is harmful and what isn't?
9. Does the EPA know that an airplane burns more fuel and pollutes more than hundreds of automobiles combined!?
10. Can the EPA fine Mother Nature? We all know a Volcano creates more pollution than mankind has in our history on this planet right?

So EPA is going to start attacking the businesses that supply racing parts or modifications? This is beyond ridiculous.
That quote about design I think is striking. As an engineer, there are different levels of design, there is engine design, there is ECU design, there is body design, etc. All of these things are snapped at one moment defining the design of that vehicle and all of the pieces of that design are maintained at Honda. By selling aftermarket parts including turbos, tuning kits, etc, we are reimagining that vehicle for a different purpose. If the vehicle was well suited for the intended purpose of racing, then PFI Speed would be out of business. These vehicles aren't. As such, they must be re-imagined and re-designed. By the EPAs own arguments, these vehicles are not being designed for on road use, and therefore they are applying the law incorrectly. Personally, this entire idea of the EPA playing shrink, and trying to get inside my head type of argument screams that they are trying to play make the accusation without proof. With the size of fine that they are levying, this must be a crime. Therefore, they need proof that indeed you sold parts for road vehicle use. The fact of the matter, the vehicles in question do not conform to any "road vehicle design" as designed by the manufacturer. The fact of the matter is that there is no evidence that these vehicles have been used for "on road use". The fact of the matter is that not only is there no proof that there was a crime committed, there is no indication that there was any intent to commit a crime. As such, even without the rpm act, the EPA has significantly over-reached and needs to be beaten back. (I do support the RPM act by the way).
My belief is that there is a group of EPA agents who are showing there superiors the "new" way of digging up enforcement by trolling through youtube videos all day. I wouldn't be suprised honestly if there isn't a think tank or other group trying to undermine any form of anything that regular people like that involves any connection to fossil fuels, fossil lubricants, or internal combustion engines. My thoughts on this are driven by seeing youtube blogs from other individuals engaged in performance tuning in the diesel arena and other areas where there have been massive fines. I don't know if it is just youtube, though there are others getting hit on youtube engaged in tuning and modifying internal combustion engines. This is very concerning as this cuts across right to repair, as well as our ability to teach our population how to design and build mechanical items. These skills are directly needed for war just like the amateur radio groups are pulled from during times of war to support military communications networks. Currently, our military and our ability to defend ourselves directly relates to electronics combines with combustion. All of the sorts of tests that you need to run to make sure a military digital radio system is properly functioning are also skills that you would need in order to program and peek these race cars. This is more that just a community under attack. This is a specific and very important skill set among our population which is under attack.

I talked to my dad about this, a supervising investigator for the EPA in Denver. He didn't know anything about it, which he said means it came from some low level peon trying to make a name for themselves. I doubt that the wheels of time can be turned back on this incident, but now that a high level guy is aware, hopefully this is the last issue for race shops in Colorado.

Definitely sharing this I been watching PFI for many years after been done with drug abuse because I found a great hobby and awesome new friends in this industry that keep me strong and looking forward staying away from my old life slowly building my race car and helping each other, together we’re stronger

The first thing you should do after ANY letter like this from the .gov is get a lawyer.
Here's the thing, if the EPA would do their job to limit the amount of pollution big multimillion dollar factories put out, there would be no need for them to bully around the common citizen.
The ammount of pollution that we the common folk contribute with is a ridiculously small percentage, compared to other sources of hazardous waste products.

As a South Australian, there are only 2 tracks that are really open to the public and only a few times a year, yet they wonder why people do stuff on the street, It pisses me off

Anyone who owns a business should pay attention to this situation. Brent made a mistake by just complying with a request for information from a Federal agency. PFI Speed should have reached out to a lawyer to find out what is protected and what has to be turned over to the EPA. Chances are, PFI screwed themselves over by just complying automatically. Let the EPA go through the courts to demand a copy of your records.
